Environmental Stewardship Grant Program General Terms and Conditions The Recipient Organization (RO) must agree to abide by the following General Terms and Conditions as a condition of receipt of the FBWHT funds applied for the following Project: RO: _______________________________________________________ FBWHT Project Number: ____________________ RO Project Title: ___________________________________________________________________ INDEMNITY: The RO agrees to indemnify and hold harmless Five Bridges Wilderness Heritage Trust (FBWHT) and its Board of Directors, officers and members from all claims, liabilities, any and all personal injury and/or death claims, damages, or expenses, including but not limited to delay of the Project, payment owed to any employee or third party, reduction of property value, fear of or actual exposure to or release of toxic or hazardous substances and any consequential damages of whatever nature, which may arise directly or indirectly, to any party, as a result of the work undertaken by the RO on this Project. COMPLIANCE WITH LAWS: The RO agrees to fully observe and comply with all applicable local, municipal, provincial and federal laws, regulations and orders pertaining to the work. The RO is responsible for the health and safety of its people and contractors conducting the work and will ensure that all regulatory safety requirements are enforced. LIABILITY INSURANCE: The RO will maintain comprehensive general liability insurance ($1,000,000 per occurrence / $2,000,000 aggregate) and automobile liability insurance for bodily injury and property damage in the amount of $2,000,000 for the duration of the Project. ENVIRONMENTAL PROTECTION: The RO agrees to conduct the work in a competent manner for which the FBWHT funds are intended, to ensure the environment is not adversely impacted from the work undertaken and shall indemnify and hold harmless FBWHT from any environmental impacts and claims, whether perceived or real. PROJECT TIMING, REPORTING AND RECOGNITION: The RO agrees to complete the Project within a 12-month time period of the receipt of FBWHT funds, unless affected by causes beyond its reasonable control, of which FBWHT must then be informed. The RO must provide a report to FBWHT upon completion of the Project, summarizing the work undertaken and completed, project objectives, community and environmental benefits and accompanying photographs. FBWHT must be recognized as a funding contributor in the Project Report and in any ensuing public announcements / presentations. PROJECT CANCELLATION AND HOLD-BACKS: The RO must reimburse the funds provided by FBWHT within thirty (30) days from the proposed Project start date if the Project is cancelled for any reason, unless written notice is provided to FBWHT requesting an extension of the timeline and Board consent is provided. FBWHT reserves the right to hold back 15% of the funds provided to the Project and agrees to release the funds within thirty (30) days of receipt of the report, provided FBWHT finds the report satisfactory.
