PHASE II OF PPH BETWEEN BRAZILIAN PTO /USPTO

PRACTICE AREA Intellectual Property

The Patent Prosecution Highway (PPH), signed by the Brazilian Patent and Trademark Office (BPTO) and the United States Patent and Trademark Office (USPTO), allows Brazilians to use the results of the patent application examination at the BPTO to expedite prosecution in the United States United States and vice-versa. The average time for issuing the final decision by the BPTO is 180 days from the date of entry into this program.

Said project entered its second phase on May 10th, 2018, and shall be in force until April 30, 2020, as published in the Brazilian Official Bulletin number 2470, of May 8th, 2018, establishing the following rules: 

The “Technology Inventions” such as Electrical machinery, apparatus, energy; Audiovisual technology; Telecommunications; Digital communication; Basic communication processes; computer technology; IT methods for management now integrate such project, along with the oil, gas and petrochemical areas (included in the first phase of the project); Up to 200 patent applications will be accepted in each country; 50 of these patent applications may use preliminary opinion results obtained by the Patent Cooperation Treaty (PCT) to require participation in this project; The applicant may apply for one PPH entry per month (except for the last 30 days of the program).
