CSD Grower Agreement Frequently Asked Questions Why has CSD chosen to introduce a Grower Agreement? The agreements and licenses, which CSD has executed with third parties allowing access to these technologies, Germplasm and Seed Chemistry have strict legal, regulatory and stewardship conditions associated with them that are imposed both from their owners and from the Australian regulatory authorities. The terms of the grower agreement closely reflect the conditions and legal requirements to which CSD is held legally accountable.

Is there a benefit to me, the grower? The confidential information collected through the process will be used to assist CSD in pre-empting grower needs and develop innovative new product offerings to drive grower profitability.

How is an Agency agreement different to how I have been traditionally buying seed? In practice, there is little change to the physical process of ordering and receiving seed through your reseller, however the main difference is that the reseller, who is now a CSD agent, will not buy the seed from CSD and sell to you, but rather facilitate the sale direct from CSD.

Does this change where I buy CSD Planting Seed? No, our cotton planting seed is available through the CSD Agency Network which is made up of 21 suppliers who have been providing cotton planting seed to growers for many years.

When does the transfer of title on the planting seed occur under the new agreement? The transfer of title of the seed occurs directly between you and CSD following the full payment of monies owed and when all the obligations between CSD and you have been met.

The agreement mentions that a grower can only plant “CSD Cotton Planting Seed” on land they own or control. Isn’t this obvious? This is a requirement that CSD is held accountable for through the third party agreements and licenses it holds. This requirement is to assist with stewardship, purity and compliance requirements.

Does signing this agreement prevent me from buying cotton planting seed from other Cotton Seed Companies? Simply, no. The agreement only relates to cotton seed purchased from CSD.

Why does the agreement formally request reasonable access to our farm? Under the conditions to which CSD is legally bound by it’s third party agreements and the regulatory environment we operate in, we need to maintain reasonable access to crops planted using CSD planting seed should we be directed by a third party or an authority to do so.

Why does the agreement state that I must pay all third party fees as a condition of the agreement? The third party agreements, licenses and regulations under which CSD operates and supplies seed to you require this as a condition on CSD.
