Indemnity Form I, the undersigned, of my own free will hereby apply to Village Roadshow Theme Parks Pty Ltd (ACN 010 919 623) ("Wild Buggy") to use a vehicle belonging to or operated by them for the purpose of recreation and practice. Warning I acknowledge and agree that off-road driving can be dangerous and that accidents can happen. I agree Wild Buggy has the right to terminate the session at any time if it considers the risks are not acceptable or if the vehicle is being used in an improper or dangerous manner. I declare that I have read and understood these warnings and accept all inherent risk of danger in activities surrounding and associated with any vehicle being driven by me and/or the vehicle in which I am a passenger. Health I understand that this experience may involve some muscle jarring and increased heart rate. My current health and ability to participate is not affected by legal or illegal drugs or alcohol, and I do not suffer a medical condition that prevents me participating safely. I am not pregnant and am aware that I can reschedule should I wish to consult my physician. Exclusion of Liability I agree to irrevocably release and absolve Wild Buggy, its management, coaches, staff and volunteers from all liability however arising (except where Wild Buggy is negligent) from injury or damage however caused (whether fatal or otherwise) arising out of my use of the Wild Buggy vehicle as either a passenger or a driver. Indemnity - Drives In consideration of Wild Buggy granting me the use of a vehicle I agree to indemnify them in respect of any actions, suits, proceedings, claims, demands, losses, damages, costs, penalties, fines, whatever arising as a result, directly or indirectly, of my use of the vehicle or any act or omission (excluding negligence) on the part of Wild Buggy. Indemnity - Passenger Rides Only In consideration of Wild Buggy granting me the vehicle passenger ride activity, I agree to indemnify them in respect of any actions, suits, proceedings, claims, demands, losses, damages, costs, penalties, fines, whatever arising as a result, directly or indirectly, of my participation or any act or omission (excluding negligence) on the part of Wild Buggy. Costs of Repair In the event of an accident whilst I am driving the Wild Buggy vehicle, which incurs actual damage to the Wild Buggy vehicle, I agree (other than where the accident is due to the negligence of Wild Buggy) to meet costs of repairing the Wild Buggy vehicle to its equivalent condition prior to my use of the Wild Buggy vehicle. I have read, understand, acknowledge and agree to the above warnings, exclusion of liability and indemnity clauses. I have inspected the Wild Buggy vehicle and accept with full knowledge the likelihood of injury and damage inherent in any off-road driving activity where I am in conveyed in the Wild Buggy vehicle.
