SUMMARY City Council, at its meeting of July 12, 13 and 14, 2011, directed Transportation Services to proceed with the detailed design and consultation process for separated bicycle lanes on Sherbourne Street with a view to implementing them in 2012. The design and consultation process has resulted in a raised cycle track design from Front Street East to Gerrard Street East and a street-level cycle track design from Gerrard Street East to just south of Bloor Street East. The operating requirements for cycle tracks are different than for traditional painted bicycle lanes and, as a result, a new definition and schedule for cycle tracks needs to be added in the Municipal Code Chapter 886 (Footpaths, Pedestrian Ways, Bicycle Paths and Bicycle Lanes). This report also seeks Council authority to amend the appropriate City by-laws required for the new cycle track design on Sherbourne Street. The new design involves the removal of all on-street parking on Sherbourne Street between Queen Street East and Bloor Street East; introduction of six lay-bys to accommodate Wheel-Trans, pick-up/drop-off activity and a taxi stand; and peak-hour left turn restrictions at the King Street East and Shuter Street intersections. To mitigate the impact of the removal of parking on Sherbourne Street, 20 new parking spaces are being added to east-west streets intersecting Sherbourne Street. The construction of the Sherbourne Street cycle tracks, from King Street East to Bloor Street East, began in August 2012 and will be completed in two phases. The section from Gerrard Street East to Bloor Street East is scheduled to be completed by mid-October and the section from King Street East to Gerrard Street East by mid-November 2012.

Due to the construction of a new building at 101 Sherbourne Street, the road resurfacing between Front Street East and King Street East cannot be completed in 2012. Therefore, the cycle tracks in this section have been deferred to 2013. Cycle track construction between Lake Shore Boulevard East and Front Street East is scheduled for 2014, to be coordinated with the reconstruction of Sherbourne Street in this section.
RECOMMENDATIONS The Acting General Manager, Transportation Services recommends that: 1. City Council authorize and direct the appropriate City officials to: A. amend City of Toronto Municipal Code Chapter 886 (Footpaths, Pedestrian Ways, Bicycle Paths and Bicycle Lanes) to introduce a new definition and a new schedule for "Cycle Tracks," to regulate permitted and prohibited usage of cycle tracks and to incorporate regulations for cyclists in a cycle track approaching a TTC bus which is stopped for the purpose of taking on or discharging passengers, all as generally described in Appendix 2 of the report dated August 20, 2012 from the Acting General Manager, Transportation Services; B. establish a fixed fine amount of $150.00 for any new parking, standing, and stopping offences created by Recommendation 1A above; and C. make application to the Senior Regional Justice of the Ontario Court of Justice to establish the set fines and that the amounts requested for new parking/standing/ stopping offences created as a result of Recommendation 1A be equal to the fixed fine amounts as outlined in Recommendation 1B above. 2.
City Council approve amendments to City of Toronto Municipal Code Chapter 886 (Footpaths, Pedestrian Ways, Bicycle Paths and Bicycle Lanes) to delete Sherbourne Street, from Front Street East to 70 metres south of Bloor Street East, from Schedule D to Chapter 886, Designated Bicycle Lanes, and to add the same section of Sherbourne Street to the new Cycle Tracks Schedule, as detailed in Appendix 3 of the report dated August 20, 2012 from the Acting General Manager, Transportation Services.
3. City Council approve the highway alterations to widen the travelled portion of the road at the following locations to allow for the installation of lay-bys to accommodate Wheel-Trans vehicles, car and taxi passenger pick-up/drop-off, and a taxi stand, as identified in Appendices 4A to 4E of the report dated August 20, 2012 from the Acting General Manager, Transportation Services: A. Sherbourne Street, east side, from a point 12.0 metres north of Isabella Street to a point 35.0 metres further north; B. Sherbourne Street, west side, from a point 168.2 metres north of Carlton Street to a point 31.0 metres further north; Sherbourne Street, east side, from a point 118.0 metres north of Carlton Street to a point 35.0 metres further north to provide a designated Taxi stand, and

City Council approve the amendments to the parking regulations to extend the permit parking limit and to add pay-and-display parking spaces on Earl Street, between Huntley Street and Sherbourne Street, and to add pay-and-display parking spaces on Adelaide Street East, between Sherbourne Street and Berkeley Street, all as detailed in Appendix 5 of the report dated August 20, 2012 from the Acting General Manager, Transportation Services. 6. City Council enact northbound and southbound left turn prohibitions on Sherbourne Street at both King Street East and Shuter Street, from 7:00 a.m. to 9:00 a.m. and from 4:00 p.m. to 6:00 p.m., Monday to Friday, as detailed in Appendix 5 of the report dated August 20, 2012 from the Acting General Manager, Transportation Services. 7. City Council enact "Right Turn on Red" prohibitions at the following locations and in the directions indicated: A. eastbound and westbound from Shuter Street onto Sherbourne Street; B. eastbound and westbound from Gerrard Street East onto Sherbourne Street; C. eastbound and westbound from Wellesley Street East onto Sherbourne Street. 8. City Council authorize and direct the appropriate City officials to take the necessary action to give effect to Recommendations 1 to 7, including the introduction of all necessary Bills. Financial Impact While there are no financial impacts resulting from the adoption of the recommendations of this report, the cost to construct the Sherbourne Street cycle tracks from King Street East to south of Bloor Street East, is approximately $2.4 million (funds are contained in the Transportation Services 2012 Approved Capital Budget in Cycling Infrastructure Account CTP812-05). The removal of the pay-and-display on-street parking spaces on Sherbourne Street between Queen Street East and Bloor Street East, combined with the addition of 20 new pay-and-display parking spaces on streets adjacent to Sherbourne

Street, will result in an estimated net reduction in the Toronto Parking Authority's revenue of $136,000 annually. The Deputy City Manager and Chief Financial Officer has reviewed this report and agrees with the financial impact information.
DECISION HISTORY The Sherbourne Street bicycle lanes were installed in 1996. City Council, at its meeting of July 12, 13 and 14, 2011, adopted the Transportation Services staff report entitled, "Bikeway Network – 2011 Update," with amendments. As a result, Council directed the Acting General Manager, Transportation Services to proceed with the detailed design and consultation process for developing separated bicycle lanes on Sherbourne Street with the goal of implementing them in 2012, in conjunction with the planned capital work on Sherbourne Street.
ISSUE BACKGROUND City Council has directed the Transportation Services Division to proceed with the consultation, design and implementation of a downtown network of separated bicycle lanes, approximately 14 km in length. The Sherbourne Street cycle tracks project is the first of these upgraded bikeway designs to be implemented. The cycle track design developed for Sherbourne Street requires several changes to parking and traffic regulations along Sherbourne Street. This report generally describes the By-law changes required for the Sherbourne Street cycle tracks.
COMMENTS 1.
Existing Conditions
Sherbourne Street, from Front Street East to Bloor Street East, is a two-way minor arterial roadway, which operates with one traffic lane in each direction. Left turn lanes are provided at signalized intersections. The TTC operates the 75-Sherbourne bus route northbound and southbound on Sherbourne Street. The road width varies from 12.2 to 14.3 metres; however, the majority of the roadway is 12.2 metres wide. The 24-hour traffic volume ranges from 9,300 to 14,800 vehicles. Pay-and-display parking is provided on one side of the street between Queen Street East and Bloor Street East. Bicycle lanes, located adjacent to the curb on one side of the street and adjacent to curbside parking on the other side, were installed on Sherbourne Street in 1996. The current traffic lanes, parking spaces and bicycle lanes all have minimum width dimensions. The average 24-hour weekday bicycle volume is 1,280 bicycles.

New Cycle Track Design
Most of Sherbourne Street is only 12.2 metres wide, which is too narrow to provide a continuous barrier curb between the bicycle lanes and traffic lanes and, at the same time, maintain left turn lanes at the major intersections and parking on one side. The traffic analysis determined that retaining most of the left turn lanes was essential to maintaining existing transit service levels and a satisfactory traffic flow along Sherbourne Street. As a result, left turn lanes are being removed at only two intersections – at King Street East and at Shuter Street – which will have minimal impact on TTC and traffic operations. To minimize delays at these two intersections, left turns will be restricted during the morning and afternoon peak periods. Left turn lanes will be maintained and left turns permitted at all other signalized intersections along Sherbourne Street. Different design options for separated bicycle lanes were evaluated through the functional design study and community consultation process. The preferred design option, unidirectional cycle tracks, achieved the best balance between providing safe conditions for cyclists and maintaining transit service levels and general traffic capacity. The Urban Bikeway Design Guide, published by the National Association of City Transportation Officials, defines cycle tracks as “...an exclusive bicycle facility that combines the user experience of a separated path with the on-street infrastructure of a conventional bicycle lane. A cycle track is physically separated from motor traffic and distinct from the sidewalk. Cycle tracks have different forms but all share common elements; they provide space that is intended to be exclusively or primarily used for bicycles, and are separated from motor vehicle travel lanes, parking lanes, and sidewalks. In situations where on-street parking is allowed cycle tracks are located to the curb-side of the parking (in contrast to bicycle lanes).” The section south of Gerrard Street East is scheduled to be resurfaced while no capital work is planned north of Gerrard Street East; this has presented an opportunity to develop different treatments for each section to achieve the best possible design for the whole corridor. South of Gerrard Street East, the scope of work for the resurfacing project was expanded to include the construction of a raised cycle track. This design also required significant additional capital work to reconstruct curbs, boulevards and catch basins. The raised cycle track is at the same level as the sidewalk/boulevard and has a rolled curb at the edge adjacent to the traffic lane. The redesigned boulevard includes a new tactile paving stone treatment so that the visually impaired will be able to detect the edge between the boulevard and the raised cycle track. North of Gerrard Street East, a raised mountable curb will be retrofitted in the roadway to create a street-level cycle track separated from the adjacent traffic lanes. The additional space required for the raised curb prevents the installation of a continuous street-level cycle track at the intersections where the left turn lanes must be retained. At those locations where separation cannot be maintained all the way to the intersection, the entire bicycle lane will be coloured with a high-visibility green surface treatment to accentuate the bicycle lane.

The bus stop locations feature a third design, a modified raised cycle track with a full 150mm high barrier curb, to maintain accessibility for TTC patrons. In this design, buses will stop outside the raised cycle track to service the stop. TTC patrons will cross the raised cycle track to access or egress the bus, similar to the operation of the recently constructed TTC streetcar stops on Roncesvalles Avenue. The cycle track design will make it more difficult for cyclists to make a vehicular-style left turn at the east-west streets crossing Sherbourne Street. To facilitate these turns, twostage left turn bike boxes, coloured with a high-visibility green surface material will be installed at all of the interconnecting east-west bicycle lanes on Shuter Street, Gerrard Street East and Wellesley Street East. Bike boxes are designated spaces at intersections for cyclists to wait in front of motor vehicles at a red light, and to proceed first when the light turns green. The Transportation Association of Canada's "Guidelines for the Design and Application of Bikeway Pavement Markings" (August 2007) recommends prohibiting right turns on red where bike boxes are installed, which is consistent with the current bike box installations in Toronto. Accordingly, "No Right Turn on Red" regulations are proposed for east and westbound traffic on Shuter Street, Gerrard Street East and Wellesley Street East at Sherbourne Street to ensure the safe operation of the bike boxes. Appendices 1A and 1B, appended to this report, illustrate the sections of Sherbourne Street where the raised and street-level cycle tracks will be implemented and the typical cross-section for each design treatment. 3.
Public Consultation
City staff conducted a comprehensive consultation process to encourage community input into the project and to develop a design that balanced the needs of the community while achieving Council's objective to significantly upgrade the existing bicycle lanes. In November 2011 more than 700 notices were mailed to all residents and businesses on Sherbourne Street inviting input from those most closely affected by future changes to Sherbourne Street. A public Open House was held on January 26, 2012 to present the draft designs and receive feedback from the broader community. Approximately 28,000 meeting notices were delivered to residents and businesses in a larger area bounded by Queens Quay, Jarvis Street, South Drive and Parliament Street. Approximately 130 people attended the Open House and the feedback was generally supportive of the design. Staff also held several smaller meetings to address the concerns of specific businesses and residents along Sherbourne Street. The community feedback revealed that the loss of on-street parking on Sherbourne Street was not a major concern to most of the residents along the street. Residents were primarily concerned about the accommodation of WheelTrans, taxis, deliveries and passenger pick-up/drop-off activities. In response to the community feedback, several lay-bys were incorporated into the cycle track design to accommodate these activities.

The most frequently expressed concerns raised by cyclists included the provision of adequate separation from traffic while, at the same time, enabling cyclists to enter and exit the cycle track mid-block, if necessary, and improving access for left turns onto the east-west streets. These issues have been addressed to the extent possible through the design of the rolled curb for the raised cycle track south of Gerrard Street East; the raised mountable curb for the street-level cycle track north of Gerrard Street East; and the installation of two-stage left turn bike boxes at all of the interconnecting east-west bicycle lanes. New Cycle Track By-law and Schedule
The operating requirements for cycle tracks are different than the traditional painted bicycle lanes and, as a result, a new definition and schedule for cycle tracks needs to be added to the Municipal Code Chapter 886 (Footpaths, Pedestrian Ways, Bicycle Paths and Bicycle Lanes). For example, with a raised and/or curb-separated cycle track, motorists turning right will not be permitted to enter the cycle track on the approach to the intersection, in contrast to traditional painted bicycle lanes. Taxis are permitted to stop in bicycle lanes while engaged in picking up or dropping off patrons, but will not be permitted to do so in cycle tracks. TTC buses typically pull up to the curb, occupying the bicycle lane, while servicing a bus stop. In the new design buses will stop outside the raised cycle track to service the stop. TTC patrons will cross the raised cycle track to access or egress the bus. Cyclists will be required to stop and yield to transit patrons while a stopped TTC bus is engaged in loading and unloading passengers, similar to the requirement for drivers and cyclists at streetcar stops. The Highway Traffic Act regulates this type of interaction at streetcar stops but does not have a comparable regulation for bus stops. The proposed amendments to the Municipal Code Chapter 886 (Footpaths, Pedestrian Ways, Bicycle Paths and Bicycle Lanes), included in Appendix 2, will set out the requirements for drivers and cyclists with respect to cycle tracks. 5.
Lay-bys to Accommodate Wheel-Trans and Pick-up/Drop-off Activity
The Sherbourne Street cycle track design includes five new lay-bys to address WheelTrans and passenger car pick-up/drop-off along the corridor. These lay-bys will be located next to major generators of Wheel-Trans trips, stores and businesses, and visitors to adjacent residential properties including visitors with disabilities. The lay-bys and the existing on-site Wheel-Trans pick-up/drop-off areas are expected to accommodate approximately 900 to 1,000 Wheel-Trans trips per month and keep the cycle track free of obstructions for 90 percent of the Wheel-Trans trips. These lay-bys will be designated as no standing zones. Wheel-Trans vehicles, car and taxi passenger pick-up/drop-off will be permitted, however, no parking will be allowed. Appendix 5 describes the no standing regulations for these five lay-by locations.

In addition, a new lay-by will be constructed on the east side of Sherbourne Street, north of Carlton Street, to replace the existing taxi stand at this location. The existing taxi stand accommodates up to three taxis; the new lay-by will accommodate two taxis. The design of the lay-bys are illustrated in Appendices 4A to 4E of this report. 6.
Changes to Parking
The uni-directional cycle track design requires more road width than the current painted bicycle lanes. As a result, on-street parking cannot be maintained with the implementation of the new cycle tracks. To assess the feasibility of removing on-street parking, Transportation Services conducted a parking study along the Sherbourne corridor. The parking study analysed parking utilization rates on Sherbourne Street, on adjacent/parallel streets and in all commercial parking lots in the Sherbourne corridor. Staff also investigated opportunities to provide additional on-street parking spaces on the east-west streets crossing Sherbourne Street. Twenty (20) additional parking spaces will be added to Adelaide Street East, Shuter Street, Dundas Street East, Gerrard Street East, Carlton Street and Earl Street, to mitigate the impact of the loss of on-street parking from Sherbourne Street. The parking study indicates that there is sufficient available parking capacity in the Sherbourne corridor to absorb the parking demand displaced from Sherbourne Street. There are 129 pay-and-display parking spaces on Sherbourne Street, between Queen Street East and Bloor Street East. Eleven surveys conducted on Sherbourne Street indicate that 29 to 45 percent of these spaces on Sherbourne Street are occupied at any

given time, representing between 38 and 58 motor vehicles. Three surveys conducted along the two parallel streets, Homewood Avenue and Bleecker Street, indicate there are 176 available parking spaces. With a utilization rate ranging from 65 to 82 percent there are approximately 30 to 60 available spaces at any given time. There are also four commercial parking lots in the corridor with a total of 1,231 parking spaces and a utilization rate of 53 to 64 percent and therefore more than 400 spaces available at any given time. Appendix 5 of this report, describes the changes to traffic and parking regulations for the Sherbourne Street Cycle Tracks project.

ARTICLE I New Definition To Be Added to § 886-1B CYCLE TRACK — The lanes on highways or portions of lanes on highways designated as cycle tracks under § 886-12. Current Article VI (Schedules), Article VII (Offences) and Articles VIII (Transition) will be renumbered to be Article VII (Schedules), Article VIII (Offences) and Article IX (Transition), accordingly, and that Sections 886-12 to 14, inclusive, will be renumbered to Sections 886-17 to 19, inclusive, and that any section reference therein will be amended accordingly.
ADD NEW ARTICLE VI – CYCLE TRACKS § 886-12. Lanes on highways or portions of highways designated for the use of bicycles only. The lanes on highways or portions of highways listed in Schedule E to this chapter are established as cycle tracks. Add New § 886-13. Signs; power to regulate traffic not affected. A.

Add New § 886-14. Bicycle Operation at Transit Stop. Where a person in charge of a bicycle on a cycle track approaches a Toronto Transit Commission bus, which is stationary for the purpose of taking on or discharging passengers, the person on a bicycle shall not pass the bus or street car or approach nearer than 2 metres measured back from the rear or front entrance or exit, as the case may be, of the Toronto Transit Commission bus or street car on the side on which passengers are getting on or off until the passengers have crossed the cycle track.
Add New§ 886-15. Operation and stopping of vehicles restricted. A.
Subject to § 886-16, no person shall operate a vehicle other than a bicycle in any cycle track except for the purpose of: (1) Ingress to or egress from a private lane or driveway adjacent to the cycle track; (2) Loading or unloading of persons with a disability from a Wheel-Trans vehicle, operated by or under contract to Toronto Transit Commission, while actively engaged in doing so;
B.
Subject to § 886-15A(2), no person shall stop a vehicle other than a bicycle in a cycle track.
