Dear Ms Uncles, Freedom of Information Act (FOIA) Request – 171110007 Thank you for your request dated 10 November 2017 in which you asked for the following information from the Ministry of Justice (MoJ): Please can you disclose; (1) The total number of financial remedies awarded to security company G4S in the financial year April 2016-2017 as a result of contractual failings between the company and the Ministry of Justice. (2) The explanation for each financial remedy. (3) The sum of each financial remedy. Your request has been handled under the FOIA. I can confirm that the MoJ holds the information that you have requested and I have provided it below. Firstly, it is worth mentioning that Prison Contracts set out a strict performance framework, consisting of prescriptive performance targets. Failure by the provider to meet performance targets results in performance points being applied. Privately managed Prison providers achieve the majority of their contractual targets with proportionately low levels of performance point and financial remedies applied as a result. Privately managed prison contracts contain provisions which allow financial remedies to be applied for non-performance. Performance points are awarded according to the severity of failure and if the total number of points exceeds the agreed baseline for the performance quarter or year, financial remedies are applied against the contractor in accordance with the contract. As financial remedies are only applied if baseline targets are exceeded, it is not possible to link individual incidents to the value of remedies that have been applied due to this cumulative effect.

The number and total of financial remedies applied at G4S Privately Managed Prisons are included in the table below. Information for the final quarter of financial year 2016-17 is not finalised in all cases but is included provisionally.

G4S also hold contracts with HMP Altcourse and HMP Oakwood. No financial remedies were imposed on these establishments for the financial year requested. The number and total of financial remedies applied at G4S managed Secure Training Centres is provided in the below table. These financial remedies relate to the following service area failures; • Assaults on trainees; • Prohibited items; • Security fence climbing; • Concerted indiscipline (passive); • Concerted indiscipline (active); • Complaints and representations; and, • Failure to provide the contracted number of beds.
