Plaintiff vs. Defense: Attorney Views in Employment Cases TOM FOLEY and FRANK HARTy Participants will learn from Tom Foley, a Plaintiff’s attorney, about what he looks for when a person comes to see him and wants to sue their employer for a violation of their rights in the course of their employment. Frank Harty, a defense attorney, will discuss what he advises will be needed to win the case. They will both discuss common errors employers make. Participants will also learn what documents employers need to keep, witness preparation and what common mistakes are made in employment documentation. Learn a few tricks of the trade and how to protect yourself. The Temp to Hire Advantage Katie Roth Unfortunately, most bad “hires” have their roots in the interviewing process.  It is difficult in an interview (or two) to evaluate the characteristics of a successful employee.  That is why many organizations are turning to the temp to hire option to make sure that the candidate is a good fit culturally and has soft skills and attitudes to be successful.  Industry veteran Katie Roth will go over the pros AND cons of the temp to hire process, how it works, what questions you should ask when you are looking at a temp to hire position, how to determine the value versus the cost, and common misconceptions about the process. FMLA Update Mike Staebell FMLA is 20 years old and additional regulations are being added. This session will provide an overview of current and the new regulations for FMLA. The session will also cover intermittent and reduced leave schedules, as well as employee and employer rights and responsibilities. Conflict: An Opportunity for Strategic Change Andy Visser Conflict is anything but rare. Some sources indicate that human resource managers spend 25 to 60 percent of their time working through employee conflicts* A University of North Carolina study showed that more than half of workers said anxiety about a past or present conflict with a co-worker cost them time while they were on the clock. More than a quarter of workers said they were less productive because they spent time trying to avoid a confrontation with a co-worker. HR professionals can engage in critical thinking using an analysis model of conflict assessment. Conflict intervention and consultation skills will be presented as a strategic leadership initiative. Conflict assessment will yield opportunities to input strategic initiatives in planning and organizational visioning.  Participants will recognize conflict resolution suitable interventions versus conflict management suitable situations. HR staff can provide strategic conflict intervention protocol’s which have a positive impact on productivity and employee health affecting the bottom line. There are numerous “tests” outlined by academics and regulators. Frank, who is one of the handful of lawyers in the nation who has tried an independent contractor case to a jury, will tell you what really matters. Attendees will learn what is an “independent contractor” and also what penalties and possible litigation an employer faces when it misclassifies an employee as an independent contractor. As leaders interact with others, it is important to remember not only what they are trying to achieve, but also seek to understand what the other person’s interests are. It is critical that leaders arrive at solutions that will result in win/win for long term success for the organization as well as the relationship. Trends in Health Insurance, Wellness and other Benefits in Iowa David P. Lind David will review the latest  trends from the 2012 Iowa Employer Benefits Study, specifically relating to health insurance and wellness initiatives. In addition, the newly-released index about Iowa employee benefits will be discussed. Known as the ‘Lindex’, this index is designed to measure and compare benefit packages offered by individual employers to distill voluminous and complicated data into one relevant number. Department of Labor Update Mike Staebell Fresh from meetings in Washington, Mike Staebell will cover new rules and regulations coming out of the Department of Labor for both the Fair Labor Standards Act (FLSA) and the Family and Medical Leave Act (FMLA). Mike will also cover the Department of Labor’s new enforcement strategy, including targeted industries and issues such as independent contractors. Public Sector Bargaining Mike Galloway This session will provide the basics for successful contract negotiations in the public sector.  The session will provide a detailed analysis and explanation of the law and emphasize new developments under Iowa Code Chapter 20.  The session will also focus on strategies that Employers can implement for negotiations current and future negotiations. This session will cover important recent developments in employment law and an update on recent Supreme Court and eighth circuit decisions. Get Ready for the Impact of the PPACA for 2014 Steve Flood Employers need to get prepared for the major changes that are coming in 2014 with the Patient Protection and Affordable Care Act (PPACA) and for questions from your employees (not to mention the CEO and CFO). The Exchanges are a major component of the PPACA which will affect employers.  Steve Flood will address issues regarding the Exchanges.   In October 2013 state and federal exchanges will begin sending out information for enrollment. Employees are going to be confused and look to you for answers. There are many aspects of the PPACA that employers need to become aware of for budgeting purposes and for the monthly tax employers will be charged. Steve will cover those facets of the law that need to be done NOW. Managing the FMLA Certification and Re-Certification Process Jim Gilliam In this presentation we will review the importance of reviewing FMLA certification forms submitted by an employee’s medical provider for legal sufficiency and the proper steps to take before FMLA use is approved. Once approved, we will cover how an employer can use the recertification process to make sure FMLA decisions are being made on the latest and best medical information. We will also cover documenting your steps to improve defending your actions from retaliation or wrongful termination claims. Evolving Drug Testing Issues in Iowa William Judge Workplace is an ever-changing legal area.  Are you aware that the courts recently changed the definition of “accident” under Iowa drug testing law?  Do you know the rules for drug testing in other states in which you operate?  If you don’t it could cost your company and you personally!  Because they didn’t follow state law, UPS recently lost nearly half a million dollars and the supervisor in the case lost $50,000 personally.  Let’s be sure you know the rules. Is E-Learning Right for Me? Carol Kristensen What you need to know before embarking on an E-learning journey. Immigration Issues for Employers Austin Kennedy  The Agriprocessors immigration raid in Postville, Iowa, has fallen from the headlines, but worksite enforcement remains an important topic for employers here in Iowa.  Austin Kennedy’s presentation will provide an overview of government agencies involved with worksite enforcement, while also identifying recent enforcement trends.  The presentation will help employers understand how to best protect themselves from potential sources of liability within their company’s workforce, with a focus on the role the Form I-9 plays in the employment eligibility verification process. Open Records/Open Meetings Update in the Public Sector MATTHEW Brick The purpose of this presentation is to provide general guidance on the Iowa Open Meetings and Open Records Law, which are Chapters 21 and 22 of the Iowa Code. The open meetings law requires meetings of governmental bodies to be open to the public. The open records law provides that every person has the right to examine and copy public records and to disseminate the information contained therein. Generally speaking, the Iowa Open Meetings and Open Records Laws favor openness, so situations where the applicability of these laws is unclear typically are resolved on the side of openness. However, municipalities often have questions about the specific applicability of these laws while undertaking day-to-day business—especially when encountering issues such as closed meetings, electronic meetings, confidential records, e-mails (both personal and business purposes) and the Iowa Public Information Board. She received her B.A. in Political Science and International Studies from Miami University in Oxford, Ohio and her J.D., with honors, from Drake University. Rowena Crosbie is a Past President of the Central Iowa Chapter of ASTD and a past Board member of the National Management Association of Iowa. She serves on the Advisory Council for Iowa State University’s Center for Industrial Research and Service (CIRAS). Ro also serves on the LEAD Advisory Committee at Drake University. In 2010, Ro was appointed by the Governor of the State of Iowa to the Regional Workforce Investment Board. Ro served as an Advisory Board member of the America Reads, America Counts Program in Iowa. Helen Eddy is the Assistant Vice President, Health and Wellness, for Hy-Vee, Inc. She is also the Executive Director of the Healthiest State Initiative. Helen graduated from the University of Iowa College of Pharmacy in 1982 with a B.S. in Pharmacy. She received her M.B.A. from Drake University in 1984. Helen began her professional career as a salesperson for Eli Lilly. She has been employed by Hy-Vee, Inc. for twenty-four years, the first eight years as a pharmacy manager. In 1995, Helen moved into the Hy-Vee corporate office as a pharmacy supervisor and held a number of positions in pharmacy operations before assuming her current role in 2010. In her current position, Helen oversees Hy-Vee’s health and wellness initiatives.

Mary Funk, ATTORNEY, is a shareholder with Nyemaster Goode in the Litigation Department, handling almost exclusively employment and labor matters.  She litigates on behalf of management in state and federal courts, administrative agencies and before arbitrators concerning employment contract disputes; sexual harassment; race, sex, age, national origin and disability discrimination; wrongful termination; Family and Medical Leave Act; Fair Labor Standards Act; non-compete agreements; and unemployment. Tanya Fish is a Health Management Consultant for Wellmark. She has over 10 years in health and wellness management, including five years as a Wellmark wellness consultant. She managed corporate fitness centers for Park Nicollet HealthSource, Minneapolis, Minn., as well as provided services for national fitness certification, wellness screenings and workplace health consulting. She has a Bachelor’s of Science in athletic training and biology from Buena Vista University and a Master’s of science in organizational leadership from Grandview University. Steve Flood has more than 25 years of employee benefits expertise with 20 of those years at Holmes Murphy & Associates. In this time Holmes Murphy’s corporate benefits division has grown over ten-fold and is the largest benefit consultant in the state of Iowa and one of the largest in the Midwest. Steve is an industry leader in the adoption of Consumer Driven Health Plans, as well as a pioneer in using wellness programs to improve the overall health status of employees and reduce employer costs. Moulder Chief Moulder has been in law enforcement for forty-four years. In 2003, he retired after serving eighteen years as Police Chief for Des Moines, Iowa. Chief Moulder has a Master’s Degree in Public Administration and currently serves as chair of the Resolutions Committee for the International Association of Chiefs of Police (IACP). The Resolutions Committee guides the policy for IACP. He has been the Legislative Committee chair for the Iowa Police Executive Forum, a statewide Organization of Chiefs of Police and has served as the chair of the Polk County Chiefs and Sheriffs Association.

After 20 years investigating more than 100 homicides and numerous other crimes against person or property Quinn was promoted to Special Agent In Charge, supervising all field operations investigations and personnel for DCI’s Zone 1. Quinn is also a leading expert in training officers statewide on the back techniques of interviewing and interrogations.  Quinn is a 1982 graduate of Iowa State University.  He has also completed Drake University Certified Public Management Program, Northwestern School of Police Staff and Command.  He a 2007 Leadership Iowa Graduate. Nancy Roehrkasse, SPHR, is a senior human resource consultant with HR-OneSource. Nancy has been in the human resources field for over 30 years.
