Comfort/Citycab MasterCard® PayPass™ Promotion 2013 Terms and Conditions 1. The Comfort/Citycab MasterCard PayPass Promotion 2013 (the “Promotion”) is organized by Cabcharge Asia Pte Ltd (the “Organizer”). 2. The Promotion is valid from 1 July 2013 to 31 December 2013, both dates inclusive (the “Promotion Period”). 3. The Promotion is open to selected cardholders of PayPass-enabled MasterCard-branded Eligible Cards issued in Singapore (“Cardholders” or each a “Cardholder”) by Participating Issuing Banks, that are maintained in good standing at all times. For the avoidance of doubt, whether a relevant card account is in good standing is determined by the relevant Participating Issuing Bank at its sole discretion. 4. The Participating Issuing Banks for the Promotion include only the following (each a “Participating Issuing Bank”): a. CIMB Bank Berhad b. DBS Bank Ltd 5. The Eligible Cards issued by the Participating Issuing Banks can be identified by its MasterCard PayPass identifier which may be on its card front or back; and include only the following (each an “Eligible Card”): a. CIMB WORLD MasterCard credit card b. CIMB PLATINUM MasterCard credit card c. DBS Woman’s World MasterCard credit card d. DBS Woman’s Platinum MasterCard credit card e. DBS One.Tap MasterCard credit card f. POSB Everyday Card 6. To be eligible for the Promotion, Cardholders must pay the Comfort and Citycab fares/charges using the PayPass function (each an “Eligible Transaction”) of their MasterCard branded payment cards (“Qualifying Cardholders” or each a “Qualifying Cardholder”) during the Promotion Period. a. For the avoidance of doubt, payment using the PayPass function refers to the contactless mode of payment by tapping a MasterCard card at a point of sale terminal, without the need for a signature or Personal Identification Number (PIN) to be provided by the cardholder and without the need for the driver to insert or swipe the card into terminal to authorize the transaction. b. Any determination by Cabcharge Asia Pte Ltd or Participating Issuing Banks as to what is an Eligible Transaction for the Promotion shall be conclusive and shall not be challenged in any manner whatsoever. 7. The 10% cash rebate shall be calculated and credited by each Eligible Transaction. a. The 10% cash rebate is calculated based on the following formula: Eligible Transaction Amount * 10% E.g. The 10% cash rebate for a S$12.00 will be S$12.00 * 10% = $1.20 b. The 10% cash rebate shall be credited by each Participating Issuing bank to its Qualifying Cardholders’ accounts within two (2) months from the Eligible Transaction(s). c. The 10% cash rebate shall be reflected in the monthly statements issued by the Participating Issuing Banks to their respective Qualifying Cardholders. 8. In case of any enquiries pertaining to the fulfillment of the 10% cash rebate or disputes for the Promotion, Cardholders should contact the relevant Participating Issuing Bank(s) directly. 9. The Organizer may at its sole discretion extend or shorten the Promotion Period without any prior notification. 10. The Organizer’s/Participating Issuing Banks’ records on all matters relating to or connected with the Promotion shall be conclusive and binding on all Cardholders. The Organizer’s/Participating Issuing Banks’

decision on all matters relating to or connected with the Promotion shall be final and binding on Cardholders and no queries shall be entertained. 11. MasterCard/Participating Issuing Bank(s) does not assume any responsibility for the products and services offered under this promotion. The products are sold and services are provided solely by the relevant vendors, under such terms and conditions as determined by such vendors, and MasterCard/Participating Issuing Bank(s) accepts no liability whatsoever in connection with such products and services. The products and services have not been certified by MasterCard/Participating Issuing Bank(s) and under no circumstances shall the inclusion of any product or service in this promotion be construed as an endorsement or recommendation of such product or service by MasterCard/Participating Issuing Bank(s). 12. The Organizer/MasterCard/Participating Issuing Bank(s) accepts no responsibility for any tax implications that may arise from the prizes or the use thereof. Any tax filing obligation or any tax payment due to any tax authority as a result of receipt of the prizes remain the sole responsibility of the Qualifying Cardholders. It is the responsibility of each Qualifying Cardholder to seek independent advice on the possible implications this may have on their own financial situation. 13. If any of the provisions of these terms and conditions becomes or is invalid, illegal or unenforceable in any respect under any law, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired and such invalid, illegal or unenforceable provisions shall be deemed severed from these terms and conditions. 14. These terms and conditions shall be governed by the laws of Singapore and Cardholders agree to submit to the non-exclusive jurisdiction of the courts of Singapore. The Promotion is not open to persons whose law of domicile prohibits them from participating in the Promotion and in the event such persons participate in the Promotion, they will be disqualified. 15. The Organizer reserves the right to vary, delete or add to any of these terms and conditions or any part thereof and/or to extend, modify, suspend, shorten, discontinue, cancel or terminate the Promotion at any time at its sole and absolute discretion, and no compensation in cash or any kind shall be given to the Cardholders for any and all losses or damages suffered or incurred by the Cardholders as a direct or an indirect result of such variation, deletion, addition or alteration of these terms and conditions and/or the extension, modification, cancellation, suspension or termination of the Promotion. Such variation, deletion, addition or alteration of these terms and conditions and/or the extension, modification, cancellation, suspension or termination of the Promotion shall be binding on the Cardholders.
