Texas Medicaid EHR Incentive Program: Appealing an Audit Finding The Notification and Appeal Process Texas Health and Human Services Commission (HHSC) will follow policies and procedures related to the notification and appeal of audit findings related to overpayments of Texas Medicaid Electronic Health Record (EHR) Incentive payments defined in the Texas Administrative Code (TAC) Title 1, Part 15, Chapter 354, Subchapter B, §354.1450 (Audits of Medicaid Providers). See the TAC Rule for official guidance, definitions, and rules. Note that an informal appeal of the findings in the draft audit report should be submitted via email to HHSC at the following address:
