SCHEELS 12 DAYS OF CHRISTMAS PROMOTION 2017 CONSUMER DISCLOSURE 1. No winners will be selected prior to November 27, 2017. On and following that date, the winners of the SCHEELS 12 Days of Christmas promotion (the “Promotion”) shall be chosen strictly in the manner provided in the Rules, Terms, & Conditions below. 2. NO PURCHASE, PAYMENT, OR DONATION IS NECESSARY TO ENTER OR WIN A PRIZE IN THE PROMOTION. PURCHASE, PAYMENT, OR DONATION WILL NOT INCREASE OR IN ANY WAY IMPACT A PARTICIPANT’S ODDS OF WINNING. 3. The estimated retail value of each prize in the Promotion is specified in Section 7 of the Rules, Terms, & Conditions below. 4. RULES, TERMS, & CONDITIONS 1. No Purchase Necessary. NO PURCHASE, PAYMENT, OR DONATION IS NECESSARY TO ENTER OR WIN A PRIZE IN THE PROMOTION. PURCHASE, PAYMENT, OR DONATION WILL NOT INCREASE OR IN ANY WAY IMPACT A PARTICIPANT’S ODDS OF WINNING. 2. Sponsor. The SCHEELS 12 Days of Christmas (the “Promotion”) is sponsored by SCHEELS All Sports, Inc., 4550 15th Avenue South, Fargo, ND 58103 (“SCHEELS”). 3. Rules, Terms, & Conditions. By participating, each entrant agrees to be bound by all rules, terms, and conditions of the Promotion, and understands the results are final in all respects.
4. Applicable Law and Severability. The Promotion is subject to all applicable federal, state, and local laws and regulations, and any offers, terms, rules, or conditions associated with the Promotion are VOID WHERE PROHIBITED. Any provision in these Rules, Terms, & Conditions which violates or is otherwise contrary to applicable law shall be considered to be without force, and the remainder of these Rules, Terms, & Conditions should be enforced to the extent legally possible as if the non-conforming provision were never included. 5. Promotion Overview. The Promotion is a sweepstakes, which is free to enter without any purchase, payment, or donation required, to all eligible persons as defined in Section 6. Contestants will have the opportunity to win the prizes listed in Section 7 through entries via the SCHEELS Facebook page (@scheels), or via the online entry form at https://goo.gl/forms/vr6Ns91dxvxTlQ7y2. SCHEELS will publish a Facebook post on each date specified in Section 10, which will describe the Prize to be awarded for that day, and include any additional instructions or information beyond these Rules, Terms, & Conditions. 6. Eligibility. The Promotion is open to legal residents of the United States who are at least 18 years old. SCHEELS employees and their immediate families, and residents of Florida, New York, and Rhode Island are not eligible to participate or win any Prizes. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. 7. Prizes and Valuation. The Prizes and their estimated retail values are listed below for each day of the Promotion. Prizes are not transferable or redeemable for cash. No Prize may be wagered, exchanged, or otherwise used to accumulate additional prizes. All Prizes must be claimed within 72 hours’ notice of winning. If a winner cannot be contacted, does not claim the prize, or is disqualified, SCHEELS shall determine an alternate winner from the eligible entries for that day of the Promotion. In SCHEELS’ sole discretion, the listed Prize may be substituted for a prize of comparable value. Prizes will be delivered to the winners within 30 days following the end of the Promotion. Retail value: $1901.86 8. Odds of Winning. Each participant’s odds of winning are subject to the total number of entries received for each day of the Promotion. 9. How to Enter. Eligible participants may enter each day of the Promotion in one of two ways: (1) using Facebook to comment on, and “LIKE,” SCHEELS’ post for the Promotion made on its Facebook Page (@scheels) between 7:00 a.m. (CST) and 11:59 p.m. (CST); or (2) completing the form located at https://goo.gl/forms/vr6Ns91dxvxTlQ7y2 between 7:00 a.m. (CST) and 11:59 (CST). Eligible participants may enter Day 13 of the Promotion in one of two ways: (1) using Facebook to comment on, and “LIKE,” SCHEELS’ post for the Promotion made on its Facebook Page (@scheels) between 7:00 a.m on Friday, Dec 15, 2017 (CST) and 11:59 p.m on Sunday, Dec. 17, 2017 (CST); or (2) completing the form located at https://goo.gl/forms/vr6Ns91dxvxTlQ7y2 between 7:00 a.m on Friday, Dec 15, 2017 (CST) and 11:59 p.m on Sunday, Dec. 17, 2017. Entries apply to that day’s Prize only, and no participant may enter more than once per day. Eligible participants may participate in the Promotion on any or all of the dates of the Promotion by adhering to the instructions in this Section 9, these Rules, Terms, & Conditions, and any additional instructions which may be presented in SCHEELS’ Facebook post for any given day of the Promotion. SCHEELS reserves complete discretion to void any entries which are lewd, harassing, spam, or otherwise do not conform to these Rules, Terms, & Conditions. 10. Promotion Dates. The Promotion will be conducted in daily installments on the following dates: 11/27/2017, 11/28/2017, 11/29/2017, 11/30/2017, 12/4/2017, 12/5/2017, 12/6/2017, 12/7/2017, 12/11/2017, 12/12/2017, 12/13/2017, 12/14/2017, and 12/15/2017. 11. Selection and Announcement of Winners. One daily winner will be chosen by random drawing from all eligible entries, on the day following each day of the Promotion. Daily winners will be announced and notified at approximately 9:00 a.m. (CST) on the following dates: 11/28/2017, 11/29/2017, 11/30/2017, 12/1/2017, 12/5/2017, 12/6/2017, 12/7/2017, 12/8/2017, 12/12/2017, 12/13/2017, 12/14/2017, 12/15/2017, and 12/18/2017. Winners will be announced on SCHEELS’ Facebook Page (@scheels), and may also be contacted via private Facebook message and/or e-mail. All participants will also be notified of the winners for each week on the Friday following each week’s promotion. For week 1, the winners for days 1-4 will be notified the morning following their entry in a Facebook post or private message, e-mail, or phone call, and will receive a confirmation reply on or before Friday, December 1, 2017.
For week 2, the winners for days 5-8 will be notified the morning following their entry in a Facebook post or private message, e-mail, or phone call, and will receive a confirmation reply on or before Friday, December 8, 2017. For week 3, the winners for days 9-12 will be notified the morning following their entry in a Facebook post or private message, e-mail, or phone call, and will receive a confirmation reply on or before December 15, 2017. For any additional prize days, the winner will be notified in a Facebook post or private message, e-mail, or phone call, and will receive a confirmation reply on or before Friday, December 22, 2017. 12. Publicity. By participating, where allowed by law, all participants and winner(s) grant SCHEELS the exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with publicizing this and other promotions, and waive any claims to royalty, right, or remuneration for such use. SCHEELS will not share any personal information obtained through any participant’s entry with third-parties for any purpose, other than through advertising, publicity, or related uses as contemplated by this Section. 13. Indemnification and Release of SCHEELS. By participating in the Promotion, all participants, including the winner(s), waive any and all claims of liability against SCHEELS, its principals, employees, and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Promotion, or from the use of any Prize. Each participant further agrees to indemnify, defend, and save SCHEELS harmless from and against any and all injury, loss, claims, actions, damages, liability, costs and expense, including reasonable attorney’s fees, resulting from loss of life, personal or bodily injury, damage to property, or other incident arising from or out of any occurrence related to the participant’s participation in the Promotion, or the use of any Prize. This agreement to waive liability and indemnify SCHEELS shall not apply to intentional, willful, or wanton acts on behalf of SCHEELS or its agents, employees, principals, and owners, but shall apply to all other manner of liability, including negligence. 14. Release of Facebook. The Promotion is in no way sponsored, endorsed, administered by, or associated with Facebook, Inc., or any of its subsidiaries or affiliates. By participating in the Promotion, each participant and winner waives any and all claims of liability against Facebook, Inc., its subsidiaries and affiliates, and all principals, employees, and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Promotion, or from the use of any prize. 15. Taxes. Any valuation of the prizes stated above is based on available information provided to SCHEELS, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the Prizes and paying any expenses associated with any Prize which is not specifically provided for in the official rules. Each winner must provide SCHEELS with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person(s) winning over $600.00 USD in prizes from SCHEELS will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
16. Conduct and Decisions. By participating in the Promotion, each participant agrees to be bound by the decisions of SCHEELS and by these Rules, Terms, & Conditions. Persons who violate any rule, gain unfair advantage in participating in the Promotion, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing, or threatening behavior is prohibited. SCHEELS will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Promotion and SCHEELS’ decisions concerning such disputes shall be final. If the conduct or outcome of the Promotion is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the SCHEELS, SCHEELS reserves the right to terminate this Promotion, or make such other decisions regarding the outcome as SCHEELS deems appropriate. All decisions will be made by SCHEELS and are final. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT, OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS PROMOTION, TELEPHONE SYSTEMS, OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS STRICTLY PROHIBITED. SHOULD SUCH AN ATTEMPT BE MADE, SCHEELS RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. 17. Choice of Forum. Any action stemming in any way from the conduct of the Promotion, or these Rules, Terms, & Conditions, shall be filed in the appropriate state or federal courts encompassing Cass County, North Dakota. Promotion entrants waive any claim of forum non conveniens or lack of personal jurisdiction they may have. 18. Miscellaneous. Each winner must submit proof of eligibility in order to be eligible to collect a Prize. For a copy of the rules, or where required by law, a list of winners, mail a written request with a stamped, self-addressed return envelope to the address, listed below.
