By uploading a photo with the #NFLPink and #TMsharemyphoto hashtags (“Photo”), you: 1. Warrant and represent that you own the rights to your Photo and that you have the written consent, release, and/or permission of each and every identifiable individual person in the Photo to use his/her respective name or likeness to enable inclusion and use of the Photo in the manner contemplated by the Ticketmaster LLC (“TM”), can make written copies of such permissions available to the TM upon request, and hereby agree to indemnify TM for such use; 2. Acknowledge and agree that you are granting TM the perpetual and unlimited to right for TM to exploit, edit, modify, display and distribute the Photo and all elements of such Photo, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to you or any third party; 3. Without limiting the foregoing, you agree and understand that your Photo may be combined with other Photos and distributed in a photo mosaic via email, blog, and other online sites; 4. Warrant and represent that your Photo is original to you and has been legally obtained and created, does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws or regulations; 5. If you are not yet at the age of majority in the jurisdiction in which you reside, you warrant and represent that you have obtained parental or legal guardian consent to upload your Photo; 6. Warrant and represent that your Photo does not contain any unlicensed images, marks or music, with the exception of NFL logo or NFL team logos in NFL licensed gear or apparel that may appear in the Photo; 6. Agree that the Photo shall not contain, include or involve any of the following: · Obscenity · Crude, vulgar or offensive pictures, depictions, images, language and/or symbols · Gang signs or symbols · Violence · Explicit sexual activity · Nudity · Illegal drug or alcohol use · Commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos or endorsements · License plates, phone numbers, personal addresses (physical or email or otherwise) · Website or web page links · Derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliation of other people (publicly or otherwise), any assault or threatening of others · Trespass or the violation of other people’s rights or property · Illegal (e.g., discriminatory, harassing) or inappropriate activity, behavior or conduct (e.g., inflicting emotional distress) · Conduct or activities in violation of these Official Rules · Any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable or offensive, as determined by TM, in their sole discretion TM is not obligated to use, publish, display or broadcast any Photo; provided however that you acknowledge that TM will rely on your agreement and compliance with these terms.
