DISPUTE RESOLUTION

Advanced Mediation Skills for Non-Family Mediators Tuesday – Thursday, February 24 – 26, 2015; 9:00 am – 5:00 pm (ALL 3 DAYS) Vancouver location to be announced LIMITED ENROLMENT. REGISTER EARLY TO AVOID DISAPPOINTMENT! WHO SHOULD ATTEND: Mediators in training wanting to experiment with process, build their skills, and learn new ones. LEARNING LEVEL: Advanced This three-day course builds on the foundation provided by the Fundamentals of Mediation course (or an equivalent) by introducing more skills and providing lots of practice opportunities. The course features advanced process and techniques as well as practical mediation problems and practice issues. Presented through an interest-based negotiation lens, the course also explores other mediation approaches and encourages thought and discussion about mediation philosophy. Participants should expect focused, intensive coaching of role play practice sessions (on Days 2 and 3) by accomplished mediators. Upon completion of Fundamentals of Mediation and Advanced Mediation Skills for Non-Family Mediators, you will receive a Certificate of Attendance confirming completion of 40 hours of mediation training. Lawyers and others wishing to learn family mediation; those who have taken 40 hours of family mediation training either recently or over the past 20 years and want a refresher; mediators with Justice Institute of BC or other training who want to learn property and asset division mediation. LEARNING LEVEL: Advanced This course is focused upon developing expertise for comprehensive family mediation. It includes training and practice mediating property/asset division and financial support issues. In the spotlight...

Tim Schober Tim Schober has practiced in Victoria for his entire career. He is currently enjoying the incredible harbour view (and personalities) at Pearlman Lindholm, after a lengthy stint with Cardinal Law, a shorter stint with the modest Schober & Company, and a few other gigs. He has a commercial practice with an emphasis on medical groups. Tim’s work with CLEBC started from doing a fair amount of work at the registries for mainland law firms, and led to CLEBC calling on him to work on the Due Diligence Deskbook, where he staked out turf on the BC Corporate Registry. His knowledge of legal due diligence led to a long (and challenging) gig with the BC PPSA Practice Manual chapter on due diligence. I became involved because of either (pick one): • my knowledge of BC Corporate Registry procedure, or • my acquaintance with the very helpful Registry staff who have done most of the work on the chapter on the BC Corporate Registry in the Due Diligence Deskbook since the book was first published It has been so long, I can’t recall my motivation at the time. My motivation for continuing must be altruism, as continuing has resulted in neither fame nor fortune.

What are you are currently working on (or have most recently worked on) with CLEBC? The current update for the Due Diligence Deskbook. What has been your most memorable CLEBC experience? Being asked (at the PPSA Practice Manual launch course) a question that I answered incorrectly­­—and being corrected immediately. I know no one else remembers, but I’m being honest—it stuck with me. What’s the most valuable piece of advice you have received? Arrive early in order to present well (works for court, CLE, whatever). Sometimes “just in time” is just not the way to do your best.

What advice would you give newcomers who are interested in working in the legal profession? Keep your options open in terms of areas of practice­—don’t lock into one area too early. At the least, you can consider exposure to “other” areas as very good cross-training. What has been the most rewarding part of your career? Interacting with people. Other than law, what are you passionate about? Family is the top of the food chain. Even though they might think it’s the clients! What are some of your favourite legal resources? (blogs, websites, etc.) Other than CLEBC, Canlii and Courthouse Libraries BC. Anything you’d like to shamelessly promote? (favourite charity, social cause, etc.) Other than CLEBC (again), Victoria Hospice (http://www. victoriahospice.org/) which provides a very valuable service to patients and families near the end of life.

of the defendant, since there was a juristic reason for her enrichment in her being a designated beneficiary under the PPWC plan, and in her receiving the funds by a “disposition of law”. That the defendant had ceased to be a “spouse” when she signed the consent order resolving the family law claim did not change that result; her entitlement to the pension benefit arose not because she was the deceased’s spouse, but because she remained the named beneficiary. Further, the consent order did not operate as a revocation of the beneficiary designation; that would run contrary to established authority that something more is required. Further, the consent order did not specifically waive entitlements to the death benefits; it said only that claims “in this proceeding”, that is the family law proceeding, were “dismissed”. There was no discussion of entitlements to benefits arising on death or any benefits that might arise outside of the family law context. As such, it could not be said that the defendant’s receipt of the death benefit was a breach of the order.
