Information on how to enter forms part of these conditions. Entry into the competition is deemed acceptance of these terms and conditions. Entry is only open to Australian residents 18 years and over. Employees (and their immediate families) of the Promoter, and agencies associated with the Promoter, are ineligible to enter. Extended family members of those persons are permitted to participate in the promotion. The promotion commences at 9:00 AWST on 22 November 2016 and closes at 23:59 AWST on 20 December 2016. The time of entry will in each case be the time the entry is received by the Promoter. The Promoter accepts no responsibility for any late, lost or misdirected entries not received by the Promoter or delays in the delivery due to technical disruptions, network congestion or for any other reason. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

Entrants may enter the competition by: a. Submitting their original entry via the entrants own personal social media accounts and uploading a picture of their decorated Gingerbread House onto the Thermomix in Australia Official Facebook Page (www.facebook.com/thermomixinaustralia) or sharing on Instagram using the hashtag #thermomixgingerbreadhouse. Before sharing their picture, entrants must ensure the privacy settings for their social media accounts are set to "public" to enable that picture to be viewed by anyone; otherwise the entry is not valid. b. Entrants must use Thermomix brand Gingerbread House moulds, available through The Mix Shop (www.thermomix.com.au/shop/kitchenware/thermomix-gingerbread-house-moulds) By entering, the participant agrees that, without limitation; a. the content submitted is their own, or they have consent to use the content for this submission b. they will not submit material that is unlawful or fraudulent, that is a breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, politically incorrect, racist, sexist, objectionable with respect to race, religion, origin or gender, not suitable for children under 15 or otherwise unsuitable for publication un the context of this competition. c. they have complied with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and access to or use of others’ computers or communication systems. d. they have the full rights to grant to the Promoter the rights referred to in these Conditions of Entry e. they will indemnify the Promotor against all costs and claims by third parties arising from a breach in these Conditions of Entry Multiple entries per person are accepted. Only one prize will be awarded per person.

Choosing the winner 10. The winners will be the valid entry submitted in accordance with these terms and conditions that is judged by the Thermomix in Australia team to be the most creative and original on 21 December 2016. 11. The judges' decision is final and no correspondence will be entered into. 12. All Instagram accounts must be public in order for the Promoter to communicate with them and notify if they’re a winner for the promotional period and the judging period. If they are not they will not be considered for judging. 13. The winners will be notified on Thursday 22 December 2016 via private Message on Facebook or Instagram. The winners must contact the promoter via email within five (5) business days to claim their prize. 14. The winner’s first name and initial will be published on the Thermomix in Australia Facebook Page on the following day of the corresponding post. 15. The winner’s first name, initial and the image of the winning entry will be published on the Thermomix in Australia Facebook Page on or after Thursday 22 December 2016. 16. In the case of an invalid entry, ineligible entrant or a prize that remains unclaimed three (3) months from the date the winner was contacted, prizes may be awarded to the reserve entries, at the discretion of the judging panel.

Five winners will receive a Thermomix prize pack including Rose gold muffin tray, Silicone snack bar moulds, Imperial silicone mould and Easter/baby animals silicone mould valued at $80.90 Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date. Prizes cannot be transferred, exchanged or redeemed for cash.

The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of entry or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause. The Promoter collects entrants’ personal information in order to conduct the promotion and uses and stores this personal information in accordance with Australian privacy laws. The Promoter’s Privacy Policy is available on our website www.thermomix.com.au. Entry is conditional upon providing this personal information. The Privacy Policy contains information about why we collect personal information, how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the Australian privacy laws and how those complaints will be dealt with. In addition to any uses outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the information provided by entrants for promotional, marketing, publicity and research purposes without notice, or any compensation to the entrant. The Promoter may disclose personal information to Vorwerk International KG in Germany. By entering this promotion and providing personal information, you consent to the terms of our Privacy Policy and for the Promoter to use the personal information provided to contact you. All entries become the property of the Promoter. The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any participant (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of accepting the prize, except for any liability that cannot be excluded by law. The Promoter shall not be responsible for any entries that are not received, or are otherwise interfered with, due to problems beyond the control of the Promoter. Entrants agree that they are fully responsible for the entries they submit. Without limiting any other terms herein, the entrant at all times indemnifies and holds harmless the Promoter for any breach of these Terms & Conditions. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to applicable legislation.
