s good as a business can be — or how well a product performs — doesn’t mean much if you can’t market it the right way. In recent years, the rise of social media has changed the landscape of marketing and advertising, and it is something that businesses and companies would do well to take advantage of. According to the Data and Marketing Association, over $26 billion is expected to go to ad spending in 2018, and in 2017 social network ad spending hit nearly $20 billion. A current trend is the shift of online content to video, said THM’s Social Media Specialist Brooke Bingham, and that by 2020,  it’s expected that 80 percent of the web traffic will be video. She also noted current trends such as live streaming video, virtual reality videos, mobile optimized content — content available and usable to visitors across all devices

A trend that many companies are latching on to is using influencers to help promote a brand or product, said Nina Waste, Top Hand Media’s social media director. An influencer is an individual or group that has the power to affect purchase decisions through social media and traditional media because of their fame, authority, knowledge, position and real or perceived power. “It’s definitely opened up the market to people who are not celebrities,” Waste said. “There are influencers who have obtained contracts from companies just because they have a following on Instagram. Companies want to reach out to them because they have this influence over all of their followers and might be able to generate business for the company.” Targeting your audience At Catalyst Marketing, a full-service

marketing agency in Fresno, Director of Client Services Josh Williams says that while having an online social media presence is vital for a business, it cannot be the only means of advertising. “You can’t just live on social media. If your entire marketing budget is just going to social media, you’re not going to see the return as if you had layers. We really feel social media is a support mechanism to other major mediums — TV, radio and print.” For effective marketing, companies have to hone in their advertising to a demographic that is most likely to engage with their content, Williams stressed. Older generations are more likely to use Facebook, while younger customers are more likely to be using Twitter, Instagram and Snapchat, and depending on the business, marketers have to be conscious of which platform might engage more users. Facebook has made it easier to collect information on its users and it allows marketers to better target their demographic audience and not spend advertising money on people who might not be able to re-

late to an ad’s message, Williams said. However, Williams said that after the recent scrutiny that Facebook has faced over data collection and its influence over political elections, they have changed their algorithm and it has made it a lot more difficult for advertisers to reach users without spending money to advertise. “They’ve [Facebook] kind of shifted their newsfeeds to more personal interactions, friends and family, and you’ll see less from advertisers, so that’s why its really turned, now more than ever, into a payto-play platform,” Williams said. “Even if you’re organically putting your content out there, and not spending money behind it, chances of somebody seeing that is less likely now.” According to Williams and latest marketing reports he’s read, less than 10 percent of a company’s social media followers will see their organic content. Armed | from 1 and getting people who can pass the qualifications is difficult in the Central Valley. While in the Bay Area or Southern California, armed guards may be making $18-20 an hour, Brandon Waters, president and owner of FAST Fresno doesn’t see the market in the Central Valley supporting those wages. What this means is that a lot of the candidates that FAST might be looking for aren’t incentivized enough to get into the business. “The industry wants armed guards, but it’s difficult to find people who do that,” said Lawrence Garcia, president and CEO of AmeriGuard Security. Even before buying their weapon, applicants can expect to spend a good $400 just to start the process, and

many companies require guards to purchase their own guns and ammunition. On top of the cost, a lot of people trying to get into the industry have been arrested for driving under the influence. While they may be able to do walking patrols, it keeps candidates from even getting into vehicles. “DUI, bad credit, it’s hard to get people to even hold a firearm,” Garcia said. Companies want to do their due diligence in order to maintain their image, which is important in a business that requires respect in order to operate. “The problem in the industry is untucked, ungroomed officers. Those are the people that give our industry a bad view,” said Garcia. On top of DUIs and outward appearance, legislation in California has made marijuana legal, but candi-

dates don’t understand that the federal qualifications still require a drug test free from pot in order to be able to carry a gun on patrol. There are a variety of reasons that wages are being kept down in the industry. Both Waters and Garcia, see a lot of fly-by-night security companies coming into the business without being fully licensed or insured and hiring anyone qualified to handle a firearm. If an incident should occur with a guard, companies have insurance to back up things like property damage or liability claims. “Chances are that nothing goes wrong, but until that opportunity shows itself — a fight, a gun involved, anything that causes litigation to come that way, that company is not going to be forthcoming with information,” said Garcia. While California did recently add a psychological profile to be able to

carry firearms on top of the background checks and Live Scan from the Department of Justice, Waters doesn’t think the requirements are tough enough. “I’ve interviewed a lot of candidates who may be qualified, but I wouldn’t trust them around a gun,” Waters said. By hiring people who only meet the minimum standards, wages are kept low and good people don’t see getting into the business as being worthwhile. For business owners looking for added security there are resources available. Though social media has changed the nature of marketing, and made it more accessible, businesses and brands should still consider leaving the work up to professionals, Matson of RPM PR says. “Public relations and social media are ever-changing industries and ones that very much pride themselves on strategy, relationships and staying relevant,” Matson said. “As a business owner, don’t be afraid to outsource your PR or branding efforts to those that work in the industry. R E TA I L will allow Granite Park to host up to 90 soccer games a week, the release continues. Originally opened in 2002, the complex closed in 2006 after it was unable to generate enough money to pay its debts, according to Mark Standriff, director of communications for the city of Fresno. “The expected growth of the entertainment venues around the stadium never really materialized,” Standriff said. “It was evident fairly quickly that the business model wasn’t going to pencil out.” Even after it closed, the city still was paying $104,000 a year to keep the facility from falling into blight, Standriff continued. An investment of more than $2 million from Terance Frazier, CEO of the Central Valley Community Sports Foundation, and his company, TFS Investments, allowed revitalization to begin in 2015, along with money from Central Valley New Market Tax Credits, LLC. The city entered into a 25-year lease and service agreement with the foundation to pay $150,000 a year for programming, staffing and maintenance, according to Standriff. The grand opening was held in 2017 and since then, the Sports Complex has hosted more than 500,000 visitors to the park.

Mr. Pickles Fresno-bound In the Villaggio Shopping Center, across from River Park, Fresno’s newest eatery is coming—Mr. Pickles Sandwich Shop. Currently under construction, the Bay Area export will be sandwiched between Antonio’s Mexican Restaurant and Pismo’s Coastal Grill and is expected to be open by mid-to-late September, according to franchisee Ray Meyers. While the deli will boast staples like pastrami, roast beef and turkey, what really makes Mr. Pickles stand out is the bread. The bread is brought in from the famous Boudin Bakery out of San Francisco, known for its sourdough starter its had since 1849, according to the website. Besides the sourdough, Mr. Pickles will have a wheat bread, a sweet bread and Meyers’ personal favorite, Dutch Crunch, which has a crunchy exterior and a soft interior. Five ounces of meat go into every sandwich and sandwiches come with mayo, mustard, pepperoncinis, tomatoes and greens. Their signature sandwich is made of chicken strips, Monterey jack, bacon, avocado and everything else behind the counter. They have soups in the winter and just like the sandwiches, salads are made to order all year round. Potato and macaroni salads can also be ordered. Inside the store will be a number of TVs to invite customers to do more than get their food and leave, but also have the chance to stay in and watch a ball game. Mr. Pickles will be replacing what was once the Pita Pit, which closed in late 2017. Even though, the company’s departure was less than a year ago, Meyers said getting the spot to fit the Mr. Pickles’ model is going to take “a ton of work.” “The size and the mold fits,” he said,” bit it had to be gutted from floor to ceiling.” Most of the work revolves around getting the shop to look like its other brands across California. Mr. Pickles had done research on the popularity of the brand in the area and saw a significant demand. Myers liked the business model and the energy of the employees at the store. For new markets, like the one in Fresno, the company pools advertising dollars from franchisees and sends it to the new markets, so among other kinds of advertising, Giants fans might also see ads during games about the new store soon, considering the company’s Bay Area fandom.

SPORTS New phase at Granite Park The once troubled sports facility at Cedar Avenue in central Fresno is entering a new phase. The 18-acre Granite Park Sports Complex, which houses baseball and softball fields, is being renovated to transform 10 of those acres into new soccer fields, according to a press release from the Central Valley Community Sports Foundation, which manages the facility. Four full-size and eight smaller fields will be available for community groups and

Located in Centennial Plaza, the 55,000-square-foot office will allow space for approximately 30 employees. Ronald Wathen, the new president and CEO at QK, said the decision to move came when they needed a place that could fit the needs of their company as it continued to grow. “I think it’s really going to give us an edge over our competitors because I there’s going to be a lot of people that really have taken an interest in QK since they found out we were handled out of Clovis,” Wathen said. QK has more than 110 employees on its staff in offices in Visalia, Merced, Bakersfield, Roseville and Porterville. The Clovis Chamber of Commerce also attended the ceremony. “We wish QK continued success and look forward to seeing QK employees and clients around Old Town, enjoying Clovis way of life,” said Greg Newman, executive director of the chamber in a press release. There are also plans later this year for a public open house.

FINANCE Student load debt low locally While student loan debt has been growing for millions of Americans in the last two decades—with totals across the country hitting $1.5 trillion earlier this year— the city of Fresno has the second least student debt in the nation, according to a recent study from the online lending exchange, LendingTree. The study on the places with the most student debt utilized the data from over 8 million MyLendingTree users and aggregated the data to the 100 biggest metropolitan statistical areas by population. With a median balance of $13,808 Fresno ranks 99 out of 100 cities. According to the study, nearly 20 percent of people age 25 and over in Fresno have attained a bachelor’s degree, and 7 percent have graduate or professional degrees. Cause for concern comes with the 23 percent of users in the area who have attended college without attaining a degree, leaving them still liable for the debt. 4.4 percent of debtors owe more than $100,000. McAllen, Texas is the city with the least student debt with a median balance of $13,017, the main reason being that few people in the city attend college. Bakersfield is ranked at 97 with a median balance of $14,656. The city with the highest student debt is Washington D.C. with a median balance of $22,803.

In the weeds Farm Bill could invigorate hemp industry David Castellon – STAFF WRITER For decades, “hemp” has been one of the bad four-letter words among many farmers and government officials because it’s a notso-distant cousin to marijuana. But the plant has its advocates, who note that you can’t smoke it and get high off it, and it has a vastly longer list of possible uses from being used to make food items to being compressed to make skateboards and other hard items to being converted into biofuel. Those advocates got extremely excited last week when the U.S. Senate passed its version of a federal Farm Bill with a provision that would fully legalize the growing of hemp in the U.S. Not that hemp is illegal to grow now. It’s just not fully legal, as the 2014 Farm Bill included a provision allowing the growing of hemp only if each grower is doing so for research — which can be scientific or market research — affiliated with a university or other research institution. If the hemp provision in the Senate’s bill makes the final cut when members of the Senate and House meet in the coming weeks to merge elements of their respective farm bills, and if the president signs it, the requirement to grow hemp for research no longer would apply. “It will allow you to grow hemp the same way you grow corn or rye or wheat or sweet potatoes or any other crops,” said Bruce Perlowin, CEO of Hemp, Inc., which operates the largest hemp-manufacturing plant in the world in Spring Hope, North Carolina. He said the change in the Farm Bill “would open the door to make America the No. 1 hemp-producing country in the world.” The Central Valley has the potential to be a cornerstone of this new industry, said Michael Green, former president of the Fresno Cannabis Association — a long-time advocate for the legalization of medicinal and recreational marijuana, as well as for hemp cultivation. “That’s one of the nice things about hemp. It’s ideally suited for the Central Valley. It grows well in hot weather, it can grow without a lot of water, it can handle saline soils and some other soil conditions that other types of plants can’t,” which makes it ideal for farms suffering from water shortages, including those on the west

side of Fresno County, as well as lands with marginal soil, said Green, who now runs his own business advising entrepreneurs on how to start medicinal and recreational cannabis businesses in California. “It can actually help remediate some substandard soil conditions because it actually encourages uptake of minerals and salts that make those [soils] sub prime. “I understand the drama about cannabis [cultivation here], but when we’re talking about hemp farming it’s got to be in Fresno County and Madera and Tulare and Kings counties,” Green said. While he couldn’t speak about the industry’s potential in the Valley, Perlowin, who started the first publicly-traded — or “pot stock” — company, Medical Marijuana, Inc., 11 years ago and later sold it, said he sees hemp’s enormous potential in the U.S., and he’s not alone. He said he started Hemp, Inc., which also is publicly traded, because he saw hemp as having greater potential than marijuana, as “hemp has way greater potential incomewise and business-wise. As an example, hemp plastics have more potential to make money than medical marijuana and recreational marijuana put together. “Farmers are drooling to get into the hemp business, and the only ones who are reticent are the ones who don’t know how much money you can make. You can make more money on hemp than any other product grown in the United States, including marijuana.” On land owned by Hemp, Inc. and other farmers in eight states — which can sell the hemp they produce under their research agreements — the company plans to grow more than 25,000 acres of hemp this year, more than 45 times the amount available to the company last year and an amount greater than all the other hemp grown in the U.S., Perlowin said. And the potential isn’t just in growing hemp, as hemp experts note that the plant has about 25,000 uses, so all kinds of manufacturing businesses could spring up if wider cultivation occurs. For example, Green said, “In Europe, they use it for insulation in car door panels, because it’s strong and doesn’t decay,” and if Faraday Future succeeds with its plans to build its first electric car plant in Hanford, a business making similar hemp products for those cars could be started here. “The range of products is so broad and

wide, it probably covers the entire spectrum of industry,” Perlowin said. And there also is potential for industries making tools, vehicles, pesticides and other goods for hemp farming, which used to occur in the U.S. decades ago, but farmers largely would have to learn hemp farming anew if the door for legalization were to swing wide open. Hemp was a legal crop in the U.S. until the post-World War II era, but the industry suffered in part because of the plant’s close kinship and similar look to marijuana. So much so, that in 1970 the federal government grouped it with all the other cannabis varieties, designating them illegal, Schedule I drugs under the Controlled Substances Act, despite hemp having less than .3 percent tetrahydrocannabinol (THC), the psychoactive substance in marijuana that gets people high. But the amount in hemp isn’t enough to get anyone high, Green noted. Still, it’s believed that competitors to hemp-based textiles, particularly among the post-WWII-era makers of synthetic fabrics, found demonizing hemp by playing up its connection to cannabis to the public and lawmakers as an easy way to eliminate some of its completion, said Green, noting that it worked. Add to that, many in law enforcement were willing to speak against hemp, despite it not having psychoactive qualities, Green said. “And as far as law enforcement, in particular, their typical objection is that they don’t want to see a bunch of hemp fields out there, because they can’t tell the difference easily — from the air, anyway.” Back before and soon after the war, Hemp largely was used to make into ship sails, ropes and a variety of textiles. While hemp was illegal to grow here, other counties have continued using the plant and developed thousands of new uses for it. Perlowin said his own company makes goods that include hemp and kenaf — another cannabis cousin — ground into a powder and used to seal fissures along the paths of oil well drill holes — a natural alternative to chemical-based products. Another division of Hemp, Inc. extracts oil from hemp seeds to produce cannabidiol — or “CBD” — a compound that also can be extracted from marijuana that reportedly relieves inflammation, pain, anxiety, psychosis, seizures, spasms and other

conditions without generating feelings of lethargy or unease or making people feel “stoned.” The House Farm Bill gave no mention of hemp, but experts following the hemp industry note that at least nothing was included by the House members to water down or eliminate the rules allowing hemp farming under research partnerships from the 2014 bill. As for the hemp provision in the Senate Farm Bill, that’s being largely credited to Senate Majority Leader Mitch McConnell, R-Ky., as a way to replace agricultural jobs in tobacco, which is finding decreasing favor among the American public and facing growing competition by electronic cigarettes. The Senate bill passed easily, while passage of the house bill was more hardfought, and it’s not clear if the Senate revision to the federal hemp regulations might be a point of contention in both houses developing and passing the final Farm Bill, nor is it clear if the president might weigh in for or against it. And even if all that happens, the Senate provisions as they stand now give states the right to decide individually if they want to allow unobstructed hemp growing in their jurisdictions, and it’s not clear whether farmers in California might push back on allowing hemp farms here. Officials for the farm bureaus in Fresno, Tulare and Madera counties didn’t respond immediately to interview requests, and Dusty Ference, executive director of the Kings County Farm Bureau, said his organization hadn’t decided whether to support hemp growing in the Valley. “We don’t have any issues with it if it does become legal,” but before showing any support for hemp or challenging it, Ference said his farm bureau is waiting for the California Department of Food and Agriculture to respond to a request to investigate whether hemp could be viable here and what its effects could be on other crops here. “We don’t know if it needs a lot of water, pesticide applications, and if it may affect other crops.” David Castellon | Reporter can be reached at: 490-3464 or e-mail [email protected]

HINDS HOSPICE   Tell us about your career to your current position. My grandmother primarily raised me and, unfortunately, in 1999 she experienced unexpected complications following a surgery. Eventually, a ventilator was all that was keeping her alive. I struggled for nine days figuring out what the end-of-life choices were. I worked for Kaiser at the time, and I considered myself well informed about the health care system. That experience made me realize that I wasn’t well informed. That difficult experience made me wonder, “If I struggled that much with my grandmother’s passing, what about people who have no understanding of the health care system at all?” It sparked a need in me to help others experiencing an end-of-life loss or terminal illness. I spent the next 17 years in executive positions, trying to make a difference for patients and their families. I’m very passionate about hospice and palliative care. Every day our challenge is to find better ways to meet the needs of the communities we serve, and improve the ways we help our health care partners do what they need to do to serve their patients and our community. Prior to accepting the position at Hinds Hospice, I was the CEO of the Visiting Nurse and Hospice Home in Fort Wayne, Indiana. During my time there, I judiciously managed growth to meet the needs of the community and improve the quality of care. Prior to that, I was CEO of Hospice of Washington County in Hagerstown, Maryland, where we received the “Hospice Honors” award for outstanding family satisfaction scores, “Non Profit of the Year” award, and “Outstanding Community Partner” award from the Washington County, Maryland, Department of Social Services. I also held positions as an executive director and regional executive director at multiple hospice organizations.

What convinced you to try for this position in Fresno? I am amazed by Nancy Hinds’ story and how this organization was started. Nancy is well known here in the Valley, but she is also recognized nationally and internationally for her work in hospice care. She is the epitome of going above-and-beyond. When I looked deeper into Hinds Hospice, it was obvious that Amy Tobin and the board of directors have done a fantastic job taking the organization to the next level. Hinds Hospice seemed like an exceptional fit, and an ideal opportunity for me to impact the organization in a positive way. This is a remarkable organization, with an impeccable reputation. Amy is providing valuable support during the CEO transition. It is humbling to lead such a noble organization. The staff is so incredibly dedicated. We are all stewards of the Hinds Hospice mission, and I take that responsibility very seriously, as Amy did before me.

WHAT WE DO: Hinds Hospice is a trusted nonprofit organization. We provide end-of-life care for patients and grief support for families and the community. We serve Fresno, Madera and Merced counties. Hinds Hospice was founded in 1981 when Nancy Hinds began caring for the terminally ill in her home. Currently, we serve approximately 250 patients each day. Each year our Center for Grief & Healing supports hundreds of people who have experienced the loss of a loved one. With generous community support, we are able to offer many of our services at little or no cost. We never turn a patient away for lack of ability to pay.

What do you think of the community so far? I’ve met so many nice people here in the Central Valley. Everyone has been very welcoming. I’m excited to get to know the community better, and to meet its leaders. I’m also eager to get involved in civic activities and to volunteer in activities that make a difference.

What are the priorities for Hinds Hospice as you take the helm? First and foremost is to continue to impact as many lives as possible in the communities we serve. As our population grows and ages, the need for quality hospice care is expanding. We will find ways to meet that need, while continuing to provide the incredible care we are known for. Secondly, there is a great deal of health care reform going on throughout the country. We will strive to better assimilate ourselves into health care organizations in the Valley. These partnerships not only help positively impact the families we serve, but our presence will help our partners provide better patient care. These partnerships will enhance care options in the communities we serve.

What is something people might not know about hospice care that they should? Hospice is not a place or a facility. Hospice is a philosophy and a movement. Hospice provides physical, emotional and spiritual support — body, mind and spirit. The objective of hospice is to maximize quality of life. The care may be provided in a private house, an apartment, or an eldercare facility. Hospice is available wherever the patient calls home, or in our Hospice Home. We are teachers, and we support our patients and caregivers throughout the end of life journey. Our care team is specially trained to give caregivers the tools they need to help their loved ones. We go along on the journey with patients and loved ones.

Hospice is not just for the last few days of life. In hospice care, what we hear often from families is that they wish they had known about, and started, hospice care sooner. In most cases, we can begin helping as soon as the patient is no longer seeking curative care. The sooner a patient is on hospice support, the sooner we can help them manage their goals. We don’t just care for patients, we care for families and caregivers. We offer enhanced grief support for family and caregivers, for a year or more, to help them process their grief and adjust to changes in their lives.

What was your very first job and what did you learn from it? I served in the United States military as an infantry soldier, and then transitioned to logistics. The Army taught me to trust in teamwork, and to value the power of a team. On the battlefield, you depend on your buddy. You are putting your life in his or her hands, and he or she is trusting you with their live as well. The Army teaches you how the team is always stronger than the individual. When you put on that green uniform, you become more than yourself. There’s not ethnicity, culture or religion, you are supporting each other and it’s just a team that wants to succeed.

What do you like to do in your spare time? I love outdoor activities so I’m looking forward to all the outdoor options available in the Valley. I like hiking and running, and I’m doing CrossFit. I also love to travel when I can, and of course I like spending time with my family. I’m looking forward to volunteering with organizations that are passionate about serving the most vulnerable. The Central Valley is my new home, and I want to make a difference.

John Abbate, owner-operator of a large number of McDonald’s restaurants throughout the Fresno market, has built a successful career investing in the iconic golden arches and in real estate. Janus decision gives California taxpayers a fighting chance Early in World War II, Nazi Germany pounded Great Britain from the air for months in what was known as “The Battle of Britain.” It was a certainty that the bombing campaign was the precursor to a German invasion. When Germany failed to make England succumb, the bombing campaign ceased. At that point, British Jon Coupal Prime Minister Winston Churchill said, “Now this is not the end. It is not even the beginning of the end. But it is, perhaps, the end of the beginning.” This week’s Supreme Court ruling in Janus v. AFSCME is one of the most important decisions in decades. Simply put, the high court ruled that public employees cannot be forced to pay so-called “agency fees” to a union as a condition of employment, because compelled support for the union violates the employees’ right of freedom of speech under the First Amendment. The ruling, in effect, renders California a right-to-work state for public-sector employees. Because public-sector unions, including the California Teach-

ers Association, Service Employees International Union and dozens of others have used compelled dues to dominate California’s political environment with vast amounts of campaign money, the decision will, over time, have a big impact in the state. But we need to stress “over time” because the changes won’t be immediate. So, to paraphrase Winston Churchill, this may not be the beginning of the end for unfair political advantage, but it is the end of the beginning. The impact will be two-fold. First, it is well known that substantial numbers of public employees bristle at having to support a union that advances political positions or supports political candidates they do not like. This form of compelled speech has been properly identified as a violation of the First Amendment since the nation’s founding. As Thomas Jefferson noted, “To compel a man to furnish contributions of money for the propagation of opinions which he disbelieves and abhors is sinful and tyrannical.” Second, as in all things political, there’s the issue of money. Public-sector labor in California is the 800-pound gorilla. Government employee unions influence all levels of government to their advantage, first by donating heavily to get their favored politicians elect-

ed, then by negotiating contracts with those same politicians to win salaries and benefits that taxpayers in the private sector can only dream of. The union treasuries are filled by extracting money from paychecks. For union members, the money withheld is called union dues. For employees who choose not to belong to the union, a similar amount is withheld from their paychecks, but it’s called a “fair share” or “agency fee.” For decades, this was justified as necessary to prevent “free riders” from having the benefit of collective bargaining without paying for it. But in the Janus case, an employee of the state of Illinois disputed that it was a benefit to impose higher and higher costs on taxpayers. When politicians sit across the table from union leaders during contract negotiations, taxpayers aren’t at the table, they’re on the menu. Thanks to the steady stream of money from compelled dues and agency fees, union leaders have had vast financial resources at their disposal. This made them kingmakers in political battles, electing politicians who are indebted to them for their careers and reliant on them for re-election. In other states where public-sector unions have lost their ability to forcibly

Health Insurance: What to expect in the second half of 2018 The National Federation of Independent Businesses has long supported affordable, flexible, and predictable health insurance for small business owners. We opposed the Affordable Care Act, and we continue to push for reform that brings small businesses cost relief. The Tax Cuts and Jobs Act, which was signed into law in December 2017, gave meaningful tax cuts to small business owners. This law also included the eventual repeal of the individual mandate penalties, a provision in the Affordable Care Act that required individuals to purchase health insurance or pay a penalty. There are additional changes coming down the pike in 2018 that small business owners must be aware of. ”NFIB continues to advocate for affordable, flexible, and predictable health insurance options for small business owners and employees,” says Kevin Kuhlman, NFIB’s director of legislative affairs. “While comprehensive health care reform efforts stalled legislatively, NFIB achieved considerable legislative victories regarding health care tax relief. These victories will lessen premium increases and provide relief from compliance burdens. At the same time, NFIB continues to work with the administration to increase access to affordable health insurance options.” Here’s what you need to know about changes in health insurance rules for 2018 and beyond.  Legislative Changes Although the individual mandate penalties were repealed with the passage of the Tax Cuts and Jobs Act in December, they will continue to be enforced through 2018. Three Affordable Care Act taxes have been suspended or delayed. The annual fee on certain health insurance providers, which is in effect for calendar year 2018, has been suspended for 2019. It is scheduled to return Jan. 1, 2020. The Cadillac tax is a 40 percent excise tax

levied on high-cost employer health insurance plans that has never been implemented due to a previous delay. It is currently delayed until Jan. 1, 2022. The medical device tax is a 2.3 percent excise tax that is levied on the sale of medical devices. It will be delayed until Jan. 1, 2020. Regulatory Updates President Trump signed an executive order on Oct. 12, 2017, requiring agencies to issue regulations to expand access to association health plans, short-term limited duration plans and Health Reimbursement Arrangements. The final regulations expanding AHPs and short-term limited duration health insurance are expected this summer. The proposed regulation expanding HRAs is also expected this year. The AHP regulation proposes to permit small business owners, their employees, sole-proprietors and other self-employed individuals to band together as a single large group to purchase insurance. As proposed, the regulation would allow broad-based business associations to offer metro- or state-based plans and industry-specific groups to offer national plans. The employer mandate—an ACA requirement for employers with 50 or more full-time or fulltime equivalent employees to offer affordable and adequate health insurance to their fulltime workers or face fines—will continue to be enforced. Enforcement for 2015 is ongoing, and enforcement for 2016 could begin later this year. The fines for 2018 increase to $2,320 per employee for non-offering employers and $3,480 per employee for offering employers whose employees are not offered affordable coverage. The Janus decision will empower workers to make their own decisions when it comes to public-sector union membership. If progressives were really worried about threats to hardworking families, they’d be happy that families now have the option to keep more of their own money.
