NOTICE OF INTENT TO CONSTRUCT AN ANIMAL FEEDING OPERATION Notice is hereby given that the SD Department of Environment and Natural Resources has received an application for an expanding animal feeding operation from: Joe Wurtz Newport Colony 11796 414th Avenue Claremont, SD 57432-5808 The permit application is for state permit coverage under the General Water Pollution Control Permit for Concentrated Animal Feeding Operations that became effective on April 15, 2017. The animal feeding operation is located in the Southwest 1/4 of Section 33, Township 126 North, Range 59 West in Marshall County, approximately nine miles west and eight miles south of Britton. The currently permitted operation consists of a maximum of 12,156 swine (9,266 swine weighing 55 pounds or more and 2,890 swine weighing less than 55 pounds), 4 mature dairy cows, 1,000 layer chickens, 1,000 broiler chickens, and 1,000 ducks. The proposed expansion will consist of an additional 5,000 layer chickens and 2 mature dairy cows, for a maximum of 6,000 layer chickens and 6 mature dairy cows. The additional animals will be housed in an existing building. Manure storage for the layer chickens, broiler chickens, and ducks will be provided by a proposed roofed storage structure that will have at least 270 days of solid manure storage capacity. Manure storage for the dairy cows will be provided in an existing in-ground, covered concrete tank that will have at least 270 days of liquid storage capacity. The manure will be land applied to fields located in portions of the following sections in the following counties: Marshall County: Sections 21, 24, 26, 29, 32, 33, 34, 35 and 36 in Township 126 North, Range 59 West; Sections 4, 5 and 9 in Township 125 North, Range 59 West; and Section 31 in Township 126 North, Range 58 West. Brown County: Sections 3, 22 and 23 in Township 127 North, Range 61 West; and Information about the permit application may be obtained from Keith Miller with the Department of Environment and Natural Resources by calling (605) 882-5111. Any person desiring to comment on whether the application meets the general permit requirements must submit written comments within thirty (30) days of the publication of this notice. Commenters shall provide their name and address, a statement of the action they wish the department to take, and the facts supporting their position. DENR will consider and address all comments submitted. A copy of this notice and online commenting are available at http://denr.sd.gov/public.
