Terms and conditions THE NEW ŠKODA FABIA – CAN YOU SHAKE IT?- COMPLETE CONTEST RULES These rules define the conditions for the "The New ŠKODA Fabia – Can You Shake it?" contest (hereinafter the "Contest"), and this is the only document that completely and bindingly defines the rules for this Contest. 1. CONTEST HOST AND ORGANISER The host of the Contest is ŠKODA AUTO a.s., a joint-stock company with its registered seat at Třída Václava Klementa 869, 293 60 Mladá Boleslav, Czech Republic, Company ID No. 00177041, registered in the Commercial Register at the Municipal Court in Prague, in Section B, File 332 (hereinafter the "Host"). The Contest organiser, ensuring practical steps during its holding, is MUSTARD s.r.o., a limited liability company with its registered seat at Prague 1 - Nové Město, Masarykovo nábřeží 246, postal code 110 00, Czech Republic, Company ID No. 28531418, registered in the Commercial Register at the Municipal Court in Prague, in Section C, file 148383 (hereinafter the „Organiser“). 2. CONTEST TIME AND PLACE The Contest will take place from 4.2.2015 to 15.2.2015. The Contest will take place on the Facebook page Škoda (https://www.facebook.com/skoda, hereinafter the “Contest FB Page”), on which communication with participants is primarily conducted. 3. CONTEST PARTICIPANTS The Contest may be entered by any individual who has reached at least the age of 18 and who resides in one of the countries where the Contest is being held. The Contest is being held in the following countries: ALBANIA, ANDORRA, ARMENIA, AZERBAIJAN, AUSTRIA, BELARUS, BELGIUM, BOSNIA, BULGARIA, CROATIA, CZECH REPUBLIC, CYPRUS, DENMARK, ESTONIA, FINLAND, FRANCE, GEORGIA, GERMANY, GREECE, GREAT BRITAIN, GUADELOUPE, HUNGARY, ICELAND, IRELAND, ITALY, KAZAKHSTAN, LATVIA, LIECHTENSTEIN, LITHUANIA, LUXEMBOURG, MACEDONIA, MALTA, MOLDOVA, MONACO, MONTENEGRO, MARTINIQUE, NETHERLANDS, NORWAY, POLAND, PORTUGAL, REUNION, ROMANIA, RUSSIA, SAN MARINO, SERBIA, SLOVAKIA, SLOVENIA, SPAIN, SWEDEN, SWITZERLAND, TURKEY, UKRAINE, UNITED KINGDOM.
By participating in the Contest, contestants confirm full acceptance of the rules and grant the Contest holder permission to process personal data as further specified herein. All persons who have participated in the preparation of the Contest, particularly persons employed by or in a similar relationship with the Host or Organiser, are ineligible to participate in the Contest, as are any persons in a similar relationship with the participating authorized partner ŠKODA or with agencies entrusted with ensuring the Contest, their family members and persons close to them. 4. CONTEST TIMING The Contest will take place in one round. The first Contest round will begin on 4.2.2015 and will end on 15.2.2015 5. Enter the Contest by writing your comment under the Facebook post. Only participants who answer correctly will be included in the draw.
The winners will be chosen from all participants who answered correctly by a randomized number, known only to assigned lawyers throughout the duration of the Contest. There will be THREE winners chosen. Prizes for the winners: One design ŠKODA package contains – namely: one t-shirt, one sweatshirt, one watch, one pair of shoes, one luggage, belt, one sunglasses. 6. NOTIFICATIONS AND DELIVERY OF WINNINGS The winners will be contacted by the Host or Organizer by e-mail no later than within 48 hours from the end of the Contest and will be asked to specify their postal mailing
addresses and personal data to facilitate all necessary actions to deliver the Prize. If the winner does not respond to the Host's e-mail or does not submit his/her contact information within 48 hours from when the e-mail is sent, the prizes will expire without substitute compensation. 7. CONSENT TO PERSONAL DATA PROCESSING By registering for the Contest, each Participant thereby confirms that he/she is aware of and accepts the rules for the Contest and expresses consent, in accordance with Directive of the European Parliament and of the Council 95/46/EC, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, for processing of his/her personal data by the Host as the administrator of personal data and/or by other parties contractually entrusted by that administrator, as well as for the purpose of disseminating commercial disclosures via electronic means in accordance with Directive of the European Parliament and of the Council 2000/31/EC of 8 June 2000, on certain legal aspects of information society services, as described below.
8. ACQUISITION AND USE OF RECORDINGS If a participant becomes a winner of the main prize, he/she grants consent for the Host to obtain and use the participant's portraits, written statements, photos and audio and visual recordings related to the participant and/or expressions of a personal nature obtained by the Host in connection with the hosting of the Contest and the delivery or drawing of winnings for commercial purposes in all communication media, regardless of their character and specifications, using all typical means, with their subsequent modification and with potential combination with other works and inclusion in a collective work. The participant grants the Host this consent free of charge without material, time, quantity or territorial limitations and may revoke the consent at any time by notifying the Host in writing. This consent shall also apply to third parties to whom the Host may provide such recordings and materials at the Host's own discretion. 9. OTHER IMPORTANT CONDITIONS: The Host exclusively shall determine the exact specification of the winnings. The displaying of winnings in promotional materials is illustrative. The Host shall not be liable for any damages arising for a participant as a result of the participation in the Contest. The participants are not entitled to demand money or other types of fulfilment as substitution for the prize. The Host is not otherwise hereby bound to provide fulfilment to the Contest participants, and the participants shall not be entitled to any fulfilment from the Host other than that expressly specified herein.
One participant can win only one of the first three main prizes during the Contest regardless of the content rounds. One participant can win only one prize in one round. The participant agrees that his/her photos may be used by the Organizer and the Host for marketing purposes and the Organizer and the Host will have publication rights for Contest website, Contest FB page, customer and in-house publication, exhibitions, website, documentation and promotional activities. A participant may be excluded from the Contest if the Host discovers or has reasonable suspicion that a participant or other persons aiding the participant have engaged in fraud in order to receive prizes or engaged in unfair conduct or conduct not based on the participant's knowledge in accordance with the rules. The Host shall not be liable for any failure to deliver messages or winnings. The Host shall not be liable for any mistake occurring as a result of technical or communication problems. The Host shall decide with final validity regarding any complaints or presented objections. The Host reserves the right without being required to provide compensation to shorten, postpone, suspend or cancel the Contest or to change or add to these rules unilaterally for the duration of their existence by notifying of such changes on the website specified above, where the valid and complete wording of the rules can also be found. This Contest is not in any way operated or sponsored by Facebook or associated with Facebook, and Facebook is not responsible for it. The information provided during the event will not be provided to Facebook. All questions, comments or complaints regarding the application must be directed to the Host, not to Facebook. This Contest is governed by the laws of the Czech Republic, except to the extent excluded by the applicable legislation of the participants' countries. ŠKODA AUTO can use personal data to provide better quality customer services, to innovate its application and all related ŠKODA AUTO products and services, and to simplify the use of this application, which can be achieved by eliminating the necessity of repeatedly inputting the same information and having the application adapt itself to the user’s specific preferences and interests.
