Assumption of Risk: Under Ohio Revised Code #2305.321, it is expressly understood that the rider knowingly and voluntarily assumes any and all risks of harm or injury which are inherently involved in riding, working with, and being around horses. These risks include damage to personal property, illness, bodily injury, trauma or death that may result to the rider from a fall while riding or being in close proximity to horses. This Agreement extends to any harm or injury which the rider may suffer from (1) their use of the property, facilities, equipment, tack and/or any horse on Stable property, and (2) the risks of injury or damage which may be caused by, result from or be incidental to the rider’s engaging in any and all equine or horse related activities while the rider is on Stable premises and property, or participating in any horse show, exhibition or clinic, or under supervision, direction or instruction by the Stable owner, representatives, agents, instructors or employees. This Assumption of Risk is intended and is understood to include, but not limited to each of the following inherent risks of harm: 1. The propensity of any horse to behave in ways that may result in serious injury, death or loss to the rider or persons on or around the horse; 2. The unpredictability or the reaction of any horse to sounds, sudden movement, unfamiliar objects, persons or other animals; 3. Hazards, including but not limited to surface or subsurface conditions; 4. A collision with another horse, another animal, a person or an object; 5. The potential of a person who is engaged in any activity with a horse to act in a negligent manner that may contribute to serious injury, death, or loss to the rider or to another person including but not limited to a person failing to maintain control over a horse or failing to act within their actual or perceived ability to do so.

Hold Harmless and Indemnification: The Stable, its employees and agents shall not be held responsible for loss, damage, injury, claims, demand, cost or expenses (including, but not limited to, attorney fees) arising out of or connected with the use, stabling or actions of the animal whether under control of rider or not. The Stable will not be responsible for any accident or injury to any person or animal who comes in contact with the rider’s horse whether the rider is mounted or dismounted. Rules and Regulations: Rider agrees to comply with all rules and regulations imposed by the Stable which are posted in the barn. The Stable shall have the right to change such rules and regulations, from time to time, which shall become effective upon being posted in the barn. It shall be the obligation of the Rider to remain current and to be aware of any revisions in such rules and regulations. Payment of Lessons: The Rider or if the Rider is a minor, their Parent/Guardian agree to pay the Stable the current lesson fee amount for the number and type of lesson provided each month. A monthly invoice indicating the date and type of lessons taken will be mailed by the Stable. Lesson fees are payable on or before the Tenth (10th) day of each month for the lessons provided from the previous month. Accounts not paid in full by the Tenth (10th) of each month will be charged a Forty Dollar ($40.00) late fee. The Stable shall have the right, from time to time, to increase the price of lessons by giving a written notice not less than Thirty (30) days prior to the date on which the said amount shall first be applicable. If any check is returned to the Stable for insufficient funds or other reason, a handling charge in the amount of Thirty Dollars ($30.00) shall be charged to the Rider or their Parent/Guardian.
