CHAiRMAN'S ANNOUNCEMENTS In welcoming Members back to the first Council Meeting since the recess, the Chairman said that his Civic engagements had not diminished during the summer holidays. He had recently attended the Carnival Queen of Queen's dance at Canewdon Village Halt. In the week prior to that he had visited the Foulness Proof and Experimental Establishment where, having fired one of the guns on the site, he had subsequently been presented with the shell case as a momento. Later that same day he had visited the Fire and Rescue Services at Leigh—on--Sea in the forum of the Emergency Panel and had been most impressed at the demonstration which they had been given, which included a thermic lance. 429. ALLOTMENT COMPETITION 1987 (Minute 249/87)

The Chairman announced that the Allotment Shield and first prize in this year's Allotment Competition had been won by Mr. F. Dupree for the second year running, the second prize and Certificate of Merit by Mr. R. Harris, and the third prize had been shared jointly by Mr. 3. Byford and Mr. W.H. Rees. in making the presentations he thanked the Rayleigh Horticultural Society for their continued assistance with this Annual event. (6056) 430. ROCHFOIUJ'S LITTER INITIATIVES (Minute 237/87)

The Chairman welcomed as guests to the Meeting pupils from two local schools, namely Rochford County Primary School and the King Edmund School. He said that the latter school had recently undertaken an operation to clear litter from the vicinity of their premises in which he had participated. On behalf of the Council he presented them with a photographic record of the event. (667) 431. ROCHFORD YOUNG ENTREPRENEUR OF THE YEAR AWARD (Minute 350/87) The Chairman reminded Members of the competition which had been launched with the prize of a sponsored place at the Essex County Council's Young

Enterprise Centre at Basildon. In addition the Eastern Electricity Board were making available electrical equipment to the value of £250. Re congratulated the two winners, Sonia Hare and Christina Florides who had submitted a most professional entry for their business of designing and manufacturing high fashion men's clothing under the name "Standing Ovation". The Chairman presented them with a commemorative key to mark their achievement which had been provided by Mr. A. Menzies, the Manager of the Young Enterprise Centre, and Members joined with the Chairman in wishing them every success for the future. (TPIO9) 432. The Director of Health and Housing reported that the Council had been invited to comment upon this document, a copy of which had been placed in the Members' Room. The District Medical Officer, Dr Griffin, was in attendance and answered questions from Members regarding the degree of underfunding in the draft Budget, the progress of the "Care Itt The Community" programme, the degree of control over privately—run elderly persons' rest homes and hostels for ex—mentally handicapped patients, the implementation of the cervical cancer screening programme, the extent to which hospital services would be privatised further or in the case of catering, could compete on a commercial basis, and the implications of the proposed contract car hire arrangements. RECOMMENDED That the Southend Health Authority Draft Operational Plan 1988/1991 be noted. 439. HEALTH EDUCATION — ACQUIRED IMMUNE DEFICIENCY SYNDROME (AIDS) The Director of Health and Rousing reported that because AIDS was the biggest current challenge to the world's public health with no effective vaccine, prevention of infection required a widespread health education programme for the entire population.

In addition to specialist officers, the Southend Health Authority education strategy envisaged a need for an AIDS Education Officer to work with the three local authorities in its area and were seeking support from them to finance this important permanent position. The Officer would

undertake health education activities amongst Council staff and provide expertise in dealing with the risks from businesses controlled by Environmental Health Officers, for example, Leisure Centres, ear piercers, hairdressers etc. The joint finance arrangements had been calculated to reflect the anticipated usage by the Local Authorities, i.e.

Members expressed concern at the threat to public health and considered the appointment to be an essential step towards combatting this very dangerous disease. The Committee noted that both Southend—on—Sea and Castle Point Councils had recently agreed to the proposal and asked that at this stage provision he made in the budget for 1.988/89 to meet the costs involved.

RECOMNENDED That the Council contributes to the Southend Health Authority 25% of the annual cost of employing an Aids Education Officer and that the necessary provision be made in the budget for l988/89.(31211)(DP)

440. ESSEX AMBULANCE SERVICE OPERATIONAL PLAN 1988/1991 (Minute 543/86) The Director of Health and Rousing reported that the Council had been invited to comment on this consultation document, a copy of which had been placed in the Members' Room. Kr B. Lloyd, the Distr[ct Liaison Officer of the Essex Ambulance Service attended the Meeting and answered questions from Members regarding the strength of the ambulance fleet, thenature of the communication equipment, and the response times achieved. The Committee noted the effect on. the service if the Basildon Casualty Department were closed and that a survey was being undertaken to ensure that if the Southend Cancer Unit were shut down the Ambulance Service could cope with the additional distance involved to Harold Wood. The Chairman with the approval of the Members thanked the District Ambulance Liaison Officer for a very lucid presentation and congratulated him on the excellence of the service which his organisation provided to the community. RECOMMENDED That the Essex Ambulance Service Operational Plan 1988/1991 be noted. (26609) (DHH)

CARAVAN SITES AND CONTROL OF DEVELOPMENT ACT 1960 RIVERSIDE TRAILER PARK LIMITED, WALLASEA ISLAND, ROCHFORD The Director of Health and Housing reported that the owner of this site had asked for an amendment of his Licence to extend the area used for touring caravans by 1.5 acres of land at the southern end of the site. No increase in the 60 touring caravans permitted by the current Licence conditions was proposed. Town and Country Planning Permission had been granted 'for this development on 23rd July 1987, (Minute 377/87) subject to the completion of a Section 52 Legal Agreement.

The Committee noted that the land covered by the application was within the overall parcel of land forming Riverside Village Trailer Park and considered it appropriate to extend the existing Site Licence No.4 to incorporate this development. 448. INTERMEDIATE CRANT — 253 EASTWOOD ROAD, RAYLEIGH The Director of Health and Housing reported confidentially on the conditions under which an Intermediate Grant of £3,703.50 had been paid on 30th September 1983 to the owners of this property but that the tenant had

Health and Housing Services Committee died in March 1986 and the property had since remained vacant until being sold into owner—occupation on 28th August 1987, which was a breach of those conditions. The Committee considered it appropriate to seek repayment in respect of the period during which the grant condition would be breached, i.e., one fifth of the original grant, plus interest. Resolved that since the availability for letting grant condition imposed on 253 Eastwood Road, Rayleigh has been breached, the Council shall demand repayment of £1,119.28. (20944) (DM11 & DF) 449. CARAVAN SITES AND CONTROL OF DEVELOPMENT ACT 1960 — SPACING OF CARAVANS — PROGRESS REPORT (Minute 465/86)



The Director of Health and Housing reported in confidence on the progress towards compliance with the standard condition that there should be at least six metres between caravans. Following his annual survey, the Director of Health and Housing found that seven of the sites in the District were satisfactory but that on four sites, there was Insufficient distance between caravans although progress had been made towards remedying the situation.

Resolved (1) that the site licence holders of Halcyon Caravan Park, Tower Caravan Park1 Crouch Caravan Park and Dome Country Club be advised that additional time will be afforded to satisfy the site licence condition requLring not less than six metres between caravans. (2) that a progress report be made In one year. (246) (DHH) 450. PUBLIC CONVENIENCES (Minute 297/87) The Directors of Health and Housing and Finance reported in confidence on the financial implications of adopting a phased programme of replacing certain of the existing public toilet facilities within the District by purchasing or leasing automatic public conveniences, known as "Supaloos". The Committee noted that the preferred option would be to lease from Street Equipment Limited and favoured the introduction of "Supaloos" at three selected sites within the centres of population. They identified the replacement of the existing toilets at King George's Playing Field! Websters Way, Rayleigh, the Spa, Southend Road, Hockley and Back Lane, Rochford for that purpose. They were mindful that automatic public conveniences were not suitable for disabled persons. It was also considered that with the introduction of automatic public conveniences the remaining toilets should be closed at night. The Committee considered that the scheme to renovate the Hockley Woods public conveniences was no longer appropriate.

The Committee noted that the proposed Sunday evening use of Clements Hall Swimming Pool by the disabled had not been progressed since it had become apparent that this activity was provided elsewhere but that further discussions would be taking place with the organisations concerned. In response to a question from a Member regarding the children's play area at Fyfield Path, Rayleigh the Chairman advised that title had been deduced and that the transfer was being prepared. 453. EASTERN ARTS ASSOCIATION (Minute 128187)

Arising out of an earlier request by the Committee, Mr Jeremy Newton, the Director of Eastern Arts Association was in attendance and advised the Meeting of the constitution of the Association, the finances and structure, and its aims of ensuring that everyone in the region had access to the arts. He answered questions from Members regarding sources of income and the level of administrative overheads, the basis of patronage and the status of productions by schools and youth clubs. In thanking him for his attendance, the Chairman advised that because the Council were currently grant—aiding the Palace Theatre renovations, provisions could not be made for membership of the Eastern Arts Association until after the next financial year. (211). 454. ARTSWORK FESTIVAL

The Director of Leisure reported on an initiative by TVS to organise an Artswork Festival in 1988 within the nine counties to which they broadcast, the programme for Essex taking place in May 1988 and the activities culminating in a regional Artswork Festival in Southampton in July. The Committee noted the proposed method of funding, that Rochford was represented on the Essex Co—ordinating Committee, and that a programme was being devised to involve l4—l year olds in a wide range of the visual and performing arts.

The Director of Leisure reported that an item of £SOOO was included within the current year's Capital Programme for the provtsion of a permanent bar in the Haltern Suite at Clements Hall Leisure Centre but that there was a need to carry out various improvements to the kitchen as a result of the volume of production now required to he met by the catering operation. In order that the necessary works could he undertaken at the earliest opportunity, thereby ensuring that the highest standards were maintained, the Chief Executive had given approval under Standing Order 18 for the necessary virement. The Committee noted that all functions in the Haltern Suite had been adequately serviced by the use of temporary bars and that that arrangement would continue for the foreseeable future. (6771) 456. CONTRACT NO.1321 — PROPOSED REFuRBISHMENT OF FIRST FLOOR BAR, KILL HALL, RAYLEIGH

The Director of Development reported that tenders for the above Contract which was not expected to exceed £20,000 had been invited from four contractors. Although only one contractor, namely L R Ramoss Limited had submitted a tender, it fell within the budget provision and on examination was found to be suitable. The Committee noted that the Chief Executive had exercised his powers under Standing Order 18 to enable the work which was part of a current scheme of refurbishment to be completed by 4th November 1987. (6643) 457. FREIGHT HOUSE - MILL HALL - CASTLE HALL - CLEMENTS MA1.L FUNCTION SUITES — HIRING POLICIES

The Committee had before them the appended report of the flirector of Leisure which sought to rationalise the operating policies of the halls so as to harmonise the objectives with those of the Council's own catering service, and to encourage more people to attend the halls for a greater variety of activity.

Whilst accepting the need for the catering service to operate on a firm commercial basis, some Members considered that the facility at present afforded to hirers to provide their own private catering should he continued, particularly in the case of small local organisations who met on a regular basis. On balance, however, the Committee accepted that such a concession was open to abuse, and that access to the kitchens, other than by employees of the Council, was undesirable. It was noted that the withdrawal of that concession would not affect Castle Hall. So far as the other halls were concerned, arrangements could he made for a regular requirement for light refreshments to be met by the Council's caterers on a group basis. P.

RECOMMENDED That the changes to the halls hiring policy as detailed in the appended report be approved. (131) (DL)

Leisure Services Committee 458. LAYING OUT AND NAMING OF NEW ROCRFORD PARK (Minute 474/86's

The Director of Leisure reported that following planning approval of the scheme to lay out the new 13 acre park at the rear of South Street, the developer had suggested that he undertake the planting and landscaping of the whole area including the 5 acres for which the Council was responsible. The Committee noted that the estimated cost would amount to £8,000 and considered that provision should be included in the draft Capital Programme for 1988/89. Members took that opportunity to select a suitable name For the park and having discussed the various suggestions put forward, favoured that of "Millvieci Park".

RECOMMENDED (I) That the Policy and Resources Committee be asked to include £8,000 in the 1988/89 draft Capital Programme to provide for the landscaping of the 5 acres of the Park for which the Council is responsible. (2) That the name "Millview Parkt be adopted. (22268)(DL,T)P) 459. ROCF1FORD RESERVOIR — FISIIING (Minute 440/85)

The Director of Leisure reported on recent public concern at toss of wildfowl on Rochford Reservoir, coupled with otherprohtems such as damage to trees, erosion of the hank, pollution of the water and disturbance to local residents which appeared to be associated with the pursuit of fishing at that location for which reasons it was considered that permission to fish those waters should now be withdrawn. Whilst acknowledging that not all of those problems would necessarily be resolved by a ban on fishing, the Committees accepted that the size of the Reservoir was such that the activity was incompatible with the protection of wild life. Because the Council's resources only permitted limited supervision, Members considered that provision should he made to enforce that ban by the employment of a local security company on an occasional patrol basis. RECOMMENDED (1) That fishing no longer be allowed in Rochford Reservoir and that the necessary provisions included in the 1988/89 draFt revenue estimates to provide for security patrols. (2) That the licence with Rochford Fishing Club be determined. (133) (DL,SEC)

460. PLAY AREA -REAR OF CASTLE INN, LITTLE WAKERING The Director of Leisure reported on a request from Wimpey Homes for access from their new development into the above play area from its southern boundary for the benefit of the new residents, thereby considerably improving access to the public. RECOMMENDED That the access as requested be agreed, subject to all costs of construction being met by the developer and to the satisfaction of the Secretary to the Council. (872) (SEC)

FLYINQOF POWERED MODEL AIRCRAFT (Minute 245/87) The Director of Leisure reported that following the decision to seek permission from the 1-Tome Office to amend the Bye—laws and grant individual licences to fly model aircraft on a specified part of Rawreth Playing Field, an approach had been received from the South East Essex Model Aircraft Society offering to undertake the management of this activity on behalf of the Council. The Committee considered that the Club would be able to give a much greater degree of control to this sport than would be possible from the Council's own immediate resources. RECOMMENDED That if and when the Home Office agree the necessary variations to the Bye—laws at Rawreth Playing Field, the management of this activity be passed to the Club for a trial period of one year t.ñien the arrangement can be reviewed. They were advised that it would not be possible to complete a feasibility study, including cost implications, in sufficient time to enable a report to be made to the next Meeting of the Committee, and with the concurrence of the proposer, the Notion was amended accordingly. RECOMMENDED That the Leisure Services Committee investigate, with the County Education Authority, the possibility of re—opening the Sweyne School Swimming Pool for public use during school holidays; and a report on the financial implications, with suggested cost sharing, be brought to a future meeting of the Leisure Services Committee. AGENDA ITEM 9 ROCUFORD DiSTRICT COUNCIL LEISURE SERVICES COMMITTEE — 13TH OCTOBER 1987 REPORT OF THE DIRECTOR OF LEISURE

FREIGHT HOUSE — MILL HALL — CASTLE HALL — CLEMENTS HALL FUNCTION SUITES — HIRING POLICY With time different operational policies have eome to be applied at the various halls that the Council operates and this report seeks to suggest a common policy direction for all the buildings which reflect the current policies of the Council. The Council has for some years faced the problem of reduced funding from central Government with the result that all the service areas had to reassess very carefully their expenditure and income in order to achieve the most cost effective operations possible. As part of this process various policies have been adopted, the most significant of which has been the establishment of the Council's own catering service, to provide the full catering functions within these buildings and others. The effect of establishing a catering service on as commercial a basis as is practicable within a local Authority has caueed a reappraisal of the type of service we operate in the halls (as the commercial success of the service depends very much on the operating policies applied within the buildings). The need to harmonise the management styles/approach between the halls and catering is something which has been developing over the last year and has necessitated the merging of the two areas. In art attempt to rationalise the existing situation the following changes to operating procedures are proposed:— 1..

Where full payment of a hall hire charge is made at the time of booking the charge for the hirIng will remain unaffected by any subsequent increase in charge that may be introduced. The normal cancellation arrangements will still apply.

2.

Fridays and Saturdays will be reserved for function bookings up to two months in advance of the date. Functions are one—off events such as weddings, anniversaries and parties, but will also include production weeks for RODS and large scale public events e.g. fairs, exhibitions and concerts etc.

3.

Regular Club bookings which enjoy a 50% concessionary charge between Mondays 8a.m. and Friday 7p.m. can subject to a minimum of two months notice, be cancelled to accommodate function bookings. Alternative accommodation will always be offered if available or the hiring charge refunded in full.

4.

Block bookings will only be accepted for a period of up to 6 months in advance. This will allow far more flexibility of programming and reduce to a minimum the need to vary bookings.

5.

The use of the Coffee Mill as a meeting room should be discontinued. The movement of the chairs and tables is resulting in damage and

the time (approximately 2 hours) taken to prepare and reset the room makes this provision totally unrealistic. It is proposed that any hirer displaced as a result shall be accommodated where possible in either the Terrace Bar or the Civic Suite. 6.

The facility at present afforded groups to provide their own private catering shall be discontinued. At the present moment the arrangement is being abused with professional caterers delivering food to hirers at their home, who then bring it into our buildings; or, after assuring the Halls Manager that catering is being done privately, a professional caterer arrives to provide this service. the latter has occurred at two wedding receptions in the last year and the only sanction available to us would have been to refuse to allow the reception to go on. Clearly such action would have been quite disastrous to the occasion. In addition caterers always require access to our kitchens and have as an inevitable consequence access to and use of our equipment with the result that frequently our Chefs find on the next day that the kitchens have been left dirty and equipment is either missing or damaged.

On Minute 249/86 a Member was advised that there was a need to establish the identity of the new owners of the premises before negotiations could be resumed. 465. UNAUTHORISED STORAGE OF VEHICLES AT DEODAR, LOWER ROAD, HOCKLEY The Director of Development reported that following enforcement proceedings against the unautborised use of agricultural land adjoining the above property, fences had been erected and the situation was being monitored to ensure compliance. Members noted however that several large high—sided lorries had subsequently been parked on the site, and were clearly visible from Lower Road, that the owner had applied to the Licensing Authority for an Operator's Licence to keep three removal lorries there, but that there was no planning permission for such a use. The Committee noted that it would be open to the local planning authority to object to the granting of such a licence if they considered the use to be detrimental to the environment and agreed that the presence of these large vehicles was visually most obtrusive in the Metropolitan Green Belt and quite inappropriate on this open residential site. Resolved that the Secretary to the Council be authorised to take all necessary action including the issue and service of Notices and action in the Courts to secure the remedying of the breach of planning control now reported. (6l9)(SEC) 466. UNAUTI-IORISE!) SITING OF CARAVANS ON ISA AND REAR OF 17—19 SOUTIW.ND ROAD, ROCHFORD

The Director of Development reported on the history of agricultural and horticultural use by the Boosey family at the above location, of which the present 3j acre site was a residual area which had remained from the original holding. That owner had been refused permission in 1983 to site a residential caravan as it was in the Green Belt and within the public

Plannin_gervices Committee safety zone of the Airport. Nevertheless a residential caravan had been sited thereon and occupied by Mr. Boosey who tended livestock on the site and had no other place of residence. Members noted that following the recent sale of the land two more caravans, owned by the new purchaser had been located there. The Committee, whilst having some sympathy for the original owner, could see no justification for departing from established Green Belt policy and allowing the reported contraventions to consolidate and perhaps encourage further breaches. It was therefore Resolved that the Secretary to the Council be a%tthorised to take all necessary action including the issue and service of Notices and action in the Courts to secure the remedying of the breach of planning control now reported. (13716) (EEC) 487. NEWHALLFAIU4, LOWER ROAD, HOCKLEY (Minute 920/84)

The Committee had before them an exempt joint report by the Secretary to the Council and the Director of Development regarding the enforcement action which had been taken to remedy various breaches of planning control at the above site, and the progress which had been made by the owner to ensure compliance. The sole remaining non—conforming use, namely a greengrocery business, had recently been refused permission on appeal. Members noted that it was the owner's intention to establish a mobile shop to enable him to continue to serve his customers and that he had asked to be allowed until 10th January 1988 to set up his new enterprise. The Committee considered that in the circumstances of this case the request was reasonable and it was Resolved that the applicant be advised that the requirements of the Enforcement Notices dated 17th December 1985 relating to the unauthorised sale of fruit and vegetables not produced at Newhall Farm and the unauthorised structure on the frontage of the premises, must be complied with no later than the 10th January 1988, failing which the Secretary to the Council will institute proceedings in the Courts to prosecute the applicant for contravention of the Enforcement Notices. Para. 6 — ROC/803/87 Note: Councillors Mrs. J.Fawell and T. Fawell declared a pecuniary interest in this item by way of intention to purchase adjacent land, and left the Meeting while it was under discussion, the Chair being occupied by the Vice—Chairman for that period. The Director of Development reported with the aid of viewfoils on this application, which followed an earlier submission under ROC/225/87 to extend the premises which had been refused. Members noted that in an endeavour to overcome the earlier objections the areas of land involved had been modified and more specific information had been supplied as to the intended zones in which the different activities involved would be carried out. In considering this application the Committee, whilst mindful that there was an existing use, had regard to the representations which had been received opposing the regularisation of the commercial use within a residential area, the intensification which had been taking place with the resultant increase in extremely large vehicles using inadequate approach roads and the lack of proper parking arid turning facilities at the site. A number of photographs were circulated showing the problems caused by the use of juggernaut lorries for delivering materials to the site. Having fully considered the planning implications involved the Committee agreed that the application should be refused, for the following reasons:—

1. The proposal would give rise to an intensification of the existing use of the adjoining builders merchants commercial business and such an intensification would be detrimental to the amenities of nearby residential properties by reason of increased noise and disturbance, dust and heavy traffic movements.

2. The proposed change of use from residential garden to builders merchants is likely to involve damage to or loss of one or more of the trees on the site which are protected by a Tree Preservation Order. 3. the proposed use is inappropriate in an area allocated primarily for residential development in the Approved Review Development Plan, the Essex Structure Plan and the Rochford District Local Plan.

area allocated for residential development, there was already commercial use taking place. The Committee were mindful chat they had already granted permission under ROC/165/86 for an almost identical building for use as a doctor's surgery but whereas that was compatible with the residential notation they considered that the extension of the commercial use should be resisted and the application was refused for the following reasons:— The proposed development would be contrary to the provisions of the Approved Review Development Plan and the Rochford Distiict Local Plan wherein the site is within an area intended primarily for residential purposes. Furthermore the proposal would represent a consolidation and intensification of the use of the site for non—conforming purposes contrary to the objectives of the aforementioned plan and to the detriment of the amenities of the adjoining residential properties. 469. This application was deferred at the last meeting on 24th September, 1987 to await a response from the County Surveyor regarding intensification in traffic movements and closure of the gap in the central reservation on the adjacent A130. The County Surveyor has now replied as follows:— "I share your Authority's concern regarding the possible intensification in the use of the gap. in the central reservation and the potential hazard caused by right turn movements across

This application follows a previous submission to extend the premises which was refused by the Committee in May, 1987 (ref. No. ROC/225/87) for the following reasons:1.

The proposal would give rise to an intensification of the existing use of the adjoining builders merchants commercial business and such an intensification would be detrimental to the amenities of nearby residential properties by reason of

increased noise and disturbance, dust and heavy traffic movements. 2.

The proposed change ot use from residential garden to builders merchants is likely to involve damage to or loss of one or mote of the trees on the site which are protected by a Tree Preservation Order.

3.

The proposed use is inappropriate in an area allocated primarily for residential development in the Approved Review Development Plan, the Essex Structure Plan and the Rochford District Local Plan.

The applicants have lodged an appeal against that decision and an informal hearing is scheduied to take place on 11th November, 1987.

In an attempt to overcome the previous objections and avoid the need to pursue the appeal the applicants have presented a revised

proposal which still seeks to change the boundaries of the existing use but with modifications to areas of land involved and

more specific information on the activities to be conducted within the site The use of the site as a builder merchants is a well established one and whether the current application is approved or not there

is little likelyhood that the existing operation will cease. the site raises a question

In addition the new application specifies precise operations in

Parking and stacking areas for building material are precisely shown both in terms of area and stacking heights which is not to exceed the heights of boundary fencing. Car parking provision is specified together with clear provision for the parking, loading and turning for commercial vehicles.

On balance it is felt that the new proposal merits favourable consideration by enabling environmental improvements to the existing situation coupled with effective control over what takes place within the site.

No firm recommendation is made as the application is a very recent submission and there has not been sufficient time to complete consultations. There is however considerable urgency in

the matter in view of the impending appeal inquiry into the previous decision.

If the Committee consider the new proposal merits support then it is recommended that determination of the application be delegated to the Director of Development. Any permission should include conditions covering the following points.

471 COUNTY HIGHWAYS MATTERS

Mr. A. Cook, the County Highways representative, advised the Meeting that immense efforts had been necessary to clear the roads of fallen trees following the hurricane winds of last week. The County and District Council workforces had co—operated fully in this respect and he was grateful for this assistance. All roads were open but many footways were still obstructed and it would be a longer process to remove the debris from roadsides. Arrangements had been made for the public to deposit storm damage debris free of charge at the Civic Amenity Sites and the County landfill site at Great Wakering. The Committee applauded the immediate response of County Highways to the emergency conditions. Members were asked to report to the Officers any trees by the highway which appeared to be in a dangerous condition. Mr. Cook added that with the evenings drawing tn Street lighting defects would again become more of a problem and that these should be reported direct to his staff at the Divisional Highways Office. Reinstatement would depend on the nature of the defect but on average would take three weeks. The highway works in South Fambridge to assist the sea wall improvements had been completed and tipping operations would begin mid November. A decision by the Department of Transport on the Rayleigh Weir Inquiry was expected within four to five weeks. Statutory undertakers' works could start in April 1988 and the main contract in November. Members noted that various traffic surveys were taking place in the District as part of a County study of road and traffic conditions in the South East of the County. (45)

472 UNDER £50,000 CAPITAL SCHEMES: ROCEFORD DISTRICT The Director of Development reported that Essex County Council were considering the installation of three mini—roundabouts at Ashingdon Road/ Dalys Road/Roche Avenue, Bradley Way/West Street and Bradley Way/Southend Road/South Street and that the draft proposals included refuges for pedestrians on dli main road approaches.

476 BRITISH RAIL — LIAISON (Minute 73/87) (a) Rpçrt by Area Manager Mr. H. Robson, the new Area Manager of British Rail, was present 10 up— date Members on the proposals for improving the rail service. He referred to the five year development programme which would involve investment of £172,000,000 on station enhancement, £380,000,000 on new trains, £39,000,000 on electrification and £112,000,000 on car parks and other works.

With the aid of viewfoils he described the current redevelopment of Liverpool Street Station, the works to Southend Central and the plans for Southend Victoria. Liverpool Street would be completed by 1991 with all eighteen platforms capable of taking twelve coach trains which would increase capacity. The whole line between Liverpool Street and Southend Victoria was programmed to be re—signalled beginning in 1988/89 and this would reduce delays and improve flexibility. Car park improvements had already been undertaken at Rochford, ilockLey and Rayleigh and ticket issuing facilities had been improved or were under review. The programme also included lighting improvements to all stations on the line. In respQnse to questions from Members Mr. Robson agreed that b tter communications with passengers over delays and

Development Services Committee cancellations were needed and that the re—signalling of the line would certainly help in this respect. Local radio could not assist more regularly than they did in supplying rail service information. The indicator boards at Rayleigh Station and other stations on the line were computerised and technical, difficulties were having to be overcome to amend the information displayed. He agreed to advertise the availability of Battlesbrtdge Station to commuters in Hullbridge and then to review the timetable. Mr. Robson acknowledged that toilet facilities on stations were needed but that they faced a serious problem with vandalism. It was noted that delays of short duration outside Wickford were probably due to the Southminster branch line and that the temporary speed restrictions between Billericay and Rayleigh would remain until after subsoil problems associated with Essex clay had been overcome in April and May. He indicated that where complaints were received that footpaths by railway property were overgrown they would arrange for them to be cleared and that he would look into the ownership of the land by the railway bridge at Rayleigh Station and whether its appearance could be enhanced. lie would also examine whether there was any means available to reduce the gap between the train and platform at Rayleigh. With regard to smoking on trains they were examining the possibility of a total ban, but that in the interim they would look into providing ashtrays and litter bins in the design of the new trains. As to the standard of the rolling stock, he explained that by May next year only twelve car trains would contain "unrefurbished" coaches and noted that it was at these peak travel times that the public would expect the best standards to be provided and that improved travelling conditions were long overdue. Hf forts were continuing through their inspectorate to reduce fare evasion but there would always be difficulty without a large increase in manpower in preventing passengers entering first class compartments after the train had Left the station. Electronic surveillance devices at stations was not a feasible option but new legislation was on its way through Parliament which would allow on the spot fines for persons without valid tickets. They were reassessing with the Transport Police the effects on security of vehicles of the transfer from car park attendants to pay and display machinery. Questioned on whether the priority should be to improve the efficiency standards and capacity in what the public regarded as a second rate service, rather than investment in the proposed new livery, Mr. Robson replied that last year the service on both the Liverpool Street and Penchurch Street lines had been the best for five years and that it was a particularly intense timetable which made it vulnerable with old rolling stock being more liable to failure. Any complaints about the service should be addressed to Mr. Corton the Area Civil Engineer at Stratford on telephone number 01 534 4500. He confirmed that British Rail were evaluating the possibility of eliminating stops at Harold Wood and Brentwood for the slower trains but that this had yet to be subjected to the consultation process. 478 HIGHWAYS ACT 1980 — SECTION 119 — DIVERSION OF FOOTPATH 22 HOCKLEY The Secretary to the Council reported on the history of an application by the owner of Grangefield Nursery, St.Peter's Road, Hockley for an Order pursuant to Section 119 of the Highways Act 1980, the effect of which would be to divert part of footpath 22, Hockley, on the advice of the Essex County Council as highway authority and the outcome of a High Court action which ruled on the position of the applicant's eastern boundary. The Committee noted that the proposal was of little consequence in terms of the highway land to be enclosed within the Nursery and that it was questionable as to whether the diversion was in the interest of the public or the landowner, the grounds for making an Order. Added to this there was doubt over whether a Diversion Order or an Extinguishment Order was appropriate depending upon the extent to which the right of way existed over part or all of St.Peter's Road. In view of the negligible effect of the diversion sought, the fact that neither of the grounds in the legislation could be satisfied, and the doubt over whether it should in any case be a diversion or an extinguishment, it was considered that the Council should not pursue this application. RECOMMENDED That in view of the foregoing factors the application wade iiy Mr. C.C. Jeffery to divert part of Footpath 22 Hockley, be refused. (28415) (SEC)

479 TOWN AND COUNTRY PLANNING ACT 1971 — SECTION 210 — PROPOSED DIVERSION OF PART OF FOOTPATH 7 HAWKWELL The Secretary to the Council reported receipt of an application by Agents acting on behalf of W3C Construction Limited for diversion of part of Footpath 7 Hawkwell to permit the carrying out of development authorised by planning permission ROC/391/86. The Committee noted that the diversion entailed moving a short section of the footpath near to the west end of Albert Road approximately 17 yards to the north of its present route and would also provide a direct link with Albert Road.

RECOMMENDED That the proposal be agreed in principle, and the Secretary to the Council be authorised to proceed with formal consultations, (8339) (SEC)

480 PRIVATE DRAIN BLOCKAGE CONTRACT (Minute 511/86) The Director of Development reported that the private drain blockage contract expired in August 1987 and that the present contractor had offered to undertake all necessary works under the same terms, conditions and prices for a further period of twelve months. The Committee noted that the cotapany had worked efficiently and well since stepping itt to take over when the original contractor withdrew on financial gounds, and supported a further one year contract on the same terms. RECOMMENDED That Ace Drain Clearing (formerly Al Arvon) be reappointed as thc Council's nominated private domestic drain blockage contractor to August 1988, on the saute terms, conditions and prices as the previous contract year i.e. £7.00 plus VAT per call and that this decision be implemented immediately. The Director of Development reported that the First Rayleigh Scout Group had asked the Council to consider this section of ditch for piping under the annual drainage contract. A scheme had been prepared which consisted of piping some 55 m of open ditch in the ownership of the District Council at the end of Kenilworth Gardens adjacent to the Scout building/land and the Glebe School Playing Field. Tenders had been invited for the work the lowest of which could be met from within the estimate provision. RECOWIENDED That the lowest tender for the above work submitted by Pearl Land Drainage in the sum of £6,950.00 be accepted subject to contract. (715) (DD,SEC)

DISTRICT PLAN WORKING PARTY The Director of Development reported that the District Plan Working Party had been considering the Inspector's Report and recommendations on the

Development Services Committee Local Plan Inquiry and that the Minutes of their deliberations which were yet to be completed would be presented to the Development Services Committee on 26th November 1987. In the meantime the Committee were aware that no alteration had been recommended in respect of Policies Hi, 1-12 and 1-15 of the Local Plan which

were current Council policies. They noted the view of the District Plan Working Party that it was important to ensure that the sites identified for development could be programmed and construction commence during the Plan period and that there was good reason therefore not to delay the progress of sites which were uncontentious. Members sought and received clarification from the Director of the sites involved. RECOMMENDED That the Planning Services Committee be advised that applications for planning permission for residential purposes in respect of sites allocated in Local Plan Policies 111, 112 and H5 be considered for approval in advance of the formal adoption of the Local Plan subject to the satisfaction of infrastructural requirements and to applications being dealt with as "departure proposals" where appropriate. 485 ESSEX STRUCTURE PLAN — FIRST ALTERATION DOCUMENT The Committee gave consideration to the appended report of the Director of Development regarding certain modificatons which had been made to the Essex Structure Plan First Alteration Document prior to its submission to the Secretary of State for approval.

RECOMMENDED That this Authority's formal response to the Essex Structure Plan First Alteration Document be as follows:— (i)

that the revised housing allocation figure of 4,600 units for the period 1986—2001 shown in proposed Poiicy Sl be accepted.

(ii) that the general phasing of housing development identified in Table 4 of the First Alteration Document be accepted. (iii) that the revised industrial/warehousing allocation of 40 hectares shown in proposed Policy El be accepted. and that Essex County Council be advised accordingly. (2081) (DD)

486 TOWARDS A POLICY FOR REGIONAL SHOPPiNG CENTRES (RSC's) The Director of Development reported receipt of a consultation paper on the above subject from the London and South East Regional Planning Conference (SERPLAN), the production of which had been considered necessary in view of the large number of RSC's being proposed in the region, most combined with leisure facilities and related to the M25 Motorway. The Committee noted the main conclusions drawn from the study, and that with the approval by the Secretary of State to the Thurrock scheme it was extremely doubtful whether another RSC could be justified in the north east London quadrant,

"Enjoying the Countryside"

Members noted that many recommendations made by Panel had been effected already in the Rochford recognised that further public awareness of the achieved. Particular aspects were discussed as

the Countryside Commission District, although it was countryside could be follows:—

(a) A member reported that Essex County Council had recently introduced a scheme whereby Parish Councils elect a footpath representative to Liaise with the County Surveyor regarding footpath problems. Members were mindful of the potential benefits of this scheme once establIshed. In the consultation paper provision was made for the development and promotion of long distance walks, of which there were three in Essex. The 21 mile "Roach Valley Way" had been waymarked and detailed in a leaflet issued by the District Council and members considered possible additions to this route.

(b) There were 50 ancient woods in Essex) most having "rights of way" either running through them, or directly alongside. Members discussed the possible further provision of rights of way in woods within the District. Mr. Amos offered to submit to the Director of Development a list of potential routes although some members were concerned over further intrusion by motor cyclists if more woodland area was opened to the public.

(c) It was noted that no public right of way existed along the southern bank of the River Roach between the points where Footpath 2 Barling Magna leaves the river bank westwards to Sutton Ford Bridge. It was agreed that the Secretary to the Coupcil would pursue investigations with Essex County Council to ascertain the feasibility of a public footpath along this section. (ii)

'New Opportunities"

The Review Panel report envisaged considerable changes in the use of surplus agricultural land over the next decade and members agreed that successful transition would depend on close liaison between the local authority and the farming community.

13. WOODLAND PROJECT Members were pleased to note that Mr. B. Watmough's duties had recently been extended to incorporate the woods of Castle Point District and that a Woodland Assistant was currently being appointed in consequence.

14. ROCEFORD BYWAY NO.2 Reference was made to this bye—way from the southern end of Gusted Hall Lane to Flemmings Farm Road. Members were aware that Essex County Council had re—surfaced the bye—way earlier this year which had resulted in its use by all classes of motor vehicles to the detriment of pedestrians and horse riders for whom it was intended. The County Council had subsequently proposed the making of a Traffic Order to exclude all but agricultural vehicles but following public advertisement a number of objections had been received and further consideration would need to be given to this matter.

15. BIO13 ACCESS TOSOUTHEND Members noted that on 21st May the Essex County Council Highways Committee had agreed in principle to Option 4 which would run from Hall Road to the A127 at a point to the east of Westbourne Grove, Westcliff. Concern was expressed that the new road could prove detrimental to the environment by bringing industry and housing along its route, although it was noted that the District Plan should prove instrumental in controlling that development. Further traffic schemes were to be implemented as a matter of urgency in Sutton Road to alleviate traffic flows into Southend.

16. LEAFLETS ON WALKS The Group were pleased to note that a number of leaflets describing walks along selected public footpaths had been updated and a new leaflet setting out a walk between Hockley and Hullbridge entitled "Pluinberow" had also been issued.

The Chairman reported the intrusion of speed boats on the River Roach at Paglesham. In view of the dangers to other river users it was agreed that Officers should inform the Crouch Harbour Authority of this infringement. (SEC)

20. ROCUPORD DISTRICT LOCAL PLAN - INSPECTOR'S REPORT The Director of Development advised Members of certain matters within the Inspector's Report on the Public Inquiry into the Rochford District Local Plan. Members noted the reasons why, in order to provide for housing needs to the year 2001, the Inspector was recommending that certain objection sites should be included although the Council considered that sufficient land was available within the Plan for that purpose. Particular items of conservation interest within the Inspector's Report were noted as follows:— (i)

Laud ar Wellington Road, Rayleigh

Members were concerned to note that this area, which fell within the Roach Valley Conservation Zone, was one of the sites recommended by the Inspector for inclusion as an Area oE Special Restraint. They were not convinced by the arguments which had been put forward in that respect and asked that the District Council be urged to resist the withdrawal of Green Belt notation from the site in question. (ii)

Provision of Horse Ridin& Facilities

The Inspector had recommended that there should be an appendix relating to horse riding facilities, including the use of grass verges and that consideration should be given to the provision of routes within public

open spaces. It was anticipated that these recommendations would be supported and modifications made, although there was no change to established policy. (iii)

Advertisement Control in Conservation Areas

The Inspector was recommending a less prescriptive policy than that set out in the Plan, but the use of illuminated box signs was seen as detrimental within conservation areas and it was therefore unlikely that any change would be made. (iv)

Conservatign Policy for the Establishment of Public Open Spaces and Local Nature Reserves

Members were advised that representations had been made by the Essex Naturalists Trust regarding a Nature Conservation Policy for specified areas of public open space. They had also sought protection for the existing Lion Creek Nature Reserve and had promoted the creation of further nature reserves. The Inspector was satisfied that the District Council was sensitive to the special requirements and value of nature conservation. Members noted that the District Plan Working Party would be meeting to discuss the Inspector's Report during the week commencing 14th September and to consider their response to the recommendations contained therein.

21. TREE CUTTING ADJACENT TO OVERHEAD POWER LINES The Director of Development reported that following liaison with the Eastern Electricity Board, it had been agreed that the Board would consult with the District Council on any tree lopping schemes, adjacent to overhead power lines. This would enable certain individual trces which merited special pollarding treatment to be identified. Proper tree surgery carried the benefit of extending the period between cuts. The first such consultation had ben received and advice given accordingly.

22. RE-INTRODUCTION OF HEATH FRITILLARY BUTTERFLY INTO HOCKLEY WOODS Members were advised that with a short life of only in the country. They were release of this butterfly

the Heath Fritillary Butterfly was a weak flyer 10—11 days and was one of the rarest butterflies pleased to learn of the re—introduction and into coppiced areas in Hockley Woods.

23. ROCHPORDBYEWAY NO.2 It was noted that this matter was due to be discussed by the Traffic Sub—Committee of the Essex County Council on the 8th October 1987.

24. RIGHTS OP WAY Members discussed the difficulties inherent in this scheme whereby Parish Councils nominated a representative to liaise with the County Surveyor over footpath problems. It was hoped that more farmers could be persuaded not to plant over the footpaths. Mrs Graham advised that she was seeking support for the protection of bridleways from being ploughed up. Members noted the manner in which the Essex County Council were to give priority to improving the public right of way network.

25. STATUS OF HOCKLEY WOODS A Member reported the need for improved access points into Hockley Woods noting that a new leaflet entitled "Hockley Woods" showed that there should be seven entrances to the Woods. Members discussed the concept of Hockley Woods becoming a Country Park but considered there was no advantage in changing its status. Members were pleased to note that improvements to the Car Park in the Woods would be commenced shortly.

26. ROYAL SOCIETY FOR THE PROTECTION OF BIRDS Members were advised that a new publication could be obtained from the Royal Society for the Protection of Birds regarding their conservation and research programme and the management of their sites.

27. MR STANLEY CRAMP The Chairman reported with sadness the death of Mr Stanley Cramp who had been a considerable force during the anti—Maplin Airport Campaign.

48. ARISING FROM THE MINUTES (a) Progress on Permissive Routes Mr. Wood reported that planning permission had been granted for the proposed link from Gusted Hall Lane to Mount Bovers Lane, and that the agreement was being discussed with Rankin Farms Limited. It was understood that Mr. H. Smith had not yet been able to contact Mr. R. Smith regarding the Stevens Farm route. With regard to the Clements Hall route, it was noted that Mr. Keddie was of the opinion that the section crossing his land had been a bridleway for at least 30 years and Mrs. Howe also promised to supply supporting evidence. Fencing of this route could possibly be carried out by the Council. Discussions bad taken place with the owner of Clements hall regarding a permissive route over his access, but if full bridleway rights

could be established then his agreement would not be necessary. The planning application affecting footpath 7 Ashingdon had been approved, including a further section of Rectory Avenue. A 7 metre wide strip had been reserved to accommodate the diverted footpath and a bridleway.

(b) Wellington Road) Rayleigh On the advice of the Chairman, it was agreed that this matter should be deferred pending consideration of the Inspector's report on the Local Plan Inquiry.

(c) Purdey's Industrial Estate, Rochford Mr. Collins reported that the proposal to divert bridleway 38 Rochford had been advertised and that 3 objections had been received. Discussions were taking place with the objectors, but if the objections were not withdrawn then a Public Inquiry would be a possibility. It was also noted that Essex County Council had agreed to an improvement scheme for Sutton Road) which would involve a new route from near Sutton Bridge to Southend Road, close to Tinker's Lane. It was suggested that Essex County Council might consider providing a wide verge along one side of this route, which could accommodate a bridleway. (d) Murrells Lane, 1-lockley and Track Leading to Polly's Farm

It was agreed that evidence relating to bridleway rights over this route should be passed to the Council for onward transmission to Essex County Council.

(e) Bridleway 10 Rochford —

Mr. Wood reported chat lie had approached Queens Moat Houses Limited the owners of the adjacent land to the north, and whilst they had not yet agreed to make any land available, they were considering the matter. If agreement could be reached the route would need fencing and the flood lights and the large aircraft on the site might have to be moved. There was also the question of compensation to be considered. The representatives were advised that Option 4 for the relief of the 131030 road had been approved and that work would commence in 1991/2. This proposal would affect Bridleway 10 although the Essex County Council had not yet indicated how they would deal with the bridleway. It was hoped that a wide verge would be made available at the side of the new road which would be suitable for horses.

49. BY-WAY 2 ROCHFORD — GUSTED HALL LANE TO FLEMINGS FARM ROAD It was noted that the proposed Traffic Order barring motor traffic but for access had been approved by County Council but for ratification by the full Council. It was proposed to control vehicular use by means of gates.

50. DATE OF NEXT MEETING It was agreed that the next Meeting of the Working Party would take place on 21st October 1987 at 7.30p.m.

DEVELOPMENT SERVICES COMMITTEE — 20TH OCTOBER 1987 ESSEX STRUCTURE PLAN — FIRST aTEFATION DOCIJNENT (Minute 583/86)

1.0 Introduction 1.1 The Director of Development reports that the County Council has recently published a revised version of the above document for formal submission and approval by the Secretary of State for the Environment, a copy of which has been placed itt the Members' Room. 1.2 Members will recall giving consideration to the draft document, published In 1986, at the Development Services Committee on 27th November 1986. 1.3 Following the Committee's consideration of the document representations were made to the County Council supporting, In the main, the proposed alterations to the current Structure Plan. 1.4 The bulk of the revised plan, which is now on public deposit, remains as previously reported but particular changes require to be brought to the Committee's attention.

2.0 Settlement Pattern 2.1 The section concerned with settlement pattern rolls forward the current Approved Structure Plan allocations to the 31st March 2001 but sets the base date, not from the end of the current plan period, but from 1st April 1986. 2.2 In the draft First Alteration document the housing allocation figure for Rochford, contained in revised Policy Si, was for 4,100 dwellings to be provided between 1986 and 2001. This figure has now been revised upwards giving a new housing allocation in Policy SI of 4,600 units. 2.3 Analysis of the current land availability position in the District, together with the capacity of long term housing sites and an allowance for intensification reveals that this revised requirement can be met. 2.4 The figure, included in Policy Si of the revised plan, for the County as a whole, are based closely on forecast requirements identified through SERP1.ANts regional planning guidance and the Department of the Environments household projections. 2.5 The Secretary of State has said that he considers SERPLAN's housing provision estimates to provide a reasonable basis on which proposals for Structure Plan alterations can be brought forward. 2.6 It is not, however, beyond the bounds of possibility that the Secretary of State will revise the Policy Si allocation upwards. If that were to be the case then Districts could [ace the difficult position of requiring to allocate more land for housing development.

2.7 In view of the fact that the allocation for Rochford has already been revised upwards, albeit without additional land being identified, it would be possible to argue a strong case to the County Council for any further housing land requirements identified by the Secretary of State, to be found elsewhere in Essex. 2.8 The County Council has maintained its attitude with regard to the inclusion within the alteration document of a general indication of the phasing of housing development. 2.9 It was initially considered that phasing imposed by the County Council would have the df feet of removing the rights of the District Council to control the programming of the sites identified in the Local Plan. 2.10 The general indication of phasing given in Table 4 of the alteration document provides, however, a broad framework to ensure that new housing land is released at the appropriate time during the Plan period.

3.0 Employment 3.1 Following their earlier consideration of the Draft Alteration document the Committee resolved to inform the County Council that the amount of industrial land required in proposed Policy El (43 hectares) for the period 1986—2001 should be reduced to 35 hectares, particularly bearing in mind the large amount of vacant floorspace existing in the District. 3.2 The County Council concluded, upon examination, that there was some merit in this request but that it would only be possible to reduce the proposed land provision 1986—2001 shown in Table 6, to 40 hectares. 3.3 it is considered that the revised figure of 40 hectares will enable industrial land allocation figures within the remit of the current Local Plan preparation procedure to be fulfilled without endangering additional Green Belt land. REC0MIIENDED That this Authority's formal response to the Essex Structure Plan First Alteration document be as follows:— (i)

That the revised housing allocation figure of 4,600 units for the period 1986—2001 shown in proposed Policy Si be accepted.

(ii)

That the general phasing of housing development identified in Table 4 of the First Alteration document be accepted.

(iii) That the revised industrial/warehousing allocation of 40 hectares shown in proposed Policy El be accepted. and that Essex County Council be advised accordingly. (2081) (DD)
