State Specific Notifications Situation There is growing employer risk as states increasingly implement employment laws that require unique forms to be distributed, acknowledged by employees, and retained by employers. For example:  New Hire Wage Acknowledgement Forms – Nearly half of all states currently require some sort of new hire wage acknowledgement with several more expected on the horizon  C  ommission Contracts – Several states have implemented mandates for commission contracts, such as New York and California, with more states considering adding this requirement  A nnual Notifications – As deemed necessary by each state, various notifications are required to be provided, acknowledged and retained each year, such as New York Wage Theft Prevention Act, NJ Gender Fairness and New Jersey Conscientious Employee Protection Act These required forms have created additional risk and complexity that increases the cost to employers. Example: New York Wage Theft Prevention Act carries a fine of $50 per week per employee when form is not distributed and an additional fine of $2,050 in individual suits.
