ORDINANCE NO. 02 , Series 2017 INTRODUCED BY: COUNCILOR ALEXANDRA LYNCH AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAFAYETTE, COLORADO, ENACTING THE CLIMATE BILL OF RIGHTS AND PROTECTIONS

WHEREAS, the people of the City of Lafayette find that global environmental destruction, which includes degradation to the climate, ecosystems, flora, fauna, land and water, constitutes an emergency that threatens our very survival; and WHEREAS, the people of the City of Lafayette believe that the systematic poisoning of our water, air and soil are activities that directly affect the health and safety of all residents and infringe upon our right to life, liberty and property; and WHEREAS, the people of the City of Lafayette find that the environmental degradation and introduction of toxic chemical pollutants resulting from the extraction of coal, oil and gas, and disposal of drilling waste within the City would significantly contribute to environmental destruction, and lifeendangering health risks. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAFAYETTE, COLORADO, AS FOLLOWS: Section 1.

Climate Bill of Rights.

(a) Right to a Healthy Climate. All residents and ecosystems of the City of Lafayette possess a right to a healthy climate and life sustaining resources, which shall include the right to be free from all activities within the City of Lafayette that interfere with that right, including the extraction of coal, oil, or gas, disposal of drilling waste contaminated drinking water, lethal carcinogens, toxic gases and other byproducts of industrial activity which threaten human physical and neurological systems. (b) Right to Local, Community Self-Government. All residents of the City of Lafayette possess the right to a form of governance which recognizes that all power is inherent in the people of the City, and that all free governments are founded on the people’s authority and consent. Laws adopted by the people of the City shall only be preempted or nullified if they interfere with rights secured by the state or federal constitution to the people of the City, or if they interfere with protections provided to the people or ecosystems of the City by state, federal, or international law. (c) Right to Defend. All residents of the City of Lafayette possess the right to defend this law. To secure this right, entities which violate the people’s right to a healthy climate and sustainable ecosystem shall not be deemed to be “persons,” nor possess any other legal rights, privileges, powers, or protections which would interfere with the enforcement of that right. (d) Right to Defense. All residents of the City of Lafayette possess the right to have the City government of Lafayette defend this law on the basis that a constitutional right of local, community self-government exists, that this law is an assertion of that right as it seeks to expand the rights of the people of the City of Lafayette, and that the doctrines of ceiling preemption, municipal subordinancy

to state government, or corporate “rights” unconstitutionally violate the right of the residents of the City of Lafayette to local, community self-government. Section 2. If any article, section, paragraph, sentence, clause or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid. Section 3. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof is hereby repealed to the extent of such inconsistency or conflict. Section 4. The repeal or modification of any provision of the Code of Ordinances of Lafayette, Colorado by this ordinance shall not release, extinguish, alter, modify or change in whole or in part any penalty, forfeiture or liability, either civil or criminal, which shall have been incurred under such provision. Each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings and prosecutions for enforcement of the penalty, forfeiture or liability, as well as for the purpose of sustaining any judgment, decree or order which can or may be rendered, entered or made in such actions, suits, proceedings or prosecutions. Section 5. This ordinance is deemed necessary for the protection of the health, welfare and safety of the community. Section 6. This ordinance shall become effective upon the latter of the 10th day following enactment, or the day following final publication of the ordinance. Recommendation: Motion to approval on first reading Ordinance No. 11, Series 2017 / Sale of City Property / Tract A West Ridge Filing No. 1 Background: In December 2015, Hix-Snedeker Companies (HSC) purchased Tracts B and C of West Ridge Filing No. 1, which area is 23.36 acres. HSC is based out of Daphne, Alabama and is a developer of single and multi-tenant commercial properties throughout the United States. HSC purchased the properties for $4.25 million or $181,934/acre. After HSC purchased the property, staff worked to make the most economically viable use of the property. The City owns Tract B, West Ridge Filing No. 1, which is 4.27 acres. To make the most economic use of the property, with the most efficient use of roadways and building placement, the developer must acquire the City’s property. HSC, approached staff to purchase the City’s 4.27 acres within the West Ridge Subdivision. The City purchased the property in January 2008 for $980,000 or $229,508/acre. HSC paid a lower per acre cost for their land than the City did. However, staff and the developer agreed to a purchase price that would have the City recouping 100% of the City’s cost. The Lafayette Promenade has received Sketch and Preliminary Plan approval by the Planning Commission. In February 2017 HSC submitted their final plan for staff review and Council approval. Staff anticipates presenting the Final Plan to Council in early May. The purchase of the City’s property by HSC must occur prior to recordation of the plat which will make Tracts A (City), B and C (HSC) one lot. Fiscal Impact: The property was purchased for a potential future peaking plant by the Water Enterprise Fund. As such, if approved, the $980,000 will be returned to the Water Enterprise Fund. ORDINANCE NO. 11, Series 2017 INTRODUCED BY: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAFAYETTE, COLORADO, APPROVING AN AGREEMENT FOR, AND AUTHORIZING THE CONVEYANCE OF CITY-OWNED REAL PROPERTY IN WEST RIDGE FILING NO. 1 SUBDIVISION TO HSC LAFAYETTE, LLC, AND HIX SNEDEKER COMPANIES, LLC

WHEREAS, Lafayette is the owner of Tract A, West Ridge Filing No. 1 Subdivision in Lafayette, Colorado, (“Tract A”); and WHEREAS, while Tract A was originally acquired by Lafayette as a potential location for a water “peaking” facility, the status of Lafayette’s municipal water system is such that Council has determined that the property is not required for such use; and WHEREAS, Tract A is not currently used or held by the City of Lafayette for utility plants or systems, nor has it been used or is it held for open space or park purposes, and thus an election is not required to authorize its conveyance; and WHEREAS, Lafayette, subject to Council approval, has executed a “Contract to Buy and Sell Real Estate (Commercial) dated ____________________ with HSC Lafayette, LLC, and Hix Snedeker Companies, LLC, with regard to Tract A of West Ridge Filing No. 1 (“Agreement to Sell”); and WHEREAS, City Council wishes to approve the Agreement to Sell and to authorize the conveyance of Tract A. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAFAYETTE, COLORADO, AS FOLLOWS: Section 1. The Agreement to Sell between the City and HSC Lafayette, LLC, and Hix Snedeker Companies, LLC, for $980,000.00 is approved by City Council in a form approved by the City Attorney. The Mayor and City Administrator are authorized to execute all documents as are necessary to carry out such conveyance. Section 2. The conveyance of Tract A pursuant to the Agreement to Sell is authorized by City Council, and the Mayor and City Administrator are authorized to execute all documents as are necessary to carry out such conveyance. Section 3. First Reading / Ordinance No. 12, Series 2017/ Supplemental Carryover Appropriation

Recommendation: Council motion to approve Ordinance No. 12, Series 2017, amending the 2017 Budget on first reading and authorizing appropriate 2016 purchase orders/expenditures to be reissued as 2017 purchase orders/expenditures. Background: The preparation of the supplemental appropriation at this time is a routine procedure required on an annual basis to carry over purchase orders not fulfilled at the end of 2016, unspent balances of grants and donations received in 2016, and the appropriation of other budget items with a high priority. Carrying forward existing purchase orders and/or previously budgeted items that have not yet been implemented has no affect on forecasted fund balances. Expenditures are merely being lifted out of one year (2016) and being place into the next year (2017). Amendments to the current budget can be made at any time. Customarily, the City passes a carryover appropriation ordinance in the Spring and a supplemental appropriation ordinance in the Fall. A capital project is defined as new, replacement of, or improvements to infrastructure (buildings, roads, parks, water and sewer lines, etc.), which has a minimum life expectancy of five years and a minimum cost of $50,000. Open capital projects are exempt from the re-appropriation process as a result of a charter amendment adopted in November, 2005. However, Staff is listing these types of carryforwards for reference. Unspent 2016 budgeted capital amounts that will be carried forward are considered in assuring that the combined carryovers added to the current 2017 budget do not exceed the projected 2016 year end fund balances. Carryovers take historically taken thee forms: •

Approved Budget items in progress. Budgeted projects, goods and services are frequently in a state of mid-completion at the end of a calendar year. Such items that were appropriated with the original 2016 budget are still considered important to City operations, but because they were not completed by the end of 2016, purchase orders were issued. Staff has requested that the monies be reappropriated from the 2016 to 2017 Budget. These items are listed in detail and in summary in the attachments.





Approved Budget items that have not yet begun. In some cases, projects, goods and services were budgeted in 2016 but were not begun/undertaken, for a variety of reasons (cost, timing, etc.). These items that were appropriated with the original 2016 budget are still considered important to City operations, but because they had not commenced by the end of 2016, purchase orders were not issued. Staff has requested that the monies be re-appropriated in 2016. Ongoing items. The City has interests in a variety of multiyear, ongoing projects. Examples of this type of item are restricted revenue carryovers from Walk & Wheel Grants, MM Theater Hist. Pres Grant, PEG Fees, Public Art fees, Parkland Dedication, Service Expansion Fee, Park Fee, Sidewalk Mtc Fee and ICMA-RC Admin Allowance. These items are not yet ready for Council approval – staff will return with the Restricted Revenue carryforwards in the near future. In 2015-16, there were $1,335,940 is these type accounts, mostly in Park Fees in Service Expansion Fees.

ORDINANCE NO. 12, SERIES 2017 INTRODUCED BY: AN ORDINANCE PROVIDING FOR ADDITIONAL APPROPRIATION DURING FISCAL YEAR 2017 FOR UNANTICIPATED 2016 REVENUES AND EXPENDITURES REQUIRED OF THE CITY OF LAFAYETTE, COLORADO, AND APPROPRIATION OF CERTAIN 2016 CAPITAL PROJECT ITEMS WHEREAS, the City Administrator has determined that actual revenues for fiscal year 2016 will exceed the anticipated revenues as reflected in the Budget Appropriation Ordinance No. 32, Series 2016, and WHEREAS, this additional revenue, along with various items previously approved by the City Council, must be re-appropriated in various City accounts in the 2017 Budget, and WHEREAS, certain events occurred subsequent to the adoption of the original 2016 budget resulting in unanticipated revenues and required expenditures during 2016, and WHEREAS, the City Administrator has determined that prior appropriations have been reclassified, and WHEREAS, the City Council may, by ordinance, pursuant to the provision of Chapter 8, Section 5, of the City Charter, increase or transfer specific expenditures in any account, department, fund or agency to another or reduce appropriations as may be necessary to achieve a balanced budget, and WHEREAS, Exhibit “A (Proposed Supplemental Appropriation Details)” attached hereto is a statement of proposed budget appropriations, and WHEREAS, the City Council of the City of Lafayette, Colorado, deems it in the best interest of the City to transfer unencumbered appropriations, and to add appropriations to accounts, departments, funds or agencies or to reduce appropriations, as fully set forth in Exhibit “A”, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAFAYETTE, COLORADO, THAT: The transfers of unencumbered appropriation balances and other identified additional appropriations or the reduction of appropriations set forth in Exhibit “A” is hereby approved and the City Administrator is ordered to affect the necessary increases and transfers to comply with this ordinance, and update beginning budget balances to actual for a more accurate statement of budget status..

CITY COUNCIL MEETING March 7, 2017 Call to Order The March 7, 2017, City Council Meeting began at 5:33 p.m. at the Lafayette Public Library at 775 West Baseline Road in Lafayette, Colorado. Roll Call Those in attendance included Mayor Pro Tem Gustavo Reyna and Councilors Brad Wiesley, Merrily Mazza, Alexandra Lynch, Chelsea Behanna, and Stephanie Walton. Mayor Christine Berg arrived at 6:30 p.m. Also present were City Administrator Gary Klaphake, Police Chief Rick Bashor, City Clerk Susan Koster, City Attorney Dave Williamson and Parks, Recreation, Open Space Director Monte Stevenson, PROS Assistant Director Ben Mazal and Recreation and Facilities Supervisor Tammy Tucker. Liquor Authority – Public Hearing City Clerk Koster presented an application for a new Retail Liquor License for Atlas Liquor, LLC, dba Atlas Valley Purveyors, 2770 Arapahoe Road, #100, in Lafayette. Ms. Koster said staff recommends Authority approval of the application. Mayor Pro Tem Gustavo Reyna invited owner John Cohagen to the lectern. He answered questions posed by the Authority. City Attorney Williamson had no issues with the application. Max Scott from Oedipus, Inc. presented the results of a Needs and Desire Survey supporting the issuance of the license. A motion was made by Councilor Lynch and seconded by Councilor Mazza to approve Resolution No. 2017-15 / Granting a new Retail Liquor Store License for Atlas Liquor, LLC, dba Atlas Valley Purveyors, at 2770 Arapahoe Road, #100 in Lafayette. The motion passed unanimously. Adjourn to Executive Sessions At 5:45 p.m. a motion was made by Councilor Behanna and seconded by Councilor Lynch to adjourn to Executive Session According to C.R.S. 24-6-402(4)(b), to confer with a City attorney for the purposes of receiving legal advice on specific legal questions pertaining to North Highway 287 . The motion passed unanimously. Return to Regular Session Mayor Pro Tem Reyna said the executive session concluded at 6:30 p.m. The participants in the session were Mayor Pro Tem Reyna and Councilors Wiesley, Lynch, Behanna, Mazza, and Walton. Also in attendance were City Administrator Klaphake, Assistant City Administrator/Economic Development Specialist Caruso, and City Attorney Williamson. Mayor Pro Tem Reyna asked if any person who participated in the executive session believed that any substantial discussion of any matters not included in the motion to go into the executive session

No one answered in the affirmative. Public Input Brian Wong (Lafayette) spoke about the importance of respecting all sides of an issue in public discourse. Mayor Pro Tem Reyna asked Council to consider his revision of the ordinance. A motion was made by Councilor Mazza to approve Ordinance No. 02, Series 2017 as written. The motion failed for lack of a second. Council discussed revisions proposed by Mayor Pro Tem Reyna. A motion was made by Councilor Lynch and seconded by Councilor to approve Ordinance No. 02, Series 2017 as revised by Mayor Pro Tem Reyna with the section on Direct Action removed, and to put the revision into the format of an ordinance for second reading. Item J A motion was made by Councilor Behanna and seconded by Mayor Pro Tem Reyna to approve the contract with Thorne Nature Experience for the Great Outdoors Colorado Inspire Initiative – Nature Kids Programming and Pathways. The motion passed unanimously. Item N A motion was made by Councilor Behanna and seconded by Mayor Pro Tem Reyna to approve a development agreement with Feed & Grain LLC for the Lafayette Elevator Site. The motion passed unanimously. Council Appointment A motion was made by Councilor Behanna and seconded by Councilor Lynch to appoint Tom Hardie to an Alternate position of the Energy Sustainability Advisory Committee. The motion passed unanimously. City Administrator’s Report City Administrator Klaphake presented details of a proposed rental housing inspection program. He said the Boulder County Housing Authority doesn’t have the ability to provide short-term housing for those who are temporarily displaced by failed inspections. Councilor Walton expressed an interest in a program that does more than just inspection; such as one that includes an educational component, and addresses tenant/landlord issues.

Mr. Klaphake said the owner of the Circle Motel had to leave town and requested the hearing for the historic designation of the property be rescheduled from March 21, 2017 to April 4, 2017. A motion was made by Councilor Behanna and seconded by Mayor Berg to approve the rescheduling as requested. The motion passed unanimously. Councilor Lynch asked staff to put redacted applications for positions on boards and commissions on the City’s website. City Administrator Klaphake asked the City Clerk to prepare a standardized application for this purpose. Mayor Berg asked staff to create a group email address for boards and commissions. Councilor Walton asked staff to provide rates of diversion for Lafayette’s waste and gather data from other jurisdictions.

Recommendation: Motion to approve the Site Plan and Architectural Review for Lot 4D, Overlook Subdivision Replat D Background: On February 28, 2017 Planning Commission unanimously recommended approval of the Site Plan and Architectural Review application for a 12,788 square foot Alfa Romeo car parts distribution office, showroom, and warehouse located at Lot 4D, Overlook Subdivision Replat D or 1450 Overlook Drive. The property is located east of 120th Street on the south side of Overlook Drive. The subject property was platted as part of the Overlook Subdivision Replat D approved February 2017. The property is zoned M1 (Industrial); office, showroom, and warehouse are approved uses for M1 zoned properties. The building is proposed to be a maximum of twenty-five (25) feet in height. In addition to the building, the site improvements include 10,066 square feet of landscaped area (16% of lot), eleven (11) parking spaces including one (1) ADA accessible space, and a fenced storage yard area. The building has provided architectural features on all sides but with the emphasis on the west and north elevations. Building materials include adobe textured metal panels, horizontal corrugated metal, storefront windows on the north elevation that are situated from floor to roof. Slate and pearl grey will be the primary colors of the building with a bright red stripe to accentuate the Alfa Romeo product color. The applicant has met all dimensional standards and the request complies with the setback and zoning requirements of the zone district. The purpose of this letter is to provide the information required to accompany the Site Plan/Architectural Review application form for Lots 4A and 5A in the Overlook Subdivision Replat D. The location of the proposed use is on the south side of Overlook Drive and east of 120th street referenced above as Lots 4A and 5A. The current zoning is M-1 as well as the adjacent and surrounding lots to the east, west and north of both lots. The adjacent land to the south is unplatted and owned by Boulder County.

The proposed use for Lot 4A - office/showroom and warehouse (Alpha Romeo car parts distribution.) Finished square footage for warehouse area is 9,581 sf and the first floor office/showroom area is 2,444 sf and second floor office area is 763 sf. Total square footage of building to be 12,788 sf. Parking was calculated using the current and anticipated number of employees at 5 which requires 10 spaces, one handicap and van accessible space. If the use would change in the future, there is ample room to add several more spaces if required. More asphalt has been added to encapsulate driving path to dock door area. Recycled asphalt will be used in the "Yard" area. Trash facilities will be provided inside the warehouse area of the building. The existing tiered retaining wall (~16-18 feet high) along the east as well as the (5) evergreen trees in the proposed landscaping plan we believe provides adequate screening for the back of the building.

The proposed use for Lot 5A - office and steel fabrication shop. Finished square footage for fabrication shop is 10,400 and the first floor office area is 1,615 sf and second floor office area is 362 sf. Total square footage of building to be 12,377 sf. Parking was calculated using the current and anticipated number of employees at 7 which requires 10 spaces, one handicap and van accessible space. An additional (3) spaces will be provided for the shop employees behind the building in the asphalted fenced yard. Trash facilities will be provided inside the warehouse area of the building. The lean to structures will be used as screening with aesthetically pleasing materials to match the proposed building. The entire back of the building will be adequately screened from view at 120th street.

Both buildings will utilize the insulated architectural adobe texture panels as the base material and then accentuating with horizontal corrugated metal and steel canopy and awnings. Lot 4A has the storefront windows from floor to roof as a main focal point with two tone gray panels and striking red stripe. Lot 5A has a few different roof heights and types as well as many wall articulations at the entire office area as the main focal point of interest. While Lot 4A gives a more modern feel with warm color tones, Lot 5A uses a blend of earth tones and a splash of rustic steel colors, all warm tones, which ties the two buildings together. Overall, we believe this project is a great fit for the Overlook Subdivision and the surrounding area not only in proposed use but in architecture and site design. Both buildings will be occupied by established businesses that have been in Lafayette for many years. The businesses have been here to see the City of Lafayette grow, enjoy the great benefits of working in the area and community and are looking forward to continue their success in their new facilities.

Background: On February 28, 2017 Planning Commission unanimously recommended approval of the Site Plan and Architectural Review application for a 12,377 square foot building for Construction Dimensions, an office and steel fabrication building with a materials storage yard located at Lot 5D, Overlook Subdivision Replat D or 1430 Overlook Drive. The property is located east of 120th Street on the south side of Overlook Drive. The subject property was platted as part of the Overlook Subdivision Replat D approved February 2017. The property is zoned M1 (Industrial); office, steel fabrication, and a materials storage yard are approved uses for M1 zoned properties. The building is proposed to be a maximum of twenty-five (25) feet in height. In addition to the building, the site improvements include 10,610 square feet of landscaped area (16% of lot), twentyfive (25) parking spaces including one (1) ADA accessible space, and a fenced storage yard area. The building provides architectural features on all sides but with the emphasis on the west and north elevations. Building materials and colors include adobe textured surrey beige metal panels, horizontal corrugated metal, trapezoidal standing seam metal roof, warm white metal panels, horizontal rustic steel metal panels, burned slate trim and awnings, a balcony with awning on the west elevation, and roof canopy. The applicant has met all dimensional standards and the request complies with the setback and zoning requirements of the zone district. The purpose of this letter is to provide the information required to accompany the Site Plan/Architectural Review application form for Lots 4A and 5A in the Overlook Subdivision Replat D. The location of the proposed use is on the south side of Overlook Drive and east of 120th street referenced above as Lots 4A and 5A. The current zoning is M-1 as well as the adjacent and surrounding lots to the east, west and north of both lots. The adjacent land to the south is unplatted and owned by Boulder County.

The proposed use for Lot 4A - office/showroom and warehouse (Alpha Romeo car parts distribution.) Finished square footage for warehouse area is 9,581 sf and the first floor office/showroom area is 2,444 sf and second floor office area is 763 sf. Total square footage of building to be 12,788 sf. Parking was calculated using the current and anticipated number of employees at 5 which requires 10 spaces, one handicap and van accessible space. If the use would change in the future, there is ample room to add several more spaces if required. More asphalt has been added to encapsulate driving path to dock door area. Recycled asphalt will be used in the "Yard" area. Trash facilities will be provided inside the warehouse area of the building. The existing tiered retaining wall (~16-18 feet high) along the east as well as the (5) evergreen trees in the proposed landscaping plan we believe provides adequate screening for the back of the building.

Finished square footage for fabrication shop is 10,400 and the first floor office area is 1,615 sf and second floor office area is 362 sf. Total square footage of building to be 12,377 sf. Parking was calculated using the current and anticipated number of employees at 7 which requires 10 spaces, one handicap and van accessible space. An additional (3) spaces will be provided for the shop employees behind the building in the asphalted fenced yard. Trash facilities will be provided inside the warehouse area of the building. The lean to structures will be used as screening with aesthetically pleasing materials to match the proposed building. The entire back of the building will be adequately screened from view at 120th street.

Both buildings will utilize the insulated architectural adobe texture panels as the base material and then accentuating with horizontal corrugated metal and steel canopy and awnings. Lot 4A has the storefront windows from floor to roof as a main focal point with two tone gray panels and striking red stripe. Lot 5A has a few different roof heights and types as well as many wall articulations at the entire office area as the main focal point of interest. While Lot 4A gives a more modern feel with warm color tones, Lot 5A uses a blend of earth tones and a splash of rustic steel colors, all warm tones, which ties the two buildings together. Overall, we believe this project is a great fit for the Overlook Subdivision and the surrounding area not only in proposed use but in architecture and site design. Both buildings will be occupied by established businesses that have been in Lafayette for many years. The businesses have been here to see the City of Lafayette grow, enjoy the great benefits of working in the area and community and are looking forward to continue their success in their new facilities.

1. All plant materials shall be in accordance with AAN specifications for number one grade. 2. All trees to be balled and burlapped, root control bagged, or containerized. 3. All shrub beds to receive rock mulch to a depth of 3" on water permeable weed barrier landscape fabric with 4" steel edging with rollover or cap. 4. Minor changes in species and plant locations may be made during construction, as required by site conditions or plant availability. Overall quantity and design concept to be consistent with approved plans. In the event of conflict with the quantities included in the plant list, species and quantities illustrated shall prevail. Recommendation: Motion to approve a Site Plan and Architectural Review for Vista Business Park, Lot 31 subject to the five conditions of the Planning Commission. Background: On February 28, 2017, Planning Commission recommended approval of the Site Plan and Architectural Review application for a 2 unit industrial building on the subject property located at 1747 Panorama Point. One of the tenants would be Panel Masters, which provides concrete construction, including foundations and tilt up panels. The primary function of the Panel Masters portion of the site would be to house equipment, trucks, and materials for construction activities in an enclosed storage yard. The applicants have anticipated office use for the other tenant. The subject property was platted as part of the Vista Business Park approved in 2000. The property is located southwest of the corner of Horizon Avenue and Panorama Point. The request is for a 13,177 square foot building on one floor located on a 2.16 acre lot. The front of the building is oriented to the east facing Panorama Point. With the inclusion of a Planning Commission condition of approval, the building provides four sided consistent architectural features. Building materials include painted tilt-up concrete, brick veneer and a metal roof. The scale is appropriate to the site and function of the project; the landscape enhances the project adjacent to the streets and will screen parking. With a Planning Commission condition of approval, the landscaping will blend well with the adjacent open space. The exterior lighting is cut-off in design and is not anticipated to shine directly on adjacent properties. Other site improvements include 47% of the site in landscaping and 37 parking spaces. The applicant has met all dimensional standards and the request complies with the setback and zoning requirements of the M-1 zone district. The proposed development complies with the Comprehensive Plan Land Use designation and a number of Comprehensive Plan policies. Planning Commission recommended approval of the request with 5 conditions of approval. Fiscal Impact: Normal fees and charges will apply where applicable. Attachments: 1. Background: In August of 2016, Matt was moved from Alternate position while another WRAC Board member requested Alternate status due to travel requirements of their business. Matt and this individual switched positions and were affirmed by City Council. Matt inherited this individual’s term appointment as a full Board member. That term has come to an end, The WRAC Board, at their March 2nd meeting recommended that Matt be reappointed to a new four-year term to the Board beginning next month.
