WHAT IS THE VIEWPOINT CERTIFICATION PROGRAM? Lateral Data, a Xerox company, is committed to working with its clients to ensure that the organization and their people have the knowledge, experience, and infrastructure necessary to optimize the use of Viewpoint for their e-discovery projects. Becoming certified is validation that you and your organization are Viewpoint product experts. WHO CAN BECOME CERTIFIED? Currently, existing clients and their employees who have undergone Viewpoint training are eligible to become Viewpoint certified. If you are not currently a Viewpoint client and would like to learn more, click here or contact

WHO IS AN EXISTING CLIENT? “Existing clients” are service providers, consultancies, law firms and corporations including all Viewpoint partner organizations - who are currently using Viewpoint pursuant to an effective license agreement. All new clients will need to receive on-site training prior to certification. WHAT VIEWPOINT CERTIFICATIONS ARE OFFERED? We offer organizational certification and individual professional certification. Organizational Certification There are three levels of organizational certification: Premium - Designed for organizations who meet the established standards in infrastructure, experience and individual employee certification
Premium Silver - Designed for organizations who choose to make additional investments in infrastructure, experience and individual employee certification

Premium Gold - Designed for organizations who choose to invest at the highest levels in infrastructure, experience and individual employee certification
Individual Professional Certification There are three types of individual certifications offered for professionals: Sales Pro Certified - Designed to ensure that an individual has the necessary knowledge and expertise to deliver a Viewpoint product demo as part of the sales process
Processing Administrator Certified Designed to ensure that an individual has the necessary knowledge and expertise to service Viewpoint clients in key areas of Viewpoint processing administration
Review & Analytics Administrator Certified - Designed to ensure that an individual has the necessary knowledge and expertise to service Viewpoint clients in key areas of Viewpoint review and analytics administration
WHAT IS THE DIFFERENCE BETWEEN ORGANIZATIONAL CERTIFICATION AND INDIVIDUAL PROFESSIONAL CERTIFICATION? Organizational certification is designed to ensure that a client has achieved standards at an organizational level required in infrastructure, experience and individual employee certifications. Individual professional certification is designed to ensure that an individual within an organization has received Viewpoint product training and has demonstrated through

required certification exams that the individual has attained the knowledge necessary to provide Viewpoint service in the particular certification area such as Viewpoint Sales Pro, Viewpoint Processing Administrator or Viewpoint Review & Analytics Administrator. Individual professional certification of employees earns a client points towards organizational certification. WHAT ARE THE BENEFITS OF VIEWPOINT CERTIFICATION? Organizations that achieve Premium, Premium Silver or Premium Gold Certified status receive: • Recognition as an organization having Viewpoint product expertise • Enhanced organizational ability to sell and service Viewpoint • Rights to organizational certification logo use and premium branding • Prioritized listing and recognition on the Lateral Data website Certified individuals receive: • Credentials and recognition as a professional Viewpoint expert in a specific area • Enhanced personal ability to sell and provide Viewpoint services • Rights to individual certification logo use and credentials for each certified area • Points allocated towards your employer’s organizational certification HOW MUCH DOES VIEWPOINT CERTIFICATION COST? There is no fee for organizational certification. The individual certification is offered free of charge to Viewpoint partner employees. Training in order to pass the individual certification exams is already provided under standard licensing agreements. If an individual requires additional training, however, additional training fees will apply. WHAT IS REQUIRED FOR ORGANIZATIONAL CERTIFICATION? An organization can achieve certification by earning points through three areas of evaluation: (1) infrastructure, (2) experience providing Viewpoint services, and (3) individual certification of employees.

Infrastructure Point Allocation The first area of evaluation is infrastructure. The Lateral Data team will work with you to test your infrastructure capabilities. All testing will be done remotely. A data set will be provided to you via upload for processing. Our team will validate your use of the correct data set and monitor your throughput remotely to evaluate the number of GBs per worker per hour. This metric is used to identify the number of points allocated towards your organizational certification as follows: GBs per Worker Per Hour 2 to 3 GB 3 to 5 GB 5 or more GB

Experience Point Allocation In order to reward organizations that have achieved Viewpoint project experience over time since inception of Viewpoint usage, points are allocated once they meet established standards of processing volume and project quantity as follows: Processing Size and Project Quantity Processing 250 GB minimum and 5 Projects minimum Processing 500 GB minimum and 10 Projects minimum Processing 1 TB minimum and 10 Projects minimum

Individual Certifications Point Allocation For organizations that invest in and encourage their employees to attain the knowledge necessary to provide optimal Viewpoint service, points are allocated for every individual professional certification as follows: Individual Certification Type Viewpoint Sales Pro Viewpoint Processing Administrator Viewpoint Review & Analytics

WHAT IS AN EXAMPLE OF HOW THE ORGANIZATIONAL CERTIFICATION POINT SYSTEM WORKS? Let’s say the Ace Company is a Viewpoint client. Lateral Data has tested its infrastructure and found that its throughput equals 5 GBs per worker per hour. Thus, Ace is allocated 30 points. Next, Lateral Data verifies Ace’s experience with Viewpoint. To date, Ace has processed over 1 TB of data and hosted 10 projects on the Viewpoint platform. Thus, they are allocated 50 points. Finally, the individual professional certifications of Ace employees are tracked. They have one Viewpoint Sales Pro (2 points), one Viewpoint Processing Administrator (4 points), and two Viewpoint Review & Analytics Administrators (8 points). Thus, Ace is allocated 14 points. In sum, Ace Company receives a total of 94 points toward organizational certification. Because this is equal to or greater than 90 points, Ace has achieved Premium Gold Certified status. WHAT STEPS DO I NEED TO TAKE TO GET MY ORGANIZATION CERTIFIED? 1. Organizational Certification Application. Complete the Organizational Certification Application located on the Lateral Data help desk portal and submit it to Ramiro Gonzalez, Director of Training, at
[email protected]. 2. Individual Professional Certification. Have employees achieve individual professional certification in the three areas based on their roles and areas of responsibility: Viewpoint Sales Pro, Viewpoint Processing Administrator and/or Viewpoint Review & Analytics Administrator. Individual professional certification of employees will result in points allocated toward organizational certification. The location of the online Viewpoint Certification Portal and instructions for logging in are available on the Lateral Data help desk portal. This information will need to be distributed to all employees who plan to get certified. 3. Evaluation and Notice. Lateral Data will assess your application and track your employees’ individual professional certification progress on the Viewpoint Certification Portal. You will be notified as soon as your organization achieves the necessary points required for each level of certification. At that time, the Premium Certified, Premium Silver Certified or Premium Gold Certified logo will be provided to you for your organization’s use (on website, sales collateral, etc.). The Lateral Data team will coordinate with you to provide any additional benefits earned based on your organization’s level of certification.

WHAT STEPS DO I NEED TO TAKE TO GET MY INDIVIDUAL PROFESSIONAL CERTIFICATION? 1. Prepare for the certification exam. First, make sure to completely review this Viewpoint Certification Guide. Details are provided below on how best to prepare for the exam. 2. Access the Viewpoint Certification Portal. Your organization’s internal Viewpoint contact will provide you with an email that includes instructions on how to access the Viewpoint Certification Portal. At the online portal, you will be directed to register as a new user. 3. Pass the Certification Exam. Once you are logged into the Viewpoint Certification Portal, you will be directed to the Viewpoint Certification course you have selected. You will have the option to review the updated training manuals and/or watch the refresher training webinar before taking the exam. Neither is required but both are highly recommended in order to achieve the highest possible exam score. The system will then provide you with instructions and guide you to the exam. Exams have time limits and will consist of between 30 and 50 questions in multiple-choice format. You must receive a score of 80% or greater to earn the certification. WHAT IS THE EXAM FORMAT? The exam is in the form of multiple-choice questions located online via the Viewpoint Certification Portal. The Viewpoint Sales Pro exam consists of 30 questions. The Viewpoint Processing Administrator and the Viewpoint Review & Analytics Administrator exams consist of 50 questions each. A passage of 80% is required for certification. The Viewpoint Certification Portal will automatically score and provide you with immediate notice of whether you passed or if you need to retake the exam. If you pass, a certificate will be automatically generated for you to download as proof that you have achieved Viewpoint certification. Your employer’s internal Viewpoint contact will also receive an email acknowledging that you successfully achieved certification. If you do not pass the first time, you will have one more chance to take the exam with a brand new set of questions. For next steps, please see the “What if I Don’t Pass?” section below. HOW DO I PREPARE FOR THE EXAM AND WHERE CAN I GET TRAINING? If you are an employee of an existing client organization, you have already received the hands-on lab training necessary to prepare for the certification exam. Updated training manuals will be available online via the Viewpoint Certification Portal. In addition, you will be provided the option to view the refresher training webinar online via the Viewpoint Certification Portal prior to taking the exam.

The following materials will be sufficient to help you prepare for the exam: • Viewpoint Certification Guide (to provide information on the process) • Updated training manuals (available on the Portal) • Refresher Training Webinar (10 to 20 minutes each, available on the Portal) WHAT TOPICS WILL BE COVERED ON THE EXAM? The following topics will be covered in the Viewpoint Sales Pro certification exam: 1. How to effectively demo Viewpoint; 2. The Viewpoint value proposition; and 3. Key Viewpoint features and workflow. The following topics will be covered in the Viewpoint Processing Administrator certification exam: 1. Interface and new project set-up; 2. Staging and cataloging data; 3. Monitoring process; 4. Cleaning data / QC; 5. De-duplication, index and post data; 6. TIFF creation and scope/media modifications; and 7. Importing pre-processed data. The following topics will be covered in the Viewpoint Review & Analytics Administrator certification exam: 1. Security; 2. View Manager; 3. Review interface; 4. Advanced tools (including all analytics and Viewpoint Assisted Review); 5. Production; and 6. Best practices. WHAT CAN I BRING WITH ME INTO THE EXAM? The exam will be a closed-book exam. No manuals, source materials, or mobile devices may be used. You cannot consult other individuals in the course of taking the exam. At the beginning of the exam, you will be required to acknowledge that you agree to take the exam under the highest ethical standards. WHEN CAN I TAKE THE EXAM AND IS THERE A TIME LIMIT? Since individual professional certification exams are offered online, you can take them anytime – all you need is a Web browser. Once you commence the online exam, you will be subject to a time limit and will not be able to stop and log back in to finish it. You will have 60 minutes to complete the Sales Pro exam. You will have 90 minutes to complete the Processing Administrator exam and 90 minutes to complete the Review & Analytics Administrator exam.

WHAT IF I DON’T PASS? If you do not pass the online exam with an 80% score the first time, you will be allowed to take the online exam again with an entirely new set of questions. Since you can only take the online exam two times, we highly recommend that you make sure to use all available resources in preparation. To enroll in a second online exam, please contact Ramiro Gonzalez, Director of Training, at
[email protected] or at 1-877-592-8585. If you do not pass on the second attempt, you will not be allowed to retake the exam until you undergo in-person full-session training at cost. WHEN DOES MY INDIVIDUAL CERTIFICATION EXPIRE? Your individual professional certification is valid for twelve months. ARE THERE RE-CERTIFICATION REQUIREMENTS? In order to remain current after an individual professional certification expires, you must recertify on an annual basis. To recertify, you can view the annual recertification webinar and pass an online multiple-choice exam. CAN I TAKE MY INDIVIDUAL CERTIFICATION WITH ME IF I LEAVE MY CURRENT ORGANIZATION? Yes. You are the holder of your individual professional certification. If you leave your current organization, your new employer will be able to gain points for your individual certification. HOW AND WHEN DOES ORGANIZATIONAL CERTIFICATION STATUS CHANGE (UPGRADE/DOWNGRADE)? The Lateral Data team will audit your organizational certification status on an annual basis. If you wish to apply for an upgrade to a higher organizational certification status, please contact Ramiro Gonzalez, Director of Training, at
[email protected] or at 1-877-592-8585. LEGAL PROVISIONS Right to Change Certification Program. Lateral Data reserves the right to change the rules and regulations of the Certification Program or terminate the Certification Program at any time without cause or notice. Such changes may include, without limitation: adding or deleting available Certifications and modifying certification requirements, recommended training courses, testing objectives, outlines and exams. You agree to meet the Certification Program requirements, as changed, as a condition of obtaining or maintaining your Certification.

Certification Revocation. Lateral Data may at its sole discretion revoke any and all Certification an individual or company may have earned, and permanently ban you from earning future Certifications for: • • • •
Failure to company with any continuing education or recertification requirements; You breach the term of any agreement between you and Lateral Data Exam misconduct Actions that violate the rights granted by the Certification Program.
Lateral Data Owned Materials. You acknowledge and agree that Lateral Data’s proprietary material, documentation, processes, manuals, and know-how that may be used in connection with the Certification Program and any of its logos, trade names or trademarks (collectively, the “Lateral Data Owned Materials”) belong to Lateral Data and that you shall not have any rights in or to the Lateral Data Owned Materials, except and only to the extent as provided to you in writing in connection with the Certification Program. You may not use the Lateral Data Owned Materials without the prior written consent of Lateral Data, and only as explicitly provided. Independent Relationship. You and Lateral Data are not partners or joint venturers, but independent parties. Neither Lateral Data nor you is authorized to make any commitment or representation on the other's behalf without the prior written approval by a duly authorized representative of the other party. Should the term “partnership” or “partner” be used to describe the relationship between you and Lateral Data, you shall make it clear to third parties that these terms refer only to the spirit of cooperation between us and does not describe or expressly or impliedly create the legal status of partners or joint venturers. Disclaimer. LATERAL DATA MAKES NO REPRESENTATION, GUARANTY, WARRANTY OF ANY BUSINESS RESULTS, FINANCIAL OR OTHERWISE RELATING THE CERTIFICATION PROGRAM. ALL WARRNTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD PARTY RIGHTS, ARE HEREBY DISCLAIMED BY LATERAL DATA TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. Limitation of Liability. IN NO EVENT SHALL LATERAL DATA AND/OR ITS AFFILIATES BE LIABLE TO ANYONE FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES OF ANY TYPE OR KIND (INCLUDING LOSS REVENUE, PROFITS, USE OR OTHER ECONOMIC ADVANTAGE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH THE CERTIFICATION PROGRAM, EVEN IF LATERAL DATA HAD BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Assignment. You may not assign any rights, licenses or obligations received under the Certification Program. Any attempted assignment in violation of this provision will be null and void and without effect.
