Sydney Cat Cafe Terms and Conditions of Promotions
VFW Group Pty Ltd (trading as Sydney Cat Café) (“Sydney Cat Café”) administers competitions, contests, sweepstakes and giveaways (“Promotions”). Promotions are administered via www.sydneycatcafe.com.au, a website owned by Sydney Cat Café or using third party software or websites (the “Site”) Please read these Terms and Conditions carefully before participating in a Promotion. By participating in a Promotion administered by Sydney Cat Cafe, you agree to be bound by these Terms and Conditions. These Terms and Conditions relate both to the administration of and participation in a Promotion and, as applicable, the administration of and participation in the reward flowing from any Promotion. These Terms and Conditions apply to both the original participant and any guests/co-‐‑participants of the participant (“you”). Variation to Terms and Conditions Sydney Cat Café may vary these Terms and Conditions at any time by updating them. Any variations will only apply to Promotions and participation in Promotions made after these Terms and Conditions have been updated. Additional Terms and Conditions Each Promotion is also participated in subject to any additional terms and conditions of Sydney Cat Café or of any third party partner for the particular event (“Additional Terms”). The Additional Terms may be disclosed as part of the event information on The Site, our partner’s website and at Sydney Cat Café and at our partners’ premises at the time of purchase. The Additional Terms are also available from Sydney Cat Café on request. Any Promotion resulting in attendance at Sydney Cat Café or an event held by Sydney Cat Café, including any event held jointly with Sydney Cat Café, is subject to the Terms and Conditions of ticket sales as through the participant were the purchaser of a ticket. The Terms and Conditions of ticket sales are also available from Sydney Cat Café on request. General Terms and Conditions Except as specified in these Terms and Conditions and except to the extent required by law (including the Australian Consumer Law) Sydney Cat Cafe otherwise has no liability to you. Refunds, exchanges and replacements
1. Sydney Cat Café will not offer any refund, exchange, replacement or cash-‐‑ equivalent for prizes created by Sydney Cat Café flowing from Promotions, subject to the Australian Consumer Law. Prizes are not redeemable including on cash, credit, or goods. 2. Sydney Cat Café will not offer any refund, exchange, replacement or cash-‐‑ equivalent for prizes created by third parties flowing from Promotions. The participant acknowledges that Sydney Cat Café is not responsible for the condition or quality of any goods created by third parties, in whole or in part, that form the prize or part thereof of a Promotion. Prizes created by third parties are not redeemable including on cash, credit, or goods. 3. Sydney Cat Café may, at its absolute discretion, cancel, reschedule or modify a Promotion. Sydney Cat Café will accept no liability in respect of any such changes, however it will endeavour to communicate such changes to its audience and to participants in advance. Eligibility requirements 4. Unless otherwise expressed in the rules of a Promotion, participation in a Promotion is subject to egilibility requirements. In particular, the following conditions apply unless otherwise specified: (a) Participants must be over the age of eighteen (18) years old. Children under this age will not be permitted to participate in any Promotion. (b) Participants must, unless otherwise stated, be located within the Sydney, NSW region. (c) As part of accepting these Terms and Conditions, you accept the Waiver set out in clause 12 below, and may be required to sign a hard copy upon receipt of your prize, if any. 5. By participating in a Promotion, you warrant and acknowledge that you meet the eligibility requirements set out herein and in the rules of the particular Promotion. General rules 6. A participant is entitled to one (1) entry into a Promotion. 7. It is the responsibility of each participant to understand and comply with the rules of a Promotion. Sydney Cat Café is not responsible should your entry be invalidated as incomplete or non-‐‑compliant. 8. Sydney Cat Café administers Promotions in good faith. Participants are required to exercise good faith in participating in a Promotion. Disqualification 9. Sydney Cat Café may, at its absolute discretion, disqualify a participant whom it considers has not complied with the rules of the competition, or where it considers that the participant has not engaged with the Promotion in good faith.

10. Sydney Cat Café may, at its absolute discretion, disqualify a participant who creates any content in connection with the Promotion that is considered inappropriate or obscene. 11. Sexism, racism, or other abusive or offensive content will not be tolerated, and any entry containing such content will be immediately removed and its author disqualified as a participant. Waiver 12. You understand and acknowledge that by participating in the Promotion there is no guarantee of winning the Promotion. You acknowledge that you voluntarily participate in the Promotion. You agree to hereby release Sydney Cat Café all persons or corporations associated directly or indirectly with the conduct of Sydney Cat Café, the Promotion or related activities from all Claims and hereby indemnify them against all Liability for all injury, loss or damage arising out of or connected with participating in the Promotion, attending any Sydney Cate Café or any event in connection with Sydney Cat Café. This release and indemnity shall extend to and Sydney Cat Café, Maggie’s Rescue, managers, officers, agents, contractors, and volunteers which is involved directly or indirectly with the activities of Sydney Cat Café. This release and indemnity continues forever and binds my heirs, executors, personal representative and assigns. Claims means claims, demands, proceedings Liability includes liability for the negligence of Sydney Cat Café, Maggies Rescue, or any other person in connection with: a) any tortious duty of care including but not limited to any claim under the Civil Liability Act 2002 (NSW); and b) any claim for breach of contract. This waiver is not intended to operate in any way that would render it unenforceable or void by operation of law. If, other than by reason of this clause 12, any part or application of this waiver would be found to be unenforceable or void by operation of law, then this waiver is to be read down so as to operate only to the extent it is enforceable and not void by operation of law. Facebook competitions 13. Sydney Cat Café is responsible for the official rules of any Promotion and the terms of eligibility requirements. 14. To the full extent permitted by law, you completely release Facebook in respect of the Promotion. 15. You acknowledge that the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.

16. You acknowledge that the Promotion does not require you to share any content with Facebook friends, nor to tag any Facebook friends in any content, and that if you do so, you do so at your own volition. Collection and delivery of prizes 17. An email or message confirmation will be sent to the successful participant or participants of of Promotion. Please retain a copy of this communication as proof of successful entry. 18. Where a Promotion results in a physical prize, Sydney Cat Café will endeavour to mail the item, by regular Australian Post, to an address within Australia to be nominated by the successful participant, within 7 business days of the announcement of the successful participant. Sydney Cat Café may, at its absolute discretion, choose an alternative means of delivery or provider. Should the successful participant fail to nominate a recognised postal address within Australia within 7 days of the announcement, Sydney Cat Café may award the Promotion to a different participant. 19. Where a Promotion results in a non-‐‑physical prize, for example, attendance at Sydney Cat Café or a Sydney Cat Café event, the Terms and Conditions of ticket sale apply to the successful participant and their guests if any as though they were purchasers of tickets. Sydney Cat Café will provide further information and conditions in relation to non-‐‑physical prizes, such information and conditions are final and non-‐‑negotiable. Errors 20. While Sydney Cat Café takes all reasonable care to ensure that Promotions and associated prizes are accurately described and administered, sometimes errors may occur. Sydney Cat Café may cancel or alter a Promotion, prize or reward as a result of any such error. Sydney Cat Café will endeavour to communicate this to you in advance of such change. 21. The Sydney Cat Café Privacy Policy is incorporated into these Terms and Conditions and apply to all sales through this Site and to the administration of and participation in any Promotion. General 23. The term “including” when used in these Terms and Conditions is not a term of limitation.
