The seven Critical Success Factors (CSFs) are foundational elements within the framework of the Texas Accountability System developed by the Texas Education Agency and the Texas Center for District and School Support. Products of evidence-based research, their purpose is to help guide school improvement. Identified priorities should lead to developing measurable goals, which in turn promote a committed team effort toward success. To assist administrators in the support of each Critical Success Factor, Region 4 has correlated professional development sessions designed to support each factor. Academic performance is the foundational Critical Success Factor. Critical Success Factor 2 emphasizes the effective use of multiple sources of disaggregated data. CRITICAL SUCCESS FACTOR 4: INCREASED LEARNING TIME

Research promotes a three-pronged approached to increased learning time that includes the following elements: (a) increased academic learning time, (b) increased enrichment activities, and (c) increased teacher collaboration and professional development. L-TAT: Learning Time Analysis Tool The Learning Time Analysis Tool (L-TAT) provides a framework for analyzing instructional learning time and discovering opportunities for increasing learning time at the campus level. The L-TAT is a web-based application to support collection and review of data related to instructional learning time. The tool is accessible on desktops, tablets, and other mobile devices, creating flexible options for data collection. This is a customized service for campuses. Family and community engagement calls for increased opportunities for input from families and the community as well as the necessity for effective communication and access to community services. 10 SCHOOL DAYS • Students with disabilities can be removed from their placement for up to 10 school days per school year without having an MDR, without there being an IEP meeting, and without the student being the recipient of special education services. 34 CFR §300.530(d)(3)

WEAPONS, DRUGS, OR SERIOUS BODILY INJURY If an infraction involves weapons, drugs, or serious bodily injury [18 USC §1365(h)(3)], a student with disabilities may be removed to an interim alternative educational setting for up to 45 school days without regard to whether the infraction was a manifestation of the disability. 34 CFR §300.530(g)

• If a student commits an infraction after being out of placement for 10 school days, each subsequent removal must be examined if the removal is a change of placement. The IEP team determines appropriate services. If there is not a change of placement, school personnel in consultation with at least one teacher determine the extent services are needed to progress toward meeting the student’s IEP. 34 CFR §300.530(d)(4)

POSITIVE BEHAVIORAL INTERVENTIONS AND DISCIPLINARY ALTERNATIVES For some students, suspension, expulsion, or ISS reinforce negative or problematic behaviors. Some alternatives to consider: • Develop whole-school interventions. • Define/teach clear behavioral expectations. • Analyze discipline/behavior data to determine function. • Acknowledge/reinforce appropriate behaviors. • Provide a cool-down room/area. • Develop behavior contracts. • Provide social skills instruction. • Involve parents in positive ways. • Build relationships with students.

WHY IS SPECIAL EDUCATION DISCIPLINE SO SPECIAL? Under IDEA, students with disabilities have certain protections to eliminate discrimination due to their disabilities. Special consideration is taken into account on a case-by-case basis. Prior to changing the student’s placement for disciplinary purposes, the IEP team must consider if an infraction is the direct result of the student’s disability or a direct result of the LEA’s failure to implement the IEP. 34 CFR §300.536, 34 CFR §300.530(a), 34 CFR §300.530(e)(1)

Case-by-Case Determination

Student with a disability violates a code of student conduct where the disciplinary consequence being considered involves a day of removal from the current educational setting.

Disciplinary Consequence Intervention If the student’s behavior impedes the student’s learning or that of others, the IEP Team must consider the use of positive behavioral interventions and supports, and other strategies, to address the behavior. 34CFR 300.324(a)(2)(i)

School personnel may remove the student from his/her current placement to an appropriate Interim Alternative Educational Setting (IAES), or suspension, for not more than 10 consecutive school days (to the extent those alternatives are applied to the student without disabilities), and for additional removals of not more than 10 consecutive school days in that same school year for separate incidents of misconduct (as long as those removals do not constitute a change of 34CFR 300.530(b) placement).
