BURLESON ANIMAL SERVICES FOSTER HOME AGREEMENT

This is a Foster Home Agreement between_________________________ (Foster Home Volunteer) and the BURLESON ANIMAL SERVICES DEPARTMENT (Burleson Animal Services), 775 SE John Jones Dr., Burleson Texas and is applicable to any animal the Foster Home Volunteer is asked to foster. All animals are to be housed, fed and cared for by above-mentioned Foster Home Volunteer making no charges of any character for licensing, care, food, or service. The Foster Home Volunteer shall be personally responsible for the humane care, treatment and control of animal(s) in its care until returned to Burleson Animal Services. The above Foster Home Volunteer shall not hold Burleson Animal Services, its volunteers, staff or City of Burleson responsible for any damages resulting from scratches, bites, or material damage. Burleson Animal Services will retain ownership of all animals in foster care and will make all decisions regarding the adoption or euthanasia of the animals fostered. _____To ensure proper and humane treatment of its foster animals, the Animal Services Supervisor or designee may inspect the premises where any of its animals in foster care are being kept. This inspection may only be done with reasonable advanced notice to the Foster Home Volunteer and during regular business hours. Refusal of this inspection by the Foster Home Volunteer may be cause for Burleson Animal Services to revoke the privilege of providing a foster home by the Foster Home Volunteer and the immediate return of the foster animal(s) to Burleson Animal Services. . _____I understand that by participating in the Burleson Animal Services Foster Home Program I may receive an animal that has an undetected contagious medical condition. I understand that my personal pets may contract illnesses passed on from the foster animal and will in no way hold Burleson Animal Services, the City of Burleson, or their volunteers or staff, liable for any conditions or injuries my personal pet may receive. (Burleson Animal Services recommends that you keep your personal animal(s) separated from the foster animal for a minimum of 10 days as a precaution.) _____I acknowledge that I have read, understood and will adhere to all the terms, conditions, policies and procedures of the Burleson Animal Services Foster Home Program. I do understand that if at anytime, I cannot fulfill these terms, conditions, policies and procedures of the Burleson Animal Services Foster Home Program I will, by mutual agreement end my tenure as a Foster Home Volunteer. _____ I am responsible for knowing and complying with the ordinances of the city in which I reside. I will not exceed the number of animals I am authorized to house based on the guidelines of that city.

______ I request participation in the Burleson Animal Services Foster Home Program with the full knowledge and understanding of the potential harm, accidents, and injuries that that my participation in the Program could cause and I hereby agree to assume any and all risks attendant to my participation in the Program and further agree as follows: (1) I assume any and all liability and risks attendant to participation in such Program, whether occurring on public or private property, which might affect me in any manner whatsoever, (2) I hereby hold harmless, and release the City of Burleson, its officers and employees, in both their public and private capacities, from all liability for any harm, bodily injury or property damage that may occur, and waive, on behalf of myself, my heirs and my estate, any claims or causes of action against the City, its officers and employees arising from my participation in this Program, INCLUDING DAMAGES, LIABILITY, CLAIMS, SUITS, DEMANDS OR CAUSES OF ACTION WHICH ARISE FROM THE NEGLIGENT ACTS OR OMISSIONS OF THE CITY OF BURLESON, ITS OFFICERS, AGENTS, OR EMPLOYEES; (3) I hereby agree to fully indemnify, hold harmless and defend the City, its officers, agents, servants, and employees from and against any and all claims, demands, suits, judgments, assessments, costs, and expenses (including without limitation, reasonable fees and expenses of attorneys, court costs, and fees of expert witnesses and other consultants) for property damage or loss and/or personal injury, including death, to any and all persons of whatsoever kind and character, directly or indirectly resulting from the acts or behavior of the Foster Animal while the animal is my responsibility, or is in my custody or control, REGARDLESS OF WHETHER THE INJURIES, DEATH OF DAMAGES ARE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE CITY, ITS OFFICERS, AGENTS, SERVANTS AND EMPLOYEES. (4) I agree that the execution of this release shall not constitute a waiver by the City of Burleson of the defense of governmental immunity, where applicable, or any other defense recognized by the courts of Texas. (5) I certify that I have read the foregoing, that I understand its terms and conditions, that I make this release, waiver and hold harmless agreement voluntarily, and that I have not relied upon any representations made by the City of Burleson, or its officers, agents, or employees in signing this document. This agreement takes effect on the _______day of ___________ 20____and is in effect as long as the Foster Home Volunteer remains associated with Burleson Animal Services Foster Home Program.

Burleson Animal Services Release I understand that I am responsible for knowing all Burleson Animal Services policies and procedures. I have read and understand all the safety procedures for Burleson Animal Services. I understand that it is my responsibility to handle all animals with respect and care and to ensure I utilize all the proper handling tools available at all times. I understand that I must report any aggressive behavior of any animal in the care of Burleson Animal Services to a member of the Foster Home Program as soon as possible.
