3RD Issue Is Cool, too By Producer 9-0, Co-Editor Well, I am putting out another lawsuit free issue. Yeah, that may seem funny to many nut the way our society is; suing is cool. It is sheek or the new status quo. Like the Ray Rice situation and the Adrian Peterson indictment, we fail to think with humility. Our first reaction is JAIL! Then, take every dime they have. Then every reporter with no story….has one. Every man that lives with a dominate partner talks about what they would never do. Ha-ha, cause they can’t. Anyway, the last issue was really dope. We showed that Lorren Cotton is a beautifully talented soul. It was great to read her interview responses. Nothing like a thought provoking piece to curl up with. I must say that Avion Blackstone and Rhyme Scheme caught my ear. Just find them on the net and see if you don’t agree with me. Of course, I must thank the centerfold, Ms. Amber Atkins. Nothing like a beauty being beautiful. Our articles on the criminal justice system were fairly informative, yet brief enough to be an easy read. That is a goal of 9.0 Magazine, to be easy to read. We are getting better at balancing substance and sex. I thank the readers again for coming along with us on this journey. Even with the Willie Lynch letter inclusion, we still talked depression. XXL Magazine to end print edition after 17 years

“We think XXL has strong potential in both the digital and live events market,” said Townsquare CCO Bill Wilson, adding that the magazine could possibly make special print appearances sporadically.

NEW YORK, Sept. 23 (UPI) -- Hip Hop magazine XXL will end production of physical issues and become an online-only publication after a 17-year run following its upcoming October/November issue. The change comes as the six-issue-a-year magazine was sold to radio giant Townsquare Media, the New York Post reported Monday.

"We incubated something digitally, but the Townsquare people can take it to the next level with their digital expertise," said Ben Harris, president of Harris Publications, XXL's publisher since its inception in 1997.

Bill Wilson, the chief content officer of Townsquare, said that 11 members of the editorial and digital sales team at XXL would be getting job offers to stay with the publication under its new publisher.

While the details of the sale remain unknown, Townsquare reportedly raised about $100 million in an initial public offering on July 23. The media company gets most of its revenue from its "331 radio stations in 66 small to mid-sized markets" as well as its growing online presence.

The Greenwich, Conn., company has been increasing its digital titles since the summer having purchased the young-man publication Antenna Magazine in July and King-mag.com later on. According to data tracker comScore, the Townsquare network is ranked at no. 50 in terms of online traffic with a reported 49.4 million unique monthly visitors in August.

News of XXL's purchase and move into a more exclusive web-based presence comes weeks after SpinMedia said it was ending XXL rival Vibe's print edition presumably over its male customers' preference for an online medium.

(all of Faymis’ responses will be in italic) What is your name/ city you rep? Faymis - Kansas City & International Lol that is a lot of territory ! You know I love me some Twitter, so, what is your Twitter @ name, plz. @xoitsfay What is your relationship Status? Single Which music genres do you like? Hip Hop/Rap What do you do/talent/profession? Photographer/Videographer/Graphic Designer/Web Designer/Promoter/ Marketer/Owner of International Website How did u get into your profession/talent? I've always had an extreme love for music. In high school I was in several choirs and it was always my passion to sing. After time, I decided to get into a different aspect of music. When I discovered the local music scene in Kansas City, I knew what I wanted to do. I wanted to be the person that helped people with the next step of their careers. I do photo shoots, concert photography, music videos, promo videos, flyers, mixtape/album covers, logos, designing websites & mobile apps, promoting artists/events/music, marketing artists/music/companies, and having a website of my own to help artists get noticed on an international level. I started with Kansas City, grew to a national level, and have moved my way up to international. What are some the obstacles have you encountered? The reason why I do so many things, rather than just picking one craft and just doing that, is because there are so many people that are doing those things. It's rare you find someone who does it all, especially on an international level. As far as obstacles, the building process. I could say that I wish it would

go faster, but honestly I can't complain.

Are you seeing success? Absolutely. I started this in April of 2013, and in just over a year have went from being locally known, to being internationally known. I taught myself everything I know. I've had a few people along the way give me tips and advice, but I literally created my own empire from the ground up. The greatest thing is that it's still growing, and people are seeing that. I am glad success is present in your career. So, tell my readers three words that describe you. Driven, Outgoing, Dreamer. Ok, so tell the readers, 3 things they should know about you. #1 - I am a single mother. I have been a single mom for a year and a half, and it was at that point of my life when I decided I needed something bigger and better than what I was doing. Every move I make, is to build my empire. My dream is for this to grow into something amazing, so that I can provide the life for my daughter that I never got to have. #2 - As many people as there are doing these things in the local music scenes everywhere, I think I'm the most passionate. Everyone has their own reasons for doing what they do of course, so no shade. But I really put my all into everything that I do. Tech N9ne said it best - "I'm an artist & I'm sensitive about my shit." #3 - Music is my life. I live, love, breathe music. There's not a single day that goes by that music isn't involved in my every day routine. Without music, I'm not sure what I'd be doing right now.

Wow, that was really on point Faymis. Now, tell the readers 3 of your top pet peeves. #1 - When artists act better than everyone else that's doing the same thing they are doing. We all start somewhere. Everyone has/had to go through the same steps to build their career. #2 - When artists think they should get hand outs. In order to build, you have to be willing to invest. That doesn't always mean spending money. Bartering is just as much investing as spending money. You have services to offer, just like everyone else does. #3 - My biggest pet peeve is that I can't be everywhere I would like to be. I have artists that I work with all over the world. I just wish I could be at some of those shows, watch my people do their thing live & direct. But it's the business. What makes you different and unique when it comes to the entertainment business? I love this question because I always ask the

artists that I interview this question. Most times it seems like the answers are all relatively the same. Me, I'm not an artist. I'm not a fan. I'm not a supporter. I REPRESENT. This is why my company is called iRep Media. iRep everything that has to do with local media EVERYWHERE. I don't just work with rappers & singers. I also work with any kind of upcoming artists, such as: dancers, producers, engineers, DJ's, promoters, managers, venues, tattoo artists, painters, writers, photographers & videographers. I literally make a point to do different than what everyone else is doing. Each of these different kinds of upcoming artists are influential to the local media scene everywhere. Seeing that you are so strong, talk about your Idols/Influences/Heroes. My biggest idol would be my step dad. He used to be a photographer, and one day realized he wasn't making a living off of that. He thought about what he wanted to do, which was involving computers. He wanted to develop, design, build, code - everything on the back end of websites. So he sat down, and read books and looked up stuff online for 6 months. Did nothing else, but read & learn & teach himself for 6 months. He now owns his own company, and has clients & employees all over the world. Seeing him do that, by just the will in his mind, let me know that if he could do something like that, so could I. What projects have you done and are doing? Elaborate, please. I do a lot of different things for a lot of different artists. My work varies: photo shoots, music videos, graphics, marketing, web design, promotions, interviews. I've done a lot for a lot of people. My biggest things that I have done in the past: Show with Kirko Bangz for Club Privilege in Kansas City, Waka Flocka Opener Auditions at Club Privilege in Kansas City, Silence The Violence - Follow Your Dreams High School Tour (Drone Boyz, Kstylis, Vyndu, Kid Swagga, Demond Jones, & Kid Swagga), and covering the Rock The Block Party in Kansas City. Death ..heartbreak ...and illness two brothers committing suicide ..me almost near death ..my mother beating stage three lymphoma. Wow, K’Monic, that is a lot to deal with. 

With you going through so many things, can you talk about those that influence you to succeed. My grandmother is my bestee. She taught me about life in general. She's the ipitomy of keeping it real. Now, my heroine is my mother for being strong after two deaths due to suicide. And, lastly, My boyfriend ..he's the most supportive man ever ..I'm blessed.



Can you Elaborate, please, on projects you have done and are doing? Besides my crown of Ms. Empress of Talent, I am modeling for Nikon agency of LA and NYC. I completed a commercial for Lira pharmaceuticals which will air in 2015.

THE REAL BLACK LIST MICHAEL BROWN Michael Brown, 18, was on his way to his grandmother's house in Ferguson, Mo.--a suburb just outside of St. Louis -- on August 9, 2014 when a series of events would claim his life. According to the St. Louis Post-Dispatch, some reports indicate that Brown and the police officer who's accused of shooting him engaged in an initial struggle for an officer’s gun inside a patrol car before the teen was shot. But a 19-year-old witness told the paper that she saw a police officer attempting to place Brown in the rear seat of a police car. She then saw Brown trying to flee the car, with his hands in the air, while multiple shots were fired at him. Brown planned to start college on Monday, August 11.

ERIC GARNER Outrage continues to mount over the death of Eric Garner, 43, who died on Thursday, July 17, 2014, after a New York City Police Department officer put him in a “choke hold” on a sidewalk in broad daylight in

front of concerned bystanders. Stunning cellphone video recorded by a passerby shows at least five officers piling onto an unarmed Garner, who suffered from asthma and diabetes and could be heard repeatedly shouting, “I can’t breathe, I can’t breathe.” Police Commissioner Bill Bratton has said that the maneuver used by the officer “would appear to have been a choke hold,” which the department banned 20 years ago. In light of the death of Garner, a father of six, The Root reviews incidents in which black men and boys without weapons lost their lives to law-enforcement officers or others who decided that they were dangerous enough to die. KI MA N I G R A Y Sixteen-year-old Kimani was shot four times in the front and side of his body and three times in the back by two New York City police officers as he left a friend’s birthday party in Brooklyn on March 9, 2013. The only publicly identified eyewitness is standing by her claim that he was empty-handed when he was gunned down.

KENDREC MCDADE Nineteen-year-old college student McDade was shot and killed in March 2012 when officers responded to a report of an armed robbery of a man in Pasadena, Calif. He was later found to be unarmed, with only a cellphone in his pocket. His death has prompted his family to file a lawsuit, in which McDade’s parents argue that he was left on the street for a prolonged period of time without receiving first aid. According to court documents, McDade’s last words were, “Why did they shoot me?” The officers involved were initially placed on paid administrative leave but have since returned to duty. TIMOTHY RUSSELL Russell and his passenger, Malissa Williams, were killed in Cleveland after police officers fired 137 rounds into their car after a chase in December 2012. Officers said they saw a possible weapon, but no weapon or shell casings were found in the fleeing car or along the chase route.

ERVIN JEFFERSON The 18-year-old was shot and killed by two security guards—also African American—outside his Atlanta home on March 24, 2012. His mother says that he was unarmed and trying to protect his sister from a

crowd that was threatening her. AMADOU DIALLO In 1999 four officers in street clothes approached Diallo, a West African immigrant with no criminal record, on the stoop of his New York City building, firing 41 shots and striking him 19 times as he tried to escape. They said they thought the 23-year-old had a gun. It was a wallet. The officers were all acquitted of seconddegree-murder charges.

PATRICK DORISMOND The 26-year-old father of two young girls was shot to death in 2000 during a confrontation with undercover police officers who asked him where they could purchase drugs. An officer claimed that Dorismond—who was unarmed—grabbed his gun and caused his own death. But the incident made many wonder whether the recent acquittal of the officers in the Amadou Diallo case sent a signal that the police had a license to kill without consequence.

TIMOTHY STANSBURY JR. Unarmed and with no criminal record, 19-year-old Stansbury was killed in 2004 in a Brooklyn, N.Y., stairwell. The officer who shot him said he was startled and fired by mistake. Police Commissioner Ray Kelly called his death “a tragic incident that compels us to take an in-depth look at our tactics and training, both for new and veteran officers.” A grand jury deemed it an accident. SEAN BELL In the early-morning hours of what was supposed to be 23-year-old Bell’s wedding day, police fired more than 50 bullets at a car carrying him and his friends outside a Queens, N.Y., strip club in 2006. Bell was killed, and two of his friends were wounded. The city of New York agreed to pay more than $7 million to settle a federal lawsuit filed by the family and two friends of Bell. The three detectives who were charged—one of whom yelled “gun,” although Bell was unarmed—were found not guilty of all charges. In March 2013 the NYPD fired four of the officers involved in the shooting for disobeying departmental guidelines on the scene. ORLANDO BARLOW Barlow was surrendering on his knees in front of four Las Vegas police officers when Officer Brian Hartman shot him in 2003. Hartman was 50 feet away and said he thought the unarmed 28-year-old was reaching for a gun. The deadly shooting was ruled “excusable.” But a federal investigation later revealed that Hartman and other officers printed T-shirts labeled "BDRT," which stood for “Baby Daddy Removal Team” and “Big Dogs Run Together,” and that they’d used excessive force during two separate investigations.

AARON CAMPBELL In 2005 Campbell was shot in the back by Portland, Ore., police Officer Ronald Frashour, who said he thought the unarmed man was reaching toward his waistband for a weapon. Witnesses said the 25-yearold was walking backward toward police with his hands locked behind his head moments before the fatal

shot was fired. A grand jury cleared Frashour of criminal wrongdoing but sent a letter to the county district attorney’s office condemning police handling of the incident. Campbell’s mother received a $1.2 settlement in the family’s federal wrongful-death lawsuit against the city of Portland.

VICTOR STEEN In 2009, 17-year-old Victor, who was riding his bicycle, refused to stop when chased by a police officer in a cruiser in Pensacola, Fla. In response, the officer aimed his Taser out of the driver’s window and fired and then ran over the unarmed teen, killing him. The deadly incident was captured on video. A judge ruled that no crime was committed.

STEVEN EUGENE WASHINGTON Washington was shot by gang-enforcement officers Allan Corrales and George Diego in Los Angeles one night in 2010 after he approached them and appeared to remove something from his waistband. The officers said they’d heard a loud sound in the area and the 27-year-old, who was autistic, was looking around suspiciously. No weapon was ever recovered. ALONZO ASHLEY Police say that 29-year-old Ashley refused to stop splashing water from a drinking fountain on his face at the Denver Zoo one hot day in 2011, then made irrational comments and threw a trash can. The responding officers, who didn’t dispute that he was unarmed, killed him with a Taser, saying he had “extraordinary strength.” No criminal charges were filed against them.

W E N D E LL A L LE N Allen was fatally shot in the chest by officers executing a warrant on his house on March 7, 2012, in New Orleans. The 20-year-old was unarmed, and five children were home at the time of his death. Police found 4.5 ounces of marijuana on Allen after they killed him. Former cop Joshua Colclough admitted that he shot an unarmed Allen and pleaded guilty to manslaughter. He accepted a four-year prison sentence.

How did u get into your Fashion Designing? I decide to design my 1 yr. old daughter a Halloween costume. I was poor and could not afford to buy her one. I asked her to lay down on the table. Every since then I have been creating a designing. Oh, I am self taught! I can make anything. That is the crazy part. I am from the Philippines and my family was poor. I enrolled myself in sewing school. I had to quit because I could not afford to pay the tuition. My uncle says that I am a jack of all trades. I even design furniture.

US adults score below average on worldwide skills test

In a global test measuring math, reading and problem solving, American adults scored below the international average, especially U.S. low-skilled workers. WASHINGTON — It's long been known that America's school kids haven't measured well compared with international peers. Now, there's a new twist: Adults don't either. In math, reading and problem-solving using technology — all skills considered critical for global competitiveness and economic strength — American adults scored below the international average on a global test, according to results released Tuesday. Adults in Japan, Canada, Australia, Finland and multiple other countries scored significantly higher than the United States in all three areas on the test. Beyond basic reading and math, respondents were tested on activities such as calculating mileage reimbursement due to a salesman, sorting email and comparing food expiration dates on grocery store tags.

Not only did Americans score poorly compared to many international competitors, the findings reinforced just how large the gap is between the nation's high- and low-skilled workers and how hard it is to move ahead when your parents haven't. In both reading and math, for example, those with college educated parents did better than those whose parents did not complete high school. The study, called the Program for the International Assessment of Adult Competencies, found that it was easier on average to overcome this and other barriers to literacy overseas than in the United States."The skills in the middle are required and we're not producing them," Carnevale said. Respondents were selected as part of a nationally represented sample. The test was primarily taken at home using a computer, but some respondents used a printed test booklet. Among the other findings: 

Japan, Finland, Canada, Netherlands, Australia, Sweden, Norway, Flanders-Belgium, Czech Republic, Slovak Republic, and Korea all scored significantly higher than the United States in all three areas on the test.



The average scores in literacy range from 250 in Italy to 296 in Japan. The U.S. average score was 270. (500 was the highest score in all three areas.) Average scores in 12 countries were higher than the average U.S. score.



The average scores in math range from 246 in Spain to 288 in Japan. The U.S. average score was 253, below 18 other countries.



The average scores on problem solving in technology-rich environments scale for adult ranged from 275 in Poland to 294 in Japan. The U.S. average score was 277, below 14 other countries.

Blessed with the knowledge and professional skills needed to survive as an independent recording and performing artist in today’s music world, John Pimp's talent goes from performing, songwriting and arranging, to recording and producing. His reputation started growing after doing drops for WJMI, a local radio station in Jackson, Ms. Formerly, he was a member of Q2B, which stands for Quick 2 Blast, a rap group which featured members: JOHN PIMP & DJ MAAD.

The group hit a brick wall when DJ MAAD was stabbed to death. This left John Pimp in utter devastation. "Now the group is split in a way that I never even thought about. Man, I mean, we talked about so much like getting money, making investments, signing other artist, but we never talked about dying. I didn't know how to handle this." Since then, he has used this tragedy in his life as motivation and has picked up the pieces and decided to carry on in honor of the group and make it what it started out to be.

He is working to be a successful artist/producer within the music industry. His goal is to oversee the creation of the music of recording artists. He is also a competent arranger, composer, and songwriter who can bring fresh ideas to a project as well as making any songwriting and arrangement adjustments. He often selects and/or gives suggestions to the mixing engineer, who takes the raw recorded tracks and edits and modifies them with hardware and software tools and creates a stereo and/or surround sound mix of all the individual voices sounds and instruments, which is in turn given further adjustment by a mastering engineer.

Independently, he is promoting his music in the south region and has gained great recognition for his grind. His goal is to achieve more success and build a larger fan base and become a household name in the music industry. "My goal is to create and develop high quality music for myself and artists of all styles, types and genres, and become successful in the music industry."

Born and raised in the 4.51 square mile city of Ypsilanti, MI, a small suburb about 20 minutes from Detroit, MI, LaWanda Lee grew up in a musically talented family. Being surrounded with music and spiritual upbringing, LaWanda began singing in community, school and church choirs , learning to blend melodic notes and follow direction. It wasn't until her early adult years, that LaWanda decided to take on music professionally and on a larger scale. She explains " I remember listening to my father create music and him having me and my brother and sister sing the harmony notes." "The feeling of hearing blended notes that sounds good , mixed with lingering lyrics showed me that music is my first true love, and my ultimate goal to have the world hear my story".

LaWanda's main interest from that point on has been music and songwriting. I always wanted to do something in music but sense I do not have the skills to single I was blessed with skills to promote and manage. I started my promotions back in 2007 or 2008 working with local hip-hop in Kansas City I didn't have the passion for that so I slowly backed away and then in 2012 I was introduced to the Reggae event seen here in Kansas City by a friend of mine and I been going hard ever since. What are some the obstacle have you encountered? Being a women in the Music industry and to top a women in the Reggae music industry.

Are you seeing success? Yes , yes! very much. I am in college for graphic web design and once I have completed that I will be attending school again for music management. I have been recognized by many great people. I have a wonderful graphic artist I have pulled in to join me he in Africa. I also have a guy that designs all my jewelry that lives in Ghana. I do see success for me but when I succeed I will not be alone. I have everyone with me I will not leave behind. Give us 3 words that describe you. I LOVE MUSIC. Can you tell the readers, 3 things they should know about you? I do everything that I do for the love of music. If you want to succeed in something make sure you have the love for it because if you don't and all you have is that you want money and fame you will not make it very fare. At just 20, Tom Andrews has had some fantastic experiences already in the music world. Since finding his voice at 13, and taking singing lessons, he has progressed from competing in small local competitions through to writing with some of the modern songwriting greats.

Although born just outside London, Tom has spent much of his life in the West Country of UK, where he has been blessed to grow up next to beautiful beaches and countryside. He soon realised however, that to follow his dream he

had to travel to find an opportunity, in doing so he has worked in London, New York, Los Angeles, Stockholm, and Bali, writing with producers from across the world.

Growing up in a non-musical family he was always influenced by the sound of soul and Motown, and then later by Queen and modern pop. Tom penned his first song at 14 in Glasgow with a writer called Greg Friel, this was called " Running in Circles" . They went on to write together several times, with one of their songs was chosen by Ellen DeGeneres to be performed live by Tom on her show. Tom was signed to her label 1111, and spent two years writing his album with amazing writers and producers such as Toby Gad, Jorgen Elofsson, RedOne, Fraser T

Smith and Julie Frost, and Arnthor Birgisson amongst others.

It soon became apparent that he had an innate love of writing as well as singing.

Unfortunately this first signing was an opportunity that went down in the school of hard knocks. But he says philosophically, that that' s all part of the journey…And it just gives him more to write about.

Despite his model looks and experiences, he remains firmly on the ground and still sings at karaoke in his seaside town where he is known and loved. He has built up an impressive army of TomAhawks across

Twitter, YouTube and Facebook and maintains a close relationship with his fans who have stuck by him through thick and thin.

He now has some 80 songs, some of which were chosen for his first album which never saw the light, and he is looking for the right opportunity to progress and make his dream a reality.

9.0 Magazine editor, Producer 9-0, interviews Trill Gang’s jack of all trades, Ray T. As we spoke, it became apparent that way too many people were claim Trill Gang. It appears that being trill has cause many to overstep the bounds of real to fake. Just do a internet search on the world trill and hundreds of results pop up. From Trill Boy to Trill Entertainment, it appears that copyrights, trademark and plain respect mean nothing to many. Listening to Ray T talk about growing up and around UGK, Pimp C and Bum B, you can get a great sense that he is speaking the Trill. Nothing artificial, water downed or hollow comes out of his mouth. In Ray T’s words: “TRILL originated in Port Arthur, Texas: LAND OF THE TRILL. The word TRILL has been around the streets in Port Arthur since the late 1980's. The Word TRILL means True and Real: based on how a person carries themselves. The first person who introduced Ray T to the word TRILL was an OG Homie by the name of Spoon Guy a.k.a. Spoony G. Ray T was part of a gang and they were very close to Spoon so they adopted the word and started using it daily. To the people in PA, it was second nature for them to use the word TRILL. In the 90's the rap duo UGK turned the gave it to the masses. Trill OG and Pimp C, one of the TRILLEST G'z as fans already know, is sadly no longer with them, but Trill Gang still reps for the southern pioneer by keeping his name alive, and pushing the label he started back in 2005, UGK RECORDS. Which music genres do you like? Well, I like all kinds of music, blues R&B, rap, hip hop country rap tunes. What do you do/talent/profession? I'm a jack of all trades I pretty much do everything. I wear different hats. I'm a manager, an artist and writer, motivational speaker, teacher and most importantly, a grinder.

How did u get into your profession/talent? Music has always been a part of who I am. As a child I used to record freestyles to beats off the radio. My parents was always playing music thru the good and bad times so it was a comfort zone that I always carried with me.

What are some the obstacles have you encountered? I've encountered a lot of hard work, everyday...with had to hand promotions. I've also encountered a lot of people who want the position but don't want the hard work or have the dedication to push for what they want. Are you seeing success? Everyday I see success when I introduce someone to my music the excitement and feed back is motivation to be the best I can be.

How do you feel about having fan? I don't call them fans I call them Trillsupporters these the people who believes in you and your movement. I appreciate all my Trillsupporters. I'm never Hollywood I'm a people person when they see me in the streets I'm giving nothing but positive vibes, resources, advice, whatever it takes for you to remember your encountered a real trill person. I'm a God fearing man who wants nothing but happiness amongst our people So, what makes you different? I'm not afraid to take the hard road I stand for Trillgang which means unity true to yourself before you can be real to others. The 1st Annual Kansas City Music Awards was held October 10, 2014 at Orland’s in Olathe Ks. At least 95 percent of state prisoners will be released back to their communities at some point. During 2010, 708,677 sentenced prisoners were released from state and federal prisons, an increase of nearly 20 percent from 2000.3 Approximately 9 million individuals are released from jail each year. Nearly 4.9 million individuals were on probation or parole at the end of 2010. In a study that looked at recidivism in over 40 states, more than four in 10 offenders returned to state prison within three years of their release. In 2009, parole violators accounted for 33.1 percent of all prison admissions, 35.2 percent of state admissions, and 8.2

percent of federal admissions. Twenty-three percent of adults exiting parole in 2010 – 127,918 individuals – returned to prison as a result of violating their terms of supervision, and 9 percent of adults exiting parole in 2010 - 49,334 individuals - returned to prison as a result of a new conviction.

Housing & Homelessness More than 10 percent of those entering prisons and jails are homeless in the months before their incarceration. For those with mental illness, the rates are even higher — about 20 percent. Released prisoners with a history of shelter use were almost five times as likely to have a post-release shelter stay. California Takes Overdue Stand Against 'Failed Drug Laws' The California Fair Sentencing Act, signed by Gov. Jerry Brown (D) late on Sunday evening, ensures that people who are convicted of certain offenses involving crack cocaine will no longer receive harsher punishments than people found guilty of the same crimes involving the powder form of the drug. Crack and powder cocaine are virtually the same drug, but crack is cheaper and more prevalent in low-income neighborhoods. According to the Drug Policy Alliance, a national advocacy group that opposes the drug war, people of color account for nearly everyone sent to California prisons for the specific crime of possession of crack for sale, a vaguely defined felony with a mandatory prison sentence of no fewer than three years. The new law will trim that sentence to two years, bringing it in line with the penalty for powder cocaine. The law will also make crack offenders eligible for probation for the first time since the 1980s. The change comes four years after President Barack Obama signed a bipartisan law that reduced -- but did not eliminate - the sentencing disparity between crack and powder cocaine on the federal level. State Sen. Holly Mitchell (D), chair of the California Legislative Black Caucus and the bill's author, addressed the sentencing discrepancy in a statement issued Sunday. “Whether sold as crack or powder, used on the street or in a corporate penthouse, the penalty for cocaine use should be the same for everybody,” she said. “The law isn’t supposed to be a pipeline that disproportionately channels the young, urban and unemployed into jail and joblessness.” Supporters expect several thousand people to enter probation instead of prison each year as a result of the sentencing change, and they estimate that taxpayers will save up to $1 million annually, according to Lynne Lyman, head of the California state branch of the Drug Policy Alliance. Lyman said the victory is also important on a symbolic level. "It represents a willingness by California's government to begin to undo a litany of failed drug laws that we have put into place over the last 40 years, and in particular it represents a blow to institutional racism," she said. California lawmakers created the sentencing disparity between crack and powder cocaine in 1986, the same year Newsweek called crack the “most addictive drug known to man” -- an assertion that has since been rejected by many scientists. The state's prison population, which had already begun to climb, exploded over the next two decades, surpassing 150,000 in 2009. That year, a panel of federal judges ruled that the state's prisons were so crowded that they violated the Constitution's ban on “cruel and unusual” punishment, a finding later affirmed by the U.S. Supreme Court. In response, Gov. Brown shifted

the responsibility for certain low-level offenders from the state to county governments, and the state prison population began to drop. But in the last two years, it has been creeping up again. Supporters of the new law hope that the governor will consider addressing the problem by supporting other sentencing reforms -- such as Proposition 47, a ballot initiative that would reduce penalties for simple possession of drugs and a range of petty crimes like shoplifting. In a sign that bodes well for such efforts, the bill signed on Sunday received far more support from the public and from lawmakers than similar measures introduced in the past. When Mervyn Dymally, an iconic African-American state legislator who died in 2012, threw his weight behind earlier versions of the bill in 2004 and 2007, none of his colleagues joined him as co-authors. This time, all 12 members of the Legislative Black Caucus and three other lawmakers co-authored the bill. Two hundred professors, multiple civil rights groups and community organizations around the country sent letters of support to Brown's office. A national shift in the public mood may help explain the happier fate of the latest legislation. Polls show that Americans across the political spectrum now prefer treatment to prosecution as a response to drug addiction, and liberals and conservatives have come together in a deeply divided Congress to draft laws that would soften the penalties for drug crimes. "A lot has changed in the last 10 years," said Lyman. "Another 10 years of failed drug war policies have made it obvious to people who didn't see it before that the current approach to drug laws was not working." Is There an Easier Way? There isn't an easier way to lose weight, but there is an easier way to figure out how to lose weight, if these formulas are a little too much for you. The absolute simplest involves one thing: Make small changes in your diet and activity levels every single day. With this method, you don't always know how many calories you're cutting, or how many calories you're burning. But, if you're doing more movement than before and you know you're eating less than before, you are creating a calorie deficit and the weight loss will follow, even if it's slow. 1985, David McCallum was 16 years old, but spent the following 29 years in prison for a false confession on kidnap and murder. He walked free yesterday after a judge overturned his conviction, saying it

was based on a false confession.

McCallum and Willie Stuckey, also 16 at the time, were arrested for the October 20, 1985 kidnapping and murder of 20-year-old Nathan Blenner in Queens. The next day, children found Blenner’s body on disused land in Brooklyn. He had been shot once in the head. The two teens were arrested shortly afterward and confessed to the crime. They were convicted the following year and sentenced to 25 years to life in prison. Each suspect initially blamed the other for the murder during videotaped interviews, but both quickly recanted. Their confessions had contradictions and what the Brooklyn district attorney, Kenneth P. Thompson, called “false fed evidence,” or details about the crime that appeared to have been provided by others. McCallum and Stuckey had long maintained their innocence. Stuckey died of a heart attack in 2001 at age 35, but McCallum, who is now 45, persevered in his attempts at clearing his name. His efforts were buoyed in February when Rubin (Hurricane) Carter, a former professional boxer who had been wrongly convicted of murder in 1967, then spent 19 years in prison before being freed, wrote a deathbed letter to Thompson asking him to investigate the case. In the letter, Carter wrote of McCallum and Stuckey: “Their two confessions, gained by force and trickery, are not corroborated even by each other; they read as if two different crimes were committed.”

“After a thorough and fair review of the case by my Conviction Review Unit and the Independent Review Panel, I have concluded that their convictions should not stand,” said Thompson, referring to a group of his staff and a group of outside lawyers who review old cases. “Mr. McCallum should be released from prison.” David McCallum’s first wish was to walk on the sidewalk, and then go home and enjoy his mother’s cooking, he said. He had no special requests, saying that after 29 years of prison food, anything would be wonderful. Since Thompson took up his post in January, a special unit headed by a Harvard law professor is reviewing dozens of cases, mainly homicides.

Sacramento Kings | Comment: Drafting shooting guard Nik Stauskas and signing point guards Darren Collison and Ramon Sessions makes it clear the Kings don't see themselves as rebuilding. They want to win. They have to prove they can, as our panelists aren't buying it. 24. Minnesota Timberwolves | Comment: Trading Love to the Cavs made sense, given that he probably was leaving in free agency and they brought in a big haul including two No. 1 overall picks. But it also meant the playoffs likely are out of the picture for this season.

Jeremy Lin, Nick Young (who will start the season injured) and Jordan Hill are decent role players but will have bigger roles than is ideal. 22. Detroit Pistons | Comment: The biggest addition of the offseason for the Pistons was coach and President Stan Van Gundy. He's regarded as a defensive specialist but also got a lot out of Dwight Howard, whom Andre Drummond resembles. The first year might be rough. 21. Indiana Pacers | Comment: Our voters took the Paul George injury hard. They were ranked between 20th and 22nd on every ballot after being the Easts No. 1 seed and reaching the conference finals. Losing Stephenson to the Hornets didn't help. 20. New York Knicks | Comment: Welcome to the Phil Jackson era. The Knicks president brought in his own coach, Derek Fisher, who will integrate the triangle offense system that made Jackson into one of the greatest coaches in NBA history. Can they master it in year one? 19. Atlanta Hawks | Comment: Before Al Horford went down last season, the Hawks were the third-best team in the East. Hes back, but the team spent its offseason embroiled in a racism controversy. Will that affect play? 18. Brooklyn Nets | Comment: Even with two veteran starters (Paul Pierce and Shaun Livingston) gone, the Nets are one of the most experienced teams in the NBA. Now, can their youngest starter, Brook Lopez, finally stay healthy? 17. Denver Nuggets | Comment: The Nuggets lost 21 more games last season than they did in 2012-13. Its safe to say Brian Shaws first season as coach was a disaster, from injuries to a lack of chemistry. But the talent remains, and the depth is back and healthy.

Voters had an understandably hard time ranking this team, everywhere from 11th to 21st. 15. New Orleans Pelicans | Comment: All nine voters placed the Pelicans, led by exciting power forward Anthony Davis, between 12th and 17th. That puts them just outside the playoff picture but clearly in contention. 14. Toronto Raptors | Comment: A historic season for the Raptors ended with the re-signing of all three of their key free agents, guards Kyle Lowry and Greivis Vasquez and forward Patrick Patterson. A repeat should be possible. 13. Miami Heat | Comment: The Heat didn't exactly trade places with the Cavaliers despite essentially trading small forwards. Dwyane Wade, Chris Bosh and Luol Deng should keep this team very respectable.

12. Phoenix Suns | Comment: After being the best team not to make the playoffs last season, the Suns drew respect from our voters, who put them as ... the No. 9 team in the West. 11. Washington Wizards | Comment: We finally arrive at our No. 3 Eastern Conference team, and the Wizards justified this treatment last year. They have a talented young backcourt and brought in crucial veteran reinforcements for the frontcourt. But they've already fallen upon injury issues. 10. Memphis Grizzlies | Comment: No. 10 in our rankings but No. 8 among West teams, the Grizzlies defensive formula might not be pretty to watch but has been rather effective the past few years. They'll be contenders, if not for the title then at least the playoffs. 9. Dallas Mavericks | Comment: After a run of 11 consecutive 50-win seasons, the Mavericks haven't hit that mark in three years. But landing Parsons from the Rockets and Tyson Chandler from the New York Knicks could be a boon. 8. Houston Rockets | Comment: The Rockets should be fine without Chandler Parsons, Jeremy Lin and Omer Asik. But our voters were slightly skeptical, dropping them a few spots. Dwight Howard and James Harden could use the motivation. 7. Portland Trail Blazers | Comment: The Blazers seem primed for improvement with Damian Lillard entering his third season and LaMarcus Aldridge entering a contract year. The counterpoint: What room is there? The crowded West clearly was an issue for our voters. 6. Golden State Warriors | Comment: Mark Jackson was a great motivator and popular coach with his players. But Steve Kerr looks to leverage this team even more than his predecessor, and our voters are buying in. 5. Chicago Bulls | Comment: Derrick Rose, Pau Gasol, Nikola Mirotic and Doug McDermott can only mean one thing: Offense is back in Chicago. Given that the defense was elite-tier last season, its easy to understand why our panelists were convinced. 4. Los Angeles Clippers | Comment: What difference will the exit of Donald Sterling make? On the court, this team is very similar. The Clippers were the third-best team in the West last season, and here they come in third in the conference to start this one. 3. Cleveland Cavaliers | Comment: Everyone is buying into the Cavs despite a 33-49 showing last year. LeBron James has that kind of influence. It seems nearly impossible to imagine this team not winning 17-plus more games this season, especially with Kevin Love also in the fold, and that earned them one first-place vote. 2. Oklahoma City Thunder | Comment: The Thunder were a popular pick to win the Western Conference, as they should be healthy by then, but they still come in behind the team they lost to in the West finals last postseason. They did draw two first-place votes and were in the top four on all nine ballots. Now, though the first concern is Kevin Durant's broken foot. 1. San Antonio Spurs | Comment: The defending champions drew much respect after an offseason spent maintaining. Coming off a historic playoff performance, the Spurs were first on six of nine ballots. Every year it becomes harder to imagine them ever falling out of the top five or so.
