Contest Rules and Regulations

Contest Period: Contest commences at 12:00 a.m. CST December 13, 2017 and closes at 11:59 p.m. CST December 24, 2017.
2. Eligibility: Must be 18 years of age or older to participate. Employees of Heights and Associates, LLC dba Massage Heights West Maple, and their immediate families, employees of Massage Heights Franchising, LLC and their immediate families, persons connected with the contest/prize draw and their immediate families i.e. prize sponsors, newsagents, wholesalers & their agents are NOT eligible to participate in this contest. 3. Entry: Contest entries will be awarded according to the following in-store purchased items: 1 entry for each retail product purchased during the Contest Period; 1 entry/ticket for each $100 in gift cards purchased during the Contest Period; 3 entries/tickets for each purchase of the then-current holiday promotion (3 1-hour massages for $199) during the Contest Period; and 4 entries/tickets for the purchase of a 12-month membership during the Contest Period. 4. Prizes: Prizes will consist of: Day 1 - one gift card redeemable at Fabulous Fashions valued at $50; Day 2 – one gift certificate for a Body Brite Facial valued up to $89; Day 3 – one Massage Heights gift basket valued up to $103; Day 4 - one gift certificate for a facial with Calla redeemable at Chroma the Salon valued up to $75; Day 5 – one gift certificate to Title Kickboxing Omaha for a 6pack of classes, gloves, and wraps valued up to $130; Day 6 – one gift certificate for a Body Brite Facial valued up to $89; Day 7 – one Chroma the Salon gift basket valued up to $110; Day 8 – one gift certificate for a 4-pack of classes, duffel bag, water bottle, and heart rate monitor redeemable at Orange Theory Fitness valued up to $200; Day 9 – one Date Night Package to include one $100 gift card to Fleming’s and one Massage Heights 60-min. couples massage valued up to $199.98; Day 10 – one 3-month Massage Heights Heightened membership valued up to $250; Day 11 – one Michael Kors purse (style and color may vary from picture) valued up to $500; and Day 12 – one diamond necklace provided by 14kt valued up to $1,480. No requests for refund or substitutions of any type are allowed. All taxes, duties, fees and surcharges associated with the prize are the responsibility of the winner. Odds of winning will depend on the number of eligible entries received. 5. Prize Draw: Random drawings will be conducted each day at 5:00 p.m. CST beginning December 13, 2017 and ending on December 24, 2017 by the Retreat Director of the Massage Heights West Maple, whose decision is final. Each entrant selected as a winner must comply with all terms and conditions set forth in these rules and regulations, and winning is dependent upon fulfilling all such
requirements. Winners will be notified by phone the morning following each drawing. If a winner cannot be contacted within fourteen (14) days after the first attempt to contact such winner, an alternate entrant will be selected at random from all entries received. If the prize notification is returned as non-deliverable, the winner will be disqualified and another winner will be selected in the original winner’s place. 6. Winner List: Heights and Associates, LLC dba Massage Heights West Maple will attempt to post contest winners to the Retreat’s Facebook page within thirty (30) days of the contest closing date. 7.
Redemption: Prizes are non-transferable and must be accepted as awarded. Heights and Associates, LLC dba Massage Heights West Maple are not responsible for a lost or damaged prize and in the case where the prize is lost or damaged it will not be replaced.
8. Conditions: By accepting the prize, the winner agrees that Heights and Associates, LLC dba Massage Heights West Maple may use the winner’s name and picture for advertising and promotional purposes without further consideration, unless prohibited by law. BY PARTICIPATING IN THE CONTEST, THE PARTICIPANT AGREES THAT HEIGHTS AND ASSOCIATES, LLC DBA MASSAGE HEIGHTS WEST MAPLE, MASSAGE HEIGHTS FRANCHISING, LLC, OR, THEIR SUBSIDIARIES, THEIR AFFILIATES AND ALL OF HEIGHTS AND ASSOCIATES, LLC’S, AND MASSAGE HEIGHTS WEST MAPLE’S OFFICERS, DIRECTORS, EMPLOYEES AND REPRESENTATIVES, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS FOR ANY AND ALL LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS CONTEST OR ANY PRIZE RELATED ACTIVITY. THE USE OF THIRD PARTY PRODUCTS AND SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND WITH YOUR AGREEMENT THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE YOU EXPERIENCE AS A RESULT OF YOUR USE OF THIRD PARTY PRODUCTS AND SERVICES. ANY WARRANTY THAT IS PROVIDED BY A THIRD PARTY IS PROVIDED SOLELY BY SUCH THIRD PARTY, AND NOT BY US OR ANY OTHER OF OUR AFFILIATES. Subject to all federal, state and local laws. right to make revisions to, cancel or suspend this contest for any reason including but not limited to a cause beyond the reasonable control of Heights and Associates, LLC dba Massage Heights West Maple which affects the administration or security of the contest. Any attempt to deliberately undermine the legitimate operation of this contest is a violation of criminal and civil laws, and should such an attempt be made, Heights and Associates, LLC dba Massage Heights West Maple will aim to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. This contest will be governed by and interpreted in accordance with the laws of the State of Nebraska, U.S.A., excluding its conflict of law principles.
