December 16, 2015 Dear Senators and Representatives: On behalf of more than 2.8 million Americans for Prosperity activists in all 50 states, I write in support of the “Protecting Americans from Tax Hikes” Act. This so-called “tax extender” legislation will rein in the IRS, bring $560 billion in immediate tax relief to families and businesses across the country, and lay the ground work for comprehensive tax reform through permanence. We encourage you and your colleagues to support it. One of the most important items included in the package is a provision that will would prohibit the Internal Revenue Service (IRS) from selectively applying the gift tax to contributions to nonprofit organizations over $14,000. This will defend Americans’ fundamental right to free speech and prevent the IRS from systematically targeting taxpayers based on their political affiliation using this section of the tax code. We applaud this legislation for including a number of additional provisions that will rein in the IRS, too. It includes a provision firing IRS employees who take politically motivated actions against taxpayers, requiring IRS employees to respect the taxpayer bill of rights, and prohibiting IRS employees from using personal e-mail accounts for official business. The package also bring permanency to the tax code. This is a step in the right direction toward comprehensive tax reform — broadening the base and lowering the rates for people and businesses across the board — and it will relieve pressure on Congress to consider a package of expired tax breaks under the threat of deadline each December. We are pleased in particular to see a provision relating to Section 179 small business expensing, which will encourage business investment and job creation.
