Let’s Talk Water Conservation Earlier this year, the City of Buda lifted Stage 1 Drought Restrictions. The City had enacted Stage 1 at the end of 2015 through 2016 to reduce demand on the water distribution system during the completion of the Interim Water Improvements project and the construction of Well No. 5 at the Garlic Creek pump station. Both projects are now complete and in operation allowing Stage 1 restrictions to be lifted. However, the City encourages citizens to be good stewards of natural resources and practice water conservation year round.

We will continue to evaluate hydrologic and system conditions and will reinstate drought restrictions if a drought declaration is made by the Barton Springs-Edwards Aquifer Conservation District (BSEACD) or if warranted by the City’s conservation ordinance. Texas cities were ranked according to their average credit score. Only places with a population above 1,000 were analyzed. Credit scores are a good economic indicator. The City of Buda invites citizens that live within the city limits of Buda to register and participate in its fall 2017 Citizens' Academy. This is your opportunity to get to know how your city government works. Registration starts on Monday, July 17th, and ends Friday, August 18, 2017.

All classes will be on Thursday, except for the Public Works class which will be held on a Saturday from 9:00 am to 12:00 pm and the Fire Department class which will be held on a Wednesday, from 6:30 PM to 8:30 PM at the Fire Department. One of the classes is a Buda City Council Meeting, which are on the first and third Tuesday of the month at 6:30 pm.

New Flood Maps Proposed by FEMA for Hays County

New Parks Maintenance Building

The Federal Emergency Management Agency (FEMA), in partnership with the U.S. Army Corps of Engineers (USACE), the State of Texas, and local communities and counties, has released preliminary flood maps for public review and comment. These preliminary flood maps—known as Flood Insurance Rate Maps (FIRMs)— provide updated flood risk information for many areas in Hays County and along San Marcos River in Caldwell, Gonzales, Guadalupe, and Hays Counties. In Hays County, the flood hazard study includes areas along the Blanco and San Marcos Rivers, and many tributaries as well as Onion Creek, Barton Creek, Bear Creek and their tributaries. Property owners are encouraged to view the maps at http://maps.RiskMAP6.com to see the specific areas being remapped and how they may be affected.

BUDA PUBLIC LIBRARY has joined more than 1,000 libraries across the country to participate in the celestial event of the century, the August 21, 2017 Solar Eclipse.

These new flood maps will show residents and business owners how their flood risks may have changed and help them make more informed decisions about buying flood insurance. Community leaders use these new flood maps to make decisions about future building and development. Everyone is encouraged to know their flood risk.

During this national event, the shadow of the moon will sweep across the United States in a narrow band from the Pacific Ocean to the Atlantic Ocean in a spectacle that hasn't occurred in decades. In fact, the last total solar eclipse for the United States was nearly 40 years ago. The rest of the U.S. and North America (including Buda and the Austin area) will see a partial eclipse, with the Moon covering up only part of the Sun. It is aptly named the Great American Eclipse.

Hays County will hold two open houses on the proposed changes to the FIRM.

The new Parks Maintenance building is open. It was paid for as part of the Prop 5 bond money. "The facility was completed in January of 2017. Public Works moved in to the new building in February. It’s an awesome building. It has offices, a full lunch room and full scale mechanic shop out here. It also has bays to work on equipment," said Parks Supervisor Juan Mosqueda.

Outside of Hays County there is an open house in Luling, TX.

For Mosqueda and his crew, the new Parks Maintenance building is a welcome addition. Before it opened, they were crammed for space.

They will also have the opportunity to ask representatives from the State, Hays County, as well as FEMA and their mapping partners, any floodplain and flood insurance questions. There will be no formal presentation, so come at your convenience. For those unable to attend the meeting, maps are available at www.RiskMAP6.com. The recently released flood maps are still preliminary; they are set to become effective in late 2018. At that time, any related flood insurance requirements will also take effect. The map adoption process includes community meetings and a ACCESSABILITY review of citizen concerns.

“We had a 20 by 12 storage building. We did all of our work outside in the heat on the asphalt. Then we acquired a 40 by 20 building. The new building has drains in it, a concrete floor, exhaust systems and everything. We’ve been able to do mechanic work and a lot of other things that we can’t do out in the field because we need a covered facility.” Public Works also utilizes the new space. “The Parks Department has been in existence probably for about 10 years. It broke off partly from Public Works. So we share a lot of items and everything. But we still have a few things to buy and things like that. So we’re always looking for good used equipment if the public would like to donate something to us.” Our staff recently held an official ribbon cutting for the new Parks and Maintenance Building. “We really appreciate the building for the Parks department.”

CELESTIAL EVENT OF THE CENTURY

BUDA PUBLIC LIBRARY will be hosting a Solar Eclipse Party on August 21st from 12:00-2:00 pm. This will be a great opportunity for our community to celebrate science with fun, hands on activities for all ages. At 1:10 pm we will view the Partial Solar Eclipse together on the library lawn. Solar glasses will be provided for all participants to safely view the eclipse. Buda Public Library has joined the STAR Library Education Network (STAR_Net) and its NASA@ My Library initiative, which are providing resources and STEM activities to libraries across the nation related to the eclipse. Partners include NASA, the American Library Association, and many other organizations. This project was made possible through support from the NASA Science Mission Directorate, Gordon and Betty Moore Foundation, Google, and the National Science Foundation.

What is Annexation? How Does it Work?

How does annexation work? It’s the million dollar question. The City gets a number of inquiries regarding annexation and we wanted to give you a brief overview of how it works.

The City tries to do all annexation procedures at regular meetings, but the timing of hearings under state law occasionally requires special called meetings. They are always posted.

What is annexation? Annexation is the process of bringing property into the City limits. It is one of the primary means by which cities grow. Cities annex territory to provide urbanizing areas with municipal services and to exercise regulatory authority necessary to protect public health and safety. Annexation is also a means of ensuring that current and future residents and businesses outside a city's corporate limits who benefit from access to the city's facilities and services share the tax burden associated with constructing and maintaining those facilities and services.

Annexation is also a primary means by which cities benefit from development occurring in the ETJ or Extraterritorial Jurisdiction. This is especially critical in cases where the city has either directly or indirectly facilitated that development. What is the ETJ? (Extraterritorial Jurisdiction) With the exception of City-owned land, Buda may only annex land within its ETJ. The ETJ is the neighboring unincorporated land within a 1 mile radius extending from and adjacent to the city limits that is not within another city's ETJ. The purpose of the ETJ is to allow cities to plan for growth in the area outside their corporate boundaries and to annex new development. The ETJ does this in two ways. First, there is a statutory prohibition against a municipality annexing into another city’s ETJ. This provides a city with land that it alone can annex encouraging planning and utility extensions in the ETJ. Second, cities are authorized to enforce their subdivision regulations and infrastructure standards (and a very limited number of other regulations) in their ETJ. This ensures that development in the ETJ meets the city’s development standards further facilitating annexation. Under state law a City cannot enforce zoning, land use regulations or density in the ETJ. The Process of Annexing An ordinance, which must be approved by the City Council, is required to make an annexation effective. The State of Texas grants authority to cities to annex territory in two different manners:  

Annexation can be requested by a property owner (voluntary exempted process) City can annex a property without the consent of the owner (non-voluntary process)

All annexations must be carried out according to State law and the City Charter. As a home rule City of more than 5,000 people, Buda has the authority to annex property contiguous with, and within one mile of its current city limits following procedures consistent with Chapter 43 of the Texas Local Government Code. City staff will monitor changes in state law and periodically recommend changes to applicable ordinances, the City’s annexation policy and internal procedures consistent with any changes in the law. Exempted Annexations will be initiated when the City r eceives a petition for voluntary annexation fr om pr oper ty owner s. The City will then adopt a resolution initiatingNthe annexation exempted annexation area process. The City will hold two public ETW ORK IN G hearings and two ordinance readings to approve a voluntary annexation (the hearings take place during our City Council meetings on the 1st and 3rd Tuesday of every month), unless otherwise notified. The annexation is completed upon second reading of the ordinance, which includes adoption of a municipal service plan for the newly annexed area. For voluntary and non-voluntary annexations (less than 100 occupied parcels in an annexation) the same process applies. The City will hold two public hearings and two ordinance readings to approve the annexation (the hearings take place during our City Council meetings on the 1st and 3rd Tuesday of every month) unless otherwise notified. The annexation is completed upon second reading of the ordinance, which includes adoption of a municipal service plan for the newly annexed area.

City of Buda Receives “Clean Audit” For Second Consecutive Year The City of Buda’s Fiscal Year 2015-16 annual audit of the City’s financial reports has been completed by the independent audit firm of Whitley Penn, LLP. We are pleased to announce that for the second consecutive year, the City has received a clean audit. “The unmodified ‘clean’ opinion that the City received in its audited financial statements is a very high mark for the City,” said Finance Director June Ellis. What does having a “clean audit” mean? Having a clean, or unmodified audit means the City’s financial records have been determined by the independent auditor to be free of any misrepresentations. “This opinion is the highest level of assurance that can be given on financial statements. This is something that I’m proud to have accomplished and is something that the entire City and staff should be proud of as well,” said Ellis. “The City of Buda is dedicated to responsible and transparent financial management. The audit results reflect those values and is proof of our efforts.” Bond rating agencies view our annual financial statements and any healthy fund balances in the audited statements as a positive indicator of financial stability when determining the City’s bond rating.

Whitley Penn, LLP., presented the audit to the City Council on April 18, 2017, at which time it was approved. Below are some highlights of the FY 2015-16 annual audit: The City of Buda’s net position increased by $1.7 million from FY 2014-15 to FY 2015-16. This increase demonstratives the ability of the City’s revenues to keep pace with annual expenses. The net position increased from $82.2 million in FY 2014-15 to $83.9 million in FY 2015-16. This change in net position is a positive change for the City, as reflected in the City’s audited financial statements. N E T W O R K I N G At the close of FY 2014-15, the City had $3.8 million in non-designated fund balances compared to $4.1 million this year. ACCESSABILITY

“Getting a clean audit is very important for an organization. This means that we have strong internal controls and strong accounting people which are essential to our success,” said City Manager Kenneth Williams. “A clean opinion also gives us trust and integrity within the financial markets. A good financial audit helps to minimize and correct any possible inaccuracy during the year. We are proud for our citizens, the Buda City Council, City staff and especially finance staff to receive this unqualified audit.”

A Hazard Mitigation Plan outlines actions that can be taken to reduce or eliminate long-term risk to people and their property from natural hazards. It is an effective tool in identifying risks from and vulnerabilities to natural hazards, allowing communities to take action to protect its people and infrastructure before disasters occur. Passage of Texas House Bill 2445 Allows the use of Hotel Occupancy Tax for Improvements to Sporting and Events Facilities The City of Buda is pleased to see the passage of House Bill 2445. The bill allows the City to utilize Hotel Occupancy Tax for Improvements to Sporting and Events Facilities. The City and its legislative advocates pursued the legislation in the 85th Texas Legislative Session. Buda hoteliers receive significant bookings related to sports tournaments and events. The Buda Sportsplex needs capital improvements to bring it up to the level where the City can host tournaments and sporting events. The City of Buda wants to thank Representative Jason Isaac for his support during the legislative session. On a side note, “wiener dog races” is now part of the state statute, which has made a lot of Buda wiener dogs happy!

City Manager Kenneth Williams Elected Vice President of TCMA Buda City Manager Kenneth Williams was recently elected Vice President of the Texas City Management Association (TCMA) for 2017-2018. TCMA consists of local government professionals dedicated to promoting the highest standards of governance, service, leadership, ethics, and education while embracing individual and regional diversity for the benefit of the membership and cities like Buda. As Vice President, Mr. Williams will chair the state-wide TCMA Membership Committee. Mr. Williams has served as City Manager of Buda since September 2008. He is responsible for the day-to-day operations of the city, applies strategic direction, implements council policies, and coordinates community issues. Mr. Williams previously held positions with the City of Diboll as City Manager (2006-2008), the City of Lufkin as Assistant City Manager of Administrative Services (2004-2006), Director of Public Works (1997-2004), and served as Lufkin’s Emergency Management Coordinator (1997- 2006). During his tenure as the Emergency Management Coordinator, he was responsible for coordinating the City’s responses to the Space Shuttle Columbia Tragedy, Hurricane Katrina and Hurricane Rita. He has a Bachelor Business Administration from Stephen F. Austin University and Master Public Administration from Villanova University. Some major accomplishments during his tenure as Buda City Manager include implementation of the Buda Police Department, the reconstruction of the Main Street Overpass, construction of the Robert S. Light Bridge, directed the development of a new Comprehensive, Transportation and Downtown Plans, the construction and inauguration of the Tyler Norris Memorial Skate Park, and is currently overseeing the City’s various bond projects, including a new Municipal/Library Facility, Public Safety Building, Parks projects, Drainage projects and Street improvements.
