The event was a tremendous success and everyone’s combining efforts helped the San Diego Brain Injury Foundation and Freedom House surpass their $60,000 goal! It was such a beautiful day to walk at Mission Bay Park - De Anza Cove with hundreds of other walkers that came out from all over the country to participate in the 3 mile course. We are honored to have been involved in this amazing event that supports brain injury survivors, their families, and caregivers have access to free educational meetings on brain injury topics, residential housing options for survivors, and much more. We have represented many past individuals in our firm that have suffered from a brain injury and thoroughly know how drastic daily life can change. We want you to know that this walk was dedicated to you! It is never too late to help. CARNIVAL “TRIUPMH” CRUISE LAWSUIT

A

fter suffering an engine fire, the Carnival Triumph cruise ship was left in a crippling state that led to poor conditions onboard for over 3,000 passengers and over 1,000 crew members for five days.

passengers received a Conditions of Carriage contract when purchasing their tickets, which limit their rights to collect from Carnival in the event that they wrong you. With their rights limited, it is unlikely that they will successfully collect additional compensation from Carnival.

The first lawsuit was filed against Carnival not even 24 hours after the incident was over. Currently, lawsuits are still piling up against Carnival Cruise Lines from the event. Carnival gave all passengers a full refund, credit for another cruise trip, and $500 as Ross explained on News 8 (KFMB) that compensation for the mishap.

CA MOTORCYCLE LANE SPLITTING GUIDELINES

C

alifornia is the only state in America that allows motorcycle lane splitting. There had been no clear guidelines for motorcyclists to follow, until now. Ross Jurewitz was asked to explain the new motorcycle guidelines on KUSI News Good Morning San Diego on Tuesday, Feb. 19, 2013.

motorcyclists should not lane-split for risk of injury. For experienced motorcyclists, lane-splitting should only be done at a maximum speed of 40 mph and only 10 mph above traffic speed (ex: If traffic flow is 25 mph, then motorcyclist speed is 35 mph max). If the flow of surrounding traffic is faster than 30 mph, then do not lane share.

NURSE REFUSES CPR, CALIFORNIA RESIDENT DIES

L

orraine Bayless, 87, collapsed on the dining room floor of her independent living facility, Glenwood Gardens. A nurse present called 9-1-1 for medical help. When the operator told the nurse to perform CPR, the nurse refused since it was against company policy to give CPR to residents. When paramedics finally arrived, Bayless had no pulse and eventually died of a massive stroke.

Ross teaches viewers that there is no duty under California law that requires a person to help another person in distress. However, California does encourage and protect a person that helps another person without being civilly liable for the outcome under the “Good Samaritan law.”

NATIONAL DISTRACTED DRIVING AWARENESS MONTH

My research this month is focused on distracted driving in America and what is causing drivers to become distracted. April was named National Distracted Driving Awareness Month on March 23, 2010 to advocate the dangers of distracted driving. For experienced and inexperienced drivers (including myself), here are the top 5 driving distractions (visual, cognitive, and/or manual) that you should avoid while driving:

Cell Phones: Probably the most common and well-known distraction for drivers. However, even using a hands-free talking device will still create the same delayed reaction as someone with a .08 blood alcohol level.

Eating or Drinking: Trying to navigate a vehicle while holding food or a drink can greatly reduce a drivers ability to properly react to critical events.

Passengers: Looking back or to the side in order to talk to passengers in the car is another leading cause of cognitive driving distraction.

GPS Devices: Although helpful, this device can still pull a drivers visual and cognitive attention away from the road.

Car Stereos: Searching for music or news can easily turn a drivers attention away from traffic. Having all of your favorite stations on preset is a great way to eliminate this distraction.

Of course there are a lot more driving distractions out there besides these five. As a driver, remember that driving distracted may cost you a lot more in the end compared to driving focused! For more info and to get involved this month, visit distraction.gov.
