By submitting an entry, your entry materials, as defined below, may be included in sponsor’s commercial material, as well as at Sponsor’s website or social media platforms. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook. These Official Rules apply to the JetBlue Solar Eclipse Sweepstakes (the “Sweepstakes”). The Sweepstakes begins on or about August 18, 2017 at 9:00:01 AM Eastern Standard Time (“EST”) and ends on August 21, 2017 at 11:59:59 PM EST (the “Sweepstakes Period”). Sponsor: The Sponsor of this Sweepstakes is JetBlue Airways Corporation, located at 27-01 Queens Plaza North, Long Island City, New York 11101 (hereafter, “Sponsor”, “JetBlue Airways” or “JetBlue”). Eligibility: The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at the time of entry and JetBlue Airways TrueBlue members at the time of entry. If you are not a registered TrueBlue Member, you will be required to complete and submit a TrueBlue Registration Form at https://trueblue.jetblue.com/web/trueblue/register/?intcmp=hd_join prior to entering the Sweepstakes. There is no cost to become a TrueBlue member. Void outside the 50 U.S., DC, and where prohibited and restricted by law. Employees, officers, agents, representatives and/or directors of Sponsor, Centra360 (herein after “Sweepstakes Administrator”), or any of their respective parent, affiliate and subsidiary companies, licensees, distributors, retailers, printers, advertising and promotion agencies, and/or any and all other companies associated with the Sweepstakes (such entities collectively, with Sponsor, and Sweepstakes Administrator, the “Related Entities”) and the immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and/or those living in the same household of any such individual, whether or not related, are not eligible to participate or win a prize. The Sweepstakes is subject to all applicable federal, state and local laws, rules and regulations. How To Enter: To enter the Sweepstakes, during the Sweepstakes Period you must (A) have an active Facebook account or sign up for a free Facebook account at www.facebook.com; (B) go to the “JetBlue” fan page at www.facebook.com/JetBlue; (C) look for a JetBlue Solar Eclipse Event Page (“Post”) and (D) respond “Going” to the event Post (A, B, C, D collectively, an “Entry” or “Entries”). Limit one (1) Entry per person/Facebook account during the Sweepstakes Period. Any attempt by any entrant to obtain more than the stated number of Entries by using multiple and/or different email addresses, identities, registrations and Facebook.com logins, or any other methods will void that entrant's Entries and that entrant may be disqualified. If you post updates to or receive updates from Facebook via SMS from your wireless phone, your wireless-service provider may charge for each post update sent and received. Please consult your wireless-service provider regarding its pricing plans. By submitting an Entry, entrant agrees to abide by the terms of these Official Rules, the Sponsor’s Privacy Policy available at http://www.jetblue.com/about/privacy.html and all Facebook Statement of Rights and Terms and Conditions. By submitting an Entry, you understand that you are submitting your information to Sponsor and not to Facebook. By entering the Sweepstakes, each Entrant waives discharges and fully releases Facebook from any and all liability associated with this Sweepstakes. Individuals who enter via Facebook must be the authorized account holder of the Facebook account from which the Entry is made. Use of automated entry or similar devices to participate or subvert the entry process is prohibited, and all entries submitted through such devices are void. All Entries are the property of the Sponsor and will not be acknowledged or returned. All Entries must be received by 11:59:59 PM ET on August 21, 2017.
Sponsor has the right to dispose of the Entries at Sponsor’s discretion. Sweepstakes entrants agree to be bound by the terms of these Official Rules and by the decisions of the Sponsor, which are final and binding on all matters pertaining to this Sweepstakes. Trademarks: All trademarks and trade names featured at jetblue.com and at Sponsor’s social media platforms are trademarks of Sponsor ("Sponsor's Trademarks"). Random Drawing/Selection of Prize Winner: Potential Grand Prize Winner will be selected in a random drawing to be conducted on or about August 22, 2017 from among all eligible Entries received during the Sweepstakes Period. The random drawing will be conducted by Sweepstakes Administrator, whose decisions regarding all matters relating to this Sweepstakes are final and binding. Odds of winning will depend upon the number of eligible Entries received during the Sweepstakes Period. Winner Notification/Releases: Potential prize winner will be notified by Sponsor on or about August 23, via Facebook in the event he/she is drawn as a potential prize winner following the random drawing. Potential prize winner must then send a direct message to the Sponsor’s Facebook account that contains the potential prize winner’s full name as it appears on your government-issued photo ID, email address, date of birth and phone number. Potential prize winner must send the direct message to the Sponsor’s Facebook account within forty eight (48) hours following the Sponsor’s post. Each entrant is responsible for monitoring his/her Facebook account(s) and the Sponsor’s Facebook page, as may be appropriate, for prize notification or other communications related to the Sweepstakes. Sponsor shall have no liability for a potential prize winner’s failure to receive notices due to the potential prize winner’s privacy settings on Facebook or spam, junk email or other security settings; for a potential prize winner’s inability to access Facebook; or a potential prize winner’s provision of incorrect or otherwise non-functioning contact information. If potential prize winner does not send a direct message to the Sponsor’s Facebook account within forty-eight (48) hours, or if the direct message is returned as undeliverable, that potential prize winner shall forfeit the prize. Once a potential prize winner sends the required information to Sponsor via direct message, he/she will be sent notification via email from Sweepstakes Administrator and will be required to sign and return a Prize Affidavit Form and, unless prohibited by law, a Publicity Release Form within forty-eight (48) hours of notification. Potential prize winner will receive an IRS Form 1099MISC for the ARV of the Grand Prize awarded. Winner is solely liable for reporting and paying any and all applicable taxes including, but not limited to personal tax, service tax, and other entertainment tax due as a result of winning the Grand Prize and Sponsor accepts no responsibility for any tax implications arising as a result of the Grand Prize. The potential prize winner may be disqualified under any the following circumstances; i) if prize notification or email correspondence is returned as undeliverable; ii) if he/she is found to be ineligible; iii) if he/she does not return the Prize Verification Form within forty-eight (48) hours of notification, or; iv) if he/she cannot or does not comply with these Official Rules. In the event the potential prize winner is disqualified for any reason, Sponsor may award that prize to an alternate potential prize winner in a random drawing from among all remaining eligible Entries received during the Sweepstakes Period. Upon prize forfeiture or disqualification, no compensation will be given. The potential prize winner will not be an official prize winner until all required documentation has been returned, and eligibility has been formally verified. Sponsor is not responsible for fraudulent calls or emails made to entrants or potential prize winners not by Sponsor or Sweepstakes Administrator. The receipt by a prizewinner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. Any violation of these Official Rules by Prize Winner will result in such Prize Winner's disqualification (at Sponsor's sole discretion) as a Prize Winner of the sweepstakes and all privileges as a Prize Winner will be immediately terminated. One (1) Grand Prize: Grand Prize will consist of one (1) one hundred thousand (100,000) TrueBlue points certificate which will be deposited into Winner’s TrueBlue Account; and one (1) JetBlue prize pack which will include JetBlue branded items. The total ARV of Grand Prize: $1,198. Prize is awarded “as is” with no warranty or guarantee, either express or implied. Winner is responsible for all federal, state and local taxes as well as all costs and expenses associated with prize acceptance and use not specified herein as being provided. Winner
cannot substitute, transfer or redeem prize for cash. Sponsor reserves the right to substitute the prize (or portion thereof) of comparable or greater value, in its sole discretion. Specific Prize Restrictions on JetBlue TrueBlue Points: Prize Winner must be an active TrueBlue member in order to claim the Prize and will be required to provide his/her TrueBlue membership number prior to claiming the Prize. TrueBlue points will be deposited into each Prize Winner’s TrueBlue account within sixty (60) business days of Prize Winner confirmation and/or verification of TrueBlue membership. General Conditions: Sponsor reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes (or any portion thereof). In the event of cancellation, Sponsor may elect to identify the Prize Winner and award the Prize by way of a Random Drawing from among all non-suspect, eligible Entries received up to the time of such cancellation or in another manner otherwise deemed fair and appropriate by Sponsor. Caution: any attempt by an entrant to deliberately damage the sweepstakes or to undermine the content or legitimate operation of this sweepstakes is a violation of criminal and civil laws and should such an attempt be made, sponsor will disqualify any such entrant and reserve the right to seek damages (including attorneys’ fees) and other remedies from any such entrant to the fullest extent permitted by law. Waiver of Liability and Release: By participating in the Sweepstakes and submitting an Entry, each entrant waives, discharges and fully releases Sponsor, Sweepstakes Administrator, the Related Entities, and the officers, directors, shareholders. agents and representatives of each (hereinafter, the “Released Parties”) from any and all liability, injury, damage or loss that may occur, directly or indirectly, in whole or in part, from or in connection with participation in the Sweepstakes or from the receipt or use of the prize or from any activity related to the receipt or use of the prize. By receipt of the prize, the Prize Winner agrees to release and hold harmless the Released Parties from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of the prize. Publicity: Except where prohibited, Prize Winner by acceptance of a prize, grant to the Released Parties the right to publicize his/her name, social media handle, city and state of residence, and Entry (or any portion thereof), photograph (including, without limitation, Facebook profile photo), voice, statements and/or other likeness and prize information in any and all media now known or hereafter devised, for advertising, trade and other purposes, throughout the world, in perpetuity, in any manner, without limitation and without additional compensation, consideration, notification or permission, unless prohibited by law. Limitations of Liability: Released Parties are not responsible for stolen, late, incomplete, inaccurate, stolen, misdirected, lost, damaged, garbled, delayed, incomplete or garbled Entries, comments or email; for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections; availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines; or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind whether human, mechanical, electronic, network, computer, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of Entries, the announcement of the prize, functionality of the Sweepstakes Hotline or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer, wireless phone/smartphone or landline phone related
to or resulting from participating in this Sweepstakes. Persons who tamper with or abuse any aspect of the Sweepstakes or attempt to undermine the legitimate operation of the Sweepstakes by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any representative of Sponsor and/or the Released Parties, or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor, and their respective agents. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes and to resolve all disputes in its sole discretion. Disputes: By entering the Sweepstakes, each entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or the prize awarded, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, and in no event will entrant be entitled to receive attorneys' fees or other legal costs; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of New York. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts located in the State of New York, County of New York, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
