ENTRY: To enter, obtain an entry form from any NVE Bank branch, complete it accurately, and submit it between July 10, 2017 and July 15, 2017 (the “Promotion Period”) in one of the two following ways: 1) deposit the completed entry form into the marked receptacle inside any NVE Bank branch; 2) mail the completed entry form in a standard business-sized envelope, with proper postage, to the following address: “130th Anniversary Prize Drawing,” c/o NVE Bank, 76 Engle Street, Englewood, NJ 07631. 4. DRAWING/WINNER SELECTION: Potential winner will be determined by random drawing on or about July 21, 2017 from all eligible entries received. The drawing will be conducted by Sponsor or its designee, the judge of the Prize Drawing, whose decisions are final and binding. Sponsor shall be the official timekeeper of the Prize Drawing. Potential winner will be notified on or within three (3) days of the drawing by an email sent to the email address specified in the entry form or, at Sponsor’s discretion, by phone. If the potential winner does not respond within twenty-four (24) hours of the prize notification, fails to comply with the instructions contained in the prize notification within the required time period, is ineligible for the Prize, or refuses to accept the Prize, Sponsor reserves the right to randomly choose an alternate potential winner from the pool of remaining eligible entries. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate potential winner. In the event of a dispute concerning the identity of the person submitting an entry online, the entry will be deemed to be submitted by the person in whose name the email account for the email address provided to Sponsor is registered. Potential winner may be required to provide a driver’s license and/or other evidence of identity in connection with claiming the Prize. Eligibility is subject to verification. Winner may be required to complete and sign an Affidavit of Eligibility and Liability Release and, except where prohibited, a Publicity Release in the form provided by Sponsor, in order to claim the Prize. GENERAL CONDITIONS: By entering this Prize Drawing, each entrant agrees to be bound by and comply with these Official Rules and all applicable laws. Any attempt to obtain more than the permitted number of entries or to tamper with the Prize Drawing may void that person’s entries and disqualify such person. Sponsor has the right to cancel, terminate or modify this Prize Drawing if it cannot be completed as planned or if the integrity, legality or proper functioning is or may be impaired due to computer virus, bugs, tampering, unauthorized intervention, technical failures, or other conditions beyond Sponsor's reasonable control. In such an event, Sponsor may, at its discretion, select a winner from eligible entries received on or before the termination date. Sponsor is not responsible for any failure to contact entrants, whether due to technical or human error. 6. GOVERNING LAW AND FORUM FOR DISPUTES; CLASS ACTION WAIVER. The Prize Drawing is governed by the laws of the United States and the State of New Jersey. Except where prohibited by law, by entering, each entrant agrees that any and all disputes, claims and causes of action arising out of or connected with the Prize Drawing or the Prize shall be resolved individually, without resort to any form of class action, and exclusively by the state or federal

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of any person in connection with the Prize Drawing, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice or conflict of law rules which would cause the application of the laws of another jurisdiction. 7. PUBLICITY AND PRIVACY: Except where prohibited by law, by entering the Prize Drawing each entrant agrees that if he or she is the winner, Sponsor and its agents may use such entrant’s first and last name and likeness in any and all publicity and advertising (including on Sponsor’s website) without any further attribution, notification, review, approval or compensation. Each entrant agrees to be contacted by Sponsor by telephone, mail or email regarding this Prize Drawing. Sponsor collects the email addresses and other information from those who submit entries for the Prize Drawing. The information we collect is used to select and notify a winner of the Prize Drawing and is not shared with or sold to other organizations unless it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the Official Rules or our website terms, or as otherwise required by law. Further, by entering the Prize Drawing you agree to our use, collection and disclosure of personally identifiable information in accordance with our Privacy Policy (http://www.nvebanking.com/home/security/privacy). 8. LIMITATION OF LIABILITY, RELEASE AND INDEMNIFICATION: To the fullest extent permitted by law, by entering this Prize Drawing, each entrant agrees, on behalf of such entrant and each of his or her guests; (i) that any and all claims, judgments and awards relating to the Prize Drawing or the Prize shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Prize Drawing but in no event attorneys’ fees; and hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased and (ii) to release and hold harmless Sponsor and its agents, employees, successors and assigns (the “Released Parties”) from any liability, damages, loss or injury resulting from entrant’s participation in this Prize Drawing or the acceptance, possession, shipping and handling, loss, use or misuse of any Prize awarded in this Prize Drawing. Without limiting the foregoing, each entrant agrees that the Released Parties shall not be responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, Sponsor, or any printing or typographical errors or equipment or programming associated with or utilized in the Prize Drawing; (2) technical failures of any kind including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Prize Drawing; (4) technical or human error which may occur in the administration of the Prize Drawing or the processing of entries; (5) late, lost, misdelivered, destroyed,

unintelligible or undeliverable entries or notifications; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation in the Prize Drawing or the receipt, use or misuse of any prize. To the fullest extent permitted by law, entrants and winner assume sole liability for any loss or injuries, including personal injuries and/or damage to person or property, caused or claimed to be caused by participating in this Prize Drawing or the acceptance, possession, shipping and handling, loss, use or misuse of any prize awarded, whether to themselves, their guests, or any third party, and agree to indemnify Sponsor for any claims, losses, liability or damages arising from any such loss or injuries.
