The gardens are perfect for post ceremony drinks and canapes.

Entertainment Sails Resort Port Macquarie by Rydges has a number of entertainment options that may be suitable for your reception. We have adequate space and facilities for bands, entertainers and DJs at your wedding. All entertainers should contact the Resort to discuss equipment delivery, set up and requirements prior to the function date. Alternatively, the Resort has a sound system allowing guests to use their personal choice in music, if you wish to bring your CDs and/or mp3 player.

Safety & Security As we are a resort destination we strongly recommend the hire of a security guard between the hours of 9:00pm to 12:30am. A security package is available at $180 for a three hour period to ensure the safety and security of your guests.

DEFINTIONS For the purpose of this document, the following definitions apply:“Function Details” means the Banquet Event Sheet form provided to you prior to your function. “Working Day” means any day from Monday to Friday, 9 a.m. to 5 p.m. inclusive except public holidays. “Estimated Function Value” means the amount calculated on the basis set out in the Hotel/ Convention Centre proposal. CONFIRMATION / DEPOSIT All reservations must be confirmed in writing, together with the specified deposit and signed Terms and Conditions along with the Business Proposal documents, within 7 working days of the Business Proposal being sent. Should any of the written confirmation, deposit or signed Information & Policies document not be received within this time frame, The Hotel / Convention Centre reserves the right to requote for any function space and accommodation. A holding deposit of 30% or $1000, whichever is greater, is required within 7 days of booking – please contact the sales team if you require a pro-forma invoice for the deposit The Hotel / Convention Centre reserves the right to assign another room for the organised function without notice in the event the room originally designated for such function shall be unavailable or deemed inappropriate in the opinion of The Hotel / Convention Centre. FINAL PAYMENT Final payment representing the total cost less the deposit is due 7 days prior to arrival via direct debit, credit card, or by making cash payment. A pro-forma invoice will be sent prior to your event for full prepayment. Should pre-payment not be received by the day of your event, a Credit Card will be required to settle the account on the day. Additional charges are to be settled upon departure from Sails Resort – by Rydges, please make appropriate arrangements for settlement of account and advise details prior to arrival. If you elect to pay your account by credit card or other card using a credit payment facility, Sails Resort – by Rydges reserves the right to charge a payment processing fee in order to cover its associated costs. Payments made by Mastercard and Visa will incur a transaction fee of 1.5% and Amex, Diners & JCB of 3.5%. - Frequent flyer points do not apply to conference and catering bookings

- A valid tax invoice will be issued at the completion of your function or event irrespective of payment method. ATTENDANCE NUMBERS & REDUCTION CHARGES Any reductions with regards to function space or attendance numbers, will incur a charge. This charge will be at the discretion of the General Manager and payable immediately to the hotel or with the final account payment. Preliminary final attendance numbers to be advised 14 days prior to arrival. Final attendance numbers are due 5 working days prior. Should final numbers not be received by this time, the invoice will reflect the most recent number given to the hotel. Please note that numbers area required for ordering and rostering purposes. FOOD & BEVERAGE POLICY The Hotel/Convention Centre practices responsible service of alcohol and we are obliged to inform you that it is against the law for Hotel/Convention Centre staff to serve underage or intoxicated guests. FUNCTION DETAILS AND INSTRUCTIONS (Client Event Sheets): In the event that The Client, after confirmation of an event, decides to change the original booking (e.g. reduce numbers, cancel catering or accommodation etc.) subsequently affecting the original prices quoted, The Hotel / Convention Centre reserves the right to requote according to the changes made to the original quoted booking. Client Event Sheet Details including but not limited to menus, beverage arrangements, audio visual requirements, entertainment, room set ups, floor plans, starting and finishing times etc. MUST be signed as correct and returned no less than 14 working days prior to the event. The Hotel/Convention Centre reserves the right to cancel the function if client event sheets are not signed by this time. Minimum guaranteed guest numbers are required no less than 5 working days prior to an event and charges will be based on guaranteed numbers or final head count, whichever is greater. It is the responsibility of The Client to contact The Hotel / Convention Centre regarding final numbers. Where no guaranteed numbers are supplied, guest numbers as originally advised will be catered for and charged accordingly. This must be communicated to an event coordinator. If the number of guests attending the function differs by more than 10% from the number of persons notified to the Hotel/Convention Centre, the Hotel/ Convention Centre may review the price charged for catering and may relocate your event to an alternative function room within the Hotel/Convention Centre. FUNCTION DETAILS AND INSTRUCTIONS (Client Event Sheets): Signage provided by The Client is restricted to the booked function venue and cannot be displayed in any public area without prior consent of The Hotel / Convention Centre management. Use of any adhesive on venue property is prohibited. You must ensure nothing is nailed screwed or adhered in any way to any wall, door or other part of the building without prior consent of the Hotel / Convention Centre Management. Although accidents often happen, damage to our function rooms can easily be prevented by good communication between your organiser and our team when arranging posters and displays. If necessary, repair or replacement charges may be passed on. No staples, sticky or masking tape, glues, pins, or velcro on our walls. The Hotel/Convention Centre does not provide technical support for AV Equipment. Technical

support can be arranged via a subcontractor on request. Additional charges will apply. In the event a function should go beyond the agreed finish time and / or beyond midnight, The Hotel / Convention Centre reserves the right to impose a labour charge of $275.00 per hour or part hour the function space is occupied. MENU SELECTION Please note your menu selections are required 14 days prior to your event date. Without confirmation within the required time frame a Chef’s selection menu will apply. CHANGE OF DATE We understand that you may need to change the date of your function. We will attempt to fit in with any changes of date where space is available. Your deposit will be rolled over for the new date subject to availability and only on one occasion. If the requested dates are not within 30 days of the original dates booked, then the change will be treated as a cancellation (see cancellation terms & conditions). CHANGE OF ROOM SET UP If in the case that a pre-approved room set up is changed by the company or its representatives within 24 hours of an event commencement. The Hotel reserved the right to charge all labour hours require to re-set for the event. This charge will at $70.00 per labour hour, per staff member and will be determined by the Hotel Management depending on room set up requirements. OUTSIDE CONTRACTORS For all exhibitions and stage set ups produced by outside contractors, plans must be approved by the Conference Sales Manager a minimum of 30 days prior to the event. The outside contractors must liaise with the Conference Sales Manager in all matters of delivering, set up and break down. All companies must have public liability insurance to operate at Sails Resort – by Rydges. Any contractors or subcontractors appointed by the client will, for the purpose of these policies be deemed as legal agents for and on behalf of the client. SECURITY Whilst every effort is made by the Hotel/Convention Centre to protect your property and equipment, it is the responsibility of the client to put in place appropriate security measures to guard against theft. Special tasked security personnel may be required for functions above 80 guests, cost which will be borne by the client.

CANCELLATION We would be disappointed if your event was to be cancelled. However, we realise circumstances occasionally make this necessary. Cancellation of function rooms and accommodation must be advised in writing. If the Event is cancelled, the following conditions will apply:NOTICE OF 6 MONTHS or more Your deposit will be refunded provided that the booked space is subsequently re-booked. NOTICE OF 4 MONTHS 50% of your deposit will be refunded, provided that the booked space is subsequently re-booked NOTICE OF 3 MONTHS OR LESS Due to the cost incurred, at this stage, unfortunately no refund of your deposit can be made. A further cancellation fee equal to 20% of the total value of the event, will be made at the discretion of the General Manager of Sails Resort – by Rydges and will be payable immediately upon request by the General Manager. Rydges Hotels and Resorts (ABN 48 050 035 268)trading as Sails Resort – by Rydges is not responsible for the cancellation of the event due to any reason beyond its reasonable control including industrial dispute. NOTICE OF 2 MONTHS OR LESS In the event of a cancellation made within 60 days of the event, the full amount of the deposit will not be refunded, full room hire will be charged along with 50% of food & beverage items NOTICE OF LESS THAN 1 MONTH In the event of a cancellation made as late as less than 1 month to the function date, full payment of the estimated cost of the event will be incurred. PREVENTING DAMAGE The patron is financially responsible and agrees to indemnify Rydges Hotels and Resorts trading as Sails Resort – by Rydges for all damage sustained to the Hotel and its grounds during an event as an action of invitees and or guests of the organiser. This also applies to any damage caused during the event staying overnight in the Hotel. No staples, sticky, blutac or masking tape, glues, pins, or velcro on the walls, windows and doors in the function

rooms and surrounding foyer areas (display boards can be arranged for your event at an additional charge). INSURANCE Rydges Hotels and Resorts (ABN 48 050 035 268) trading as Sails Resort – by Rydges takes all care with the security and protection of property and guests, we are unable to accept any responsibility for damage or loss of property left in the Hotel prior, during, or after an event, as the case may be. We recommend patrons arrange their own insurance. ROOM ASSIGNMENT If the room or rooms reserved herein cannot be made available to the Patron for causes beyond the control of the Hotel, the Hotel reserves the right to substitute similar or comparable accommodation for the event, which substitute shall be deemed by the Patron as full performance of the Hotels obligations under the agreement. This applies to Accommodation, Meeting and Banquet Rooms. Please note that conference space reserved during the days is subjected to reletting for the evening functions, unless alternate arrangements have been made. BEHAVIOUR The Client will be responsible to ensure the orderly behaviour of their guests and The Hotel / Convention Centre reserves the right to intervene where it is deemed appropriate. The Hotel / Convention Centre reserves the right to request The Client to have mandatory security for any function it deems necessary. Where the Hotel / Convention Centre have any reason to believe an event or function will affect the smooth operation of The Hotel / Convention Centre business, it reserves the right to cancel the event without notice or liability. The Hotel/Convention Centre has no responsibility to you for any costs, damages or expenses that you may incur in relation to the Hotel/Convention Centre’s termination of your event. The Hotel/Convention Centre may exclude or remove any persons or possessions from your function or from the premises. At no time will The Client commit any act or permit its employees, agents or invitees to commit any act that is illegal, noisome or offensive or is in breach of The Hotel / Convention Centre’s rules or any statutes, bylaws, orders, regulations or other provisions having the force of the law including, but not limited to, The Hotel / Convention Centre’s Liquor Licence and Smoking regulations, Fire Regulations and Health & Safety Regulations.

CONDUCT OF EVENT The Patron agrees to begin its Event at the Scheduled time and agrees to have its guests, invitees and other persons vacate the designated event space at the closing hour indicated. If the hotel has reason to believe that the event or any part of it will effect the smooth running of the Hotel business, its security or reputation, the Management reserves the right to cancel the Event or any part of it at its discretion and without notice or liability. The Event shall be conducted in all respects in an orderly and lawful manner and in accordance with the conditions attached to the Hotels Licences granted pursuant to the Liquor Act 1982. The Hotel reserves the right to terminate the event immediately in the case of any costs, damages or expenses whatsoever arising from such termination. The hotel reserves the right to exclude or remove any and all undesirable persons from the Hotels premises without liability. FORCE MAJEURE: In the case of events such as earthquake, fire, flood, cyclone, civil disturbance or industrial action preventing The Client or The Hotel / Convention Centre from carrying out their obligations under this agreement, neither The Client, nor the Hotel/ Convention Centre shall be liable for the nonperformance of this agreement. - In the event The Client cancels for reasons of Force Majeure, all payments will be refunded except the initial deposit. - If the Hotel / Convention Centre cancel the agreement due to Force Majeure all payments and the initial deposit will be refunded. In no event shall The Hotel / Convention Centre be liable for the loss of profit or consequential damages whether based on breach of contract, warranty or otherwise. GOVERNMENT TAXES, CHARGES OR LEVIES: Rates/prices are subject to change without notice due to the imposition of Government taxes, charges or levies. GST – unless otherwise specified, prices and amounts payable (including any adjustments to price or amounts payable) will include GST at the current applicable rate. Subject only to variations specified in a subsequent event order signed by The Client, this Information & Policies document constitutes the entire agreement of the parties and shall supersede all prior offers, negotiations and agreements in connection with the function. PUBLIC HOLIDAY Any event that falls on a public holiday will incur a 15% surcharge ACCOMMODATION BOOKINGS Block bookings can only be held if a rooming list is to be compiled from the event organiser and the account is settled in one lump sum amount. Should delegates be managing their own accommodation, a customised webpage will be created in order for delegates to book online and receive the discounted rate. For a small number of accommodation rooms (less than 10 rooms), rooms will only be reserved once guest names are received along with payment instructions. For all accommodation blocks, there needs to be an agreed ‘Cancellation & Release Back Policy’, please find this policy below: 60 – 30 days prior Rooms will be released and no cancellation fee will be incurred, deposit refunded 30 - 14 days prior One nights’ accommodation charged per room cancelled 14 days prior Each room night cancelled will be subject to a cancellation fee equal to the full accommodation component (100%) on all guaranteed rooms cancelled. Any direct costs incurred by the hotel will be passed onto the client. Any additional rooms will be on a request basis at the best available rate, subject to availability. All cancellations must be received in writing and must be re-confirmed by the Hotel. NO SHOWS “No Shows” will be subject to a minimum charge of one night’s room charge, to a maximum of all room nights booked, at the contracted rate for the entire stay. ACCOMMODATION PAYMENT POLICY Where a company or organisation does not have credit approved with the hotel, full pre-payment of all accommodation charges is required on or prior to arrival. Where credit approval has been granted by the hotel to a company/organisation, that company/ organisations written authorisation will be accepted and full payment is required 14 days following receipt of the hotel’s invoice. In the event the company/ organisation has not guaranteed all charges Sails Resort - by Rydges will request a credit card imprint or cash deposit in lieu of that authorisation.
