BETTER LIVING EXPO TERMS & CONDITIONS Installation and Dismantling & EXPO Schedule The installation of exhibits must be completed either Friday, September 7 between 5:00 and 7:00 p.m. or Saturday, September 8 between 7:00 and 9:00 a.m.. If any booth is not set up in full by 9:00 a.m. the day of the event, SRC reserves the right to re-assign the space to another exhibitor or to make use of the space as deemed necessary at the exhibitor’s expense. Refunds are not available. Exhibits must remain set up and occupied until the closing of the exhibits at 5:00 p.m. at the close of the Exhibit Hall. All exhibits must be fully removed by 7:00 p.m. Saturday, September 8. If exhibits are not removed by that time, SRC reserves the right to remove the exhibit at the exhibitor’s expense. Exhibitors should be at their exhibit ready to do business when the EXPO opens promptly at 9:00 AM. Scheduled Exhibit Hall set-up and move out, Exhibit Hall Map, and Exhibit Hall activities are all subject to change. Booth Assignments Booth assignments will be made on first-come, first-served basis with priority going in order of receipt of a deposit and/or payment in full. The Senior Resource Center for Douglas County reserves the right to move assigned exhibit spaces to avoid conflict of related vendors and reserves the right to make such changes at any time. Subletting and sharing of exhibit space by multiple vendors or entities is strictly prohibited. Exhibit Décor, Displays, and Signage All displays are to be professional and attractive. Vendors are permitted to bring outside furnishings, banners, and other materials to enhance booth décor. Please note, affixing any signage, banners, or other décor directly to the walls of the Exhibit Hall is prohibited. Pop up banners or other banners can be displayed as long as they are self-standing or affixed to the table or other structure. Open flames are strictly prohibited. Exhibits should be installed so they do not project beyond the space allotted or obstruct the view of or interfere with other exhibits. Any audio levels must be kept low as to not interfere with other vendors and EXPO events. Registration/Name Badges All exhibitors and other vendors are issued 2 badges for personnel staffing the exhibit. Additional badges for Exhibit representatives may be purchased for $5 each. Cancellations All cancellations must be submitted in writing or by email to [email protected]. Cancellations made before or on Friday, August 3, 2018, are eligible for a 50% refund plus the $100 deposit. After August 3, 2018, no refunds will be given. All cancellation fees retained by the Senior Resource Center for Douglas County under this contract are deemed fully earned and made in consideration for expense incurred by SRC for lost or deferred opportunity to provide exhibit space to others.

Hold Harmless Clause All EXPO vendors and exhibitors assume complete responsibility and agree to hold the Senior Resource Center for Douglas County and Crown Toyota harmless from any and all claims, suits, liabilities, demands, damages, or other costs of any kind which might result from any action or failure to act of the exhibitor or any agent, representative, personnel, etc. during or related to exhibition at this event, including but not limited to claims of damage or loss, harm, or injury to the person or property of the exhibitor or any of its agents employees or other agents. SRC and the host venue will not maintain insurance covering exhibitor property and, therefore, it is the sole responsibility of each vendor to obtain insurance for such purpose. Exhibitors are encouraged to carry All Risk Insurance. SRC shall not be responsible for any damage or loss of exhibitors’ material. In the event the EXPO facility becomes unusable due to acts of God, strikes, fire, terrorism, or any other cause not within the control of the Senior Resource Center for Douglas County, the exhibitor releases the Senior Resource Center for Douglas County from all claims, damages, etc. which may be consequences thereof. Vendor Liability Insurance All vendors are required to provide a certificate of indemnification prior to set up in the EXPO Exhibit Hall. Vendors will be held responsible for any repair or replacement costs associated with any damages associated with their exhibit space. Fire & Safety Exhibitors must comply with all rules, regulations, and codes relating to fire and safety. This EXPO is a non-smoking event. Smoking is not permitted in the EXPO Exhibit Hall or any areas desginated as non-smoking by Crown Toyota. Security It is the responsibility of the exhibitor to secure all valuables. General security of all Crown Toyota property is provided by the venue. All goods and/or equipment are solely the responsibility of the exhibitor. Neither the Senior Resource Center for Douglas County nor Crown Toyota is responsible for the replacement of lost or stolen goods. If at any time during show hours, the booth is left unattended, exhibitors must secure all valuables prior to leaving. Neither SRC nor the host venue will be held responsible for any loss or damage incurred to exhibits left unattended. Any additional security of vendor property during this time is at the risk of the vendor with the understanding of existing security measures provided by Crown Toyota. Waste Removal Vendors are solely responsible for the removal of any materials and waste related to set up and move out of each exhibit. Any vendor leaving waste after the scheduled move out times will be charged at a rate of $45 per hour with a one-hour minimum.

Firearms Firearms are prohibited at the Better Living EXPO in accordance with Senior Resource Center for Douglas County policy as well as the specific policy of all facilities on Crown Toyota property. On site sales of firearms and other weapons are also prohibited at this event.

Product/Service Restrictions The Senior Resource Center for Douglas County reserves the right to limit the number of vendors offering any one particular product or service. In the case the SRC decides to limit vendors, the first-come, first-served policy will apply. All vendors are required to provide SRC a list of products/services to be offered at the exhibit.

Listings and Promotional Materials By exhibiting at the Better Living EXPO, all vendors grant the Better Living EXPO and its affiliates a fully paid, perpetual non-exclusive license to use, display, and reproduce their name, trade names, and product names in any directory (print, electronic, or other media) listing all vendors at the EXPO and to use such names in any and all promotional materials. The Senior Resource Center for Douglas County shall not be liable for any errors in any listing or descriptions, or for omitting the company from the EXPO program or other lists or materials. Show management reserves the right to edit and/or delete EXPO Program submissions.

Vendor Sales All vendors are required to comply with all sales tax regulations related to all sales during and after the event. Vendors are responsible for reporting and payment of all applicable taxes, license fees, use fees, or other fees, charges, levies, or penalties that become due to any governmental authority in connection with sales and activities at the Better Living EXPO. The sales tax rate in Lawrence, KS is 9.05%. Further, all vendors are solely responsible for obtaining any licenses, permits, or other required approvals under any and all federal, state, and/or local law applicable to your participation at the Better Living EXPO.

Recording and Photo Consent All EXPO vendors agree to grant the Senior Resource Center for Douglas County privileges to record and photograph the exhibit setup and any interaction between exhibitor(s) and EXPO attendees throughout the Better Living EXPO event. All exhibitors and representatives grant SRC permission to use any video and/or photographs obtained from the EXPO before, during, or after the open hours of the EXPO in future promotions and print advertising.
