SUBJECT: Award of Construction Contract to R&R Pacific Construction for the construction of Oakley Community Dog Park Phase 2 Landscaping Project – CIP 197

Background and Analysis The City’s adopted FY 2017/18 Capital Improvement Program (CIP) Budget designates funding for various infrastructure repair and replacement projects. This is consistent with the City’s goals to improve the quality of the City’s public infrastructure and to enhance the quality of life for our residents. Phase 1 of the construction for Capital Improvement Project No. 197 for the Oakley Community Dog Park began in August for the grading, paving the parking lot, storm drain improvements, utility connections, and restroom installation. We anticipate to complete construction of Phase 1 by January 2018. Phase 2 of the project is mainly the landscaping component which includes finish grading, concrete walkways, planting, irrigation, and fence installation. The original bid package for Phase 2 was originally advertised on September 18, 2017. The City opened five bids on October 12, 2017 with the lowest bid exceeding the engineer’s estimate by over 75%. On October 24, 2017, City Council approved to reject all bids and authorized staff to re-bid the project and revise the design to reduce the cost for the project. Staff re-packaged the plans and specifications to omit some elements of the park to fit the budget. On November 2, 2017, the City re-advertised Phase 2 for the landscape improvements for the Dog Park Project and received eight proposals at the bid opening on November 30, 2017. The lowest responsible bidder is R&R Pacific Construction. Their bid was very competitive and in tune with the project budget. Fiscal Impact The FY 2017/18 CIP Budget for the Oakley Community Dog Park Project is comprised of: $413,515 from the Land and Water Conservation Fund (State Grant), and $764,485 from the Park Impact Fee Fund. This project does not use City General Funds. There

is sufficient funds from the above referenced sources for the construction of this project. Staff Recommendation Staff recommends that the City Council adopt the resolution approving staff to process a construction agreement with R&R Pacific Construction for an amount not to exceed $480,796.95, and authorizing the City Manager to execute said agreement. Additionally, due to variables associated with construction projects and to address unforeseen circumstances during the course of construction; staff further recommends that the City Council authorize staff to execute future change orders to the construction contract as necessary, in an amount not to exceed $40,000 for work beyond what is defined in the project proposal.
