Neighbourhood Plan Update (Min 190 17.11.14)

District Council Delegated Decisions (Min 191 17.11.14) The Committee will recall at the last meeting, a question from the public as to the number of “at variance decisions” that had been delegated officer decisions at the District Council. It has been clarified that the role of the Town Council is as a statutory consultee on planning matters and the District Council as Planning Authority employs suitably qualified and experienced officers, who practice planning law daily. However the committee felt strongly that their local knowledge and feelings should be seen to be taken into account when a delegated decision is being made. The view of the Town Council is transparently seen when a matter is referred to the District’s planning committee and local councillors are able to attend and speak on a matter, however on delegated matters this is not perceived to be as transparent. Along with the Town Council, the District Councillor (Ward member) is also consulted, but not necessarily furnished with the view of the Town Council. The Committee are asked to consider whether they wish to make representation to the District concerning at variance delegations. If they wish the Committee could request that where the Town Council have recommended refusal on an application that the delegated officer either ; 1- Provide a brief but clear explanation as to why the recommendation was not upheld be reported back to the Town Council, or 2- In each case the view of the Town Council be discussed with the ward district councillor before a decision is made. The Committee are asked to advise their instruction, for the Clerk to approach the District Council.
