Dear Liam, Ward members, I write with reference to the outline application for 50 units to the land south of Lavendon Road, Olney. This is a resubmission of 15/02299/OUT which was refused for access issues, drainage and lack of s106. The applicant has resubmitted the application seeking to address these issues. I have based the attached on the comments I received from consultees during the previous consultation in February - can you please review the relevant sections of the attached and let me know whether you have any comments of suggested amendments. As we discussed yesterday with the Town Council, if you want to give me comments around the projects coming out of the emerging Neighbourhood Plan and specifically identify any contributions you don’t feel are necessary, so we can seek to allocate these to another priority project (i.e. from burial grounds to health, for example). Dear all, I write with reference to the outline application for 50 units to the land south of Lavendon Road, Olney. Attached is the site location plan. The below sets out the likely s106 contributions calculated in accordance with MKC Supplementary Planning Documents and Guidance. I would appreciate any comments you have along with any specific projects or additional requirements from this development in order to make the development acceptable in planning terms. If you would like to identify any projects, please let me know why the contribution is needed and how it will help to mitigate the impact of the development, so any supporting data/evidence you have to support your request is essential. Community Infrastructure Levy (CIL) Regulations: Any requests must be CIL regulation 122 compliant, which means it must be have regard to the following statutory tests: “A planning obligation may only constitute a reason for granting planning permission for the development if the obligation is— (a) necessary to make the development acceptable in planning terms; (b) directly related to the development; and (c) fairly and reasonably related in scale and kind to the development.” I would appreciate if you can provide any comments on the s106 requirement’s whether you support the contributions sought, and whether are aware of local projects that will need to be funded to mitigate time impact of this development. If you consider further contributions are also required, can you please provide me with the details of each contribution/request and how these are required as a result of this development and make the development acceptable in planning terms and mitigate any impacts resulting from the scheme. From the 6th April 2015, when assessing whether any s106 contribution the local authority is required under the Community Infrastructure Levy Regulations (CIL Regulation 123) to ensure that we have not entered into 5 other s106 obligations for the same project or type of infrastructure since April 2010. Therefore, any contribution sought must not exceed the pooling restriction. I can confirm that for this development, Pooling is not a concern and therefore this will not hamper the ability to secure any of the contributions listed below.
